The constitutionality of bills passed under the Holman rule has been questioned by legal scholars in light of the U.S. Supreme Court's ruling in United States v. Lovett (1946). That case dealt with an act of Congress, passed during the Red Scare's McCarthyism, that defunded the salaries of 39 employees accused of having Communist sympathies. The Court held that, under these circumstances, the Act was no "mere appropriation measure", but was effectively a bill of attainder prohibited by Article I, Section 9, of the Constitution.

The Holman Rule has been a favorite blunt instrument for the Freedom Caucus this session. It was read into the record and approved in Jan 2023. So, it is an applicable House rule the FC intend to use it as a cudgel to gut programs. It can be slipped in during the markups, and there is nothing anyone can do to stop it except to not approve the entire bill it is attached to.
You have to introduce a new clean version of the bill and get it through the entire committee process again during the current session where it could be fettered with yet another Holman Rule before it gets to the final vote. It's a poison pill and a dirty trick that has been used numerous times in the past by both parties since it's introduction after the Civil War.
Senior members tend not to use it because the knife cuts ways. The Democrats can easily apply it to any appropriations the GOP might favor. IE: a program or regulation could be approved, but immediately defunded, and effectively still-born.
I'm sure Bobo feels quite smug about using it. All the more reason to get her out of office ASAP.
