Donald Trump has departed the Manhattan federal courthouse and is on his way to a New Hampshire event ahead of next week's primary.

The former president voluntarily attended jury selection in a civil trial to decide how much money in damages, if any, he must pay E. Jean Carroll for his 2019 defamatory statements about her sexual assault allegations.

Trump has not indicated if he will attend Wednesday's session. He has announced he will miss Thursday's hearing due to the scheduled funeral of Melania Trump's mother.

There's a docket entry from January 11 bouncing the motion of Peter Gabra, an associate in Habba's firm, for admission pro hac vice. He had included a certificate of good standing from the federal district court in New Jersey, but failed to include a certificate from the New Jersey Supreme Court. As I've mentioned before, the requirements for pro hac vice motions are pickier than one might think, and busted motions happen all the time, even to first-rate firms. But this was a stupid flub, and, more important, it's a bad look that they didn't fix it right away. And it's really disrespectful to try to participate without being admitted.

Inner City Press's reporting from the first hour of the trial (pre jury selection) was telling, I thought. Habba making rude remarks to the judge, questioning everything, complaining that they didn't have instructions from the judge about such and such.

Oh for a timely transcript! (Yes, I know; transcripts don't grow on trees--I just believe that given the importance of these trials, an extra step should have been taken).

I take some commenting of this case from skimming MTN.

One point raised is that Alina Habba is making an ass of herself. It was pointed out that federal courts stick much more to decorum than state courts. Her presentation raises eyebrows among the profession. Like addressing the court by Sir or by name rather than Your Honor. It was pointed out that according to her companies website their lawyers do not have expertise in the federal court system.

MTN mentioned that Carrolls lawyer presented and put on record to the jury all the social media postings, including the rants done in his name while sitting in the court room.

I assume by this she is saying: since Carroll is giving testimony about the White House denial of the rape, that means I can cross examine her (?) about whether or not the assault occurred? Or possibly: since Carroll is giving this testimony, TFG can testify that he didn't do it?

ETA: Habba's intent seems to be to literally testify herself (wrong on so many levels) while Carroll is being questioned. Reaching new heights for "speaking objection." Judge has slapped her down two, three times? Crazy.

Donald Trump has been in the courtroom Wednesday morning watching the testimony of E. Jean Carroll, shaking his head at one point when Carroll accused him of assaulting her and conversing with his attorneys while she testifies.

After the jury left the courtroom for a mid-morning break, one of Carroll’s attorneys, Shawn Crowley, told the judge Trump could be heard “loudly saying things” about Carroll’s testimony, like “it’s false” and “she’s gotten her memory back." Crowley said since it's loud enough for her to hear at the table two rows in front of Trump, she said it’s possible the jury could hear it, too.

On Wednesday morning, Trump entered the courtroom before Carroll, who was in an anteroom since she was going to be called as the first witness. He slung his winter coat onto the back of chair and sat down between his attorneys. As Carroll was called to the witness stand, there was no visible reaction from Trump, and she did not turn to look toward him.

When Carroll testified that Trump assaulted her, lied and shattered her reputation, Trump shook his head from side to side.

For most of the first hour of testimony, Trump was looking straightforward, passing notes to an attorney and leaning over to talk to his lead lawyer. He otherwise did not appear to gesticulate or make any other physical reaction to the testimony.

When Carroll is interrupted by Habba for an objection, after the judge overrules it, her attorney seems to just move on. Is there a reason she doesn't ask again so Carroll can answer fully? Like, "...that these women did very well..." I'd like to know what that means or what Carroll assumes tfg means by that.
"He said people like me should tread carefully" Kaplan just goes to another question after the objection is overruled. Why would she not follow up with "people like me" what does that mean and what does "tread carefully" mean.

IANAL but I'm following this case pretty closely, and based on Habba's opening, I believe her point is that: since fuckhead is not supposed to be able to deny the assault under testimony, but only discuss his motivation the things he said about her, the issue of the assault must be off the table, with only the defamation motivation up for testimony--so she is saying her, "this is non-responsive to the issue that is being allowed."

I've been thinking that the mentions of the assault on direct were a surprise to Habba, based on her various objections. So not prepared....

Habba is going nuts as Robbie Kaplan questions Carroll about all the harrassment TFG has been engaging in since the first trial.

In her opening, Habba said that "all of this" is about "two statements" that TFG made in 2019. She presented the trial as if it was ridiculous to blame TFG for all the harrassment, when he had only made "two little statements." At the time, I wondered if she'd read any of the filings since the first case, when it was clear that every damn word TFG has ever said was going to be brought into this case as part of punitive damages.

I don't wonder any more. It's clear she didn't have a clue.
