As I've said, Trump lives in two different realities, one of which he actually does control.
Epshteyn is a lawyer, meaning that he should be operating in the main reality, where stuff is, y'know ... real. Trump prefers the other one, where anything he says is true no matter how ridiculously false. It sounds like Epshteyn is trying to navigate the two realities, but leaning more towards the unreal, Trumpian one. And maybe even confusing which one is which. Which might could get him in trouble with the real reality of courts and judges and stuff.

I have a theory that the purpose of Boris Epshteyn is to give Trump the excuse that "No one told me, Epshteyn talked to those people but he never told me any of this".

Federal prosecutors have obtained an audio recording of a summer 2021 meeting in which former President Donald Trump acknowledges he held onto a classified Pentagon document about a potential attack on Iran, multiple sources told CNN, undercutting his argument that he declassified everything.
The recording indicates Trump understood he retained classified material after leaving the White House, according to multiple sources familiar with the investigation. On the recording, Trump’s comments suggest he would like to share the information but he’s aware of limitations on his ability post-presidency to declassify records, two of the sources said.
CNN has not listened to the recording, but multiple sources described it. One source said the relevant portion on the Iran document is about two minutes long, and another source said the discussion is a small part of a much longer meeting.

The recording was made at Bedminster in July 2021 by Trump aide Margo Martin when Trump met with ghost writers for Mark Meadows’ book, per sources familiar. Martin had her laptop and devices imaged earlier this year and got asked about the tape when she testified in March.
Trump is said to have had the meeting taped because, in general, he does not trust journalists and authors to necessarily reflect his comments accurately. Martin typically taped the meetings, sources said.

I am more and more convinced that the video we saw of boxes being carried from an SUV and loaded into the plane that Trump took to Bedminster more than likely contained some classified documents, probably including the one Trump was bragging about to people who did not have security clearance. This was something several of us had speculated/wondered about when that video was discovered after we learned that the FBI had executed a search warrant that produced a number of classified documents and other government papers and property from Mar-a-Lago.
I don't think it matters whether he specifically allowed them to read the words from the document or if he paraphrased what was contained in that document. To the extent that he talked about anything in the document that was classified information, if those people did not have proper clearance to hear that information, that is bad, bad, bad.

Who here thinks there are no documents hidden at Bedminster? And who thinks the search his attorneys did and certified that there were none is just as bogus as the one done at Mar A Lago 100 odd secret documents ago?

Yes, I do believe he took documents with him to Bedminster. And I think there is suspicion by the Special Counsel that he took documents to other properties, and that is why he was able to get the judge to instruct the Trump team that they needed to have searches conducted at other properties. The Special Counsel was also able to interview individuals that were involved in the searches. I think the document in question for April 2021 was probably recovered, I remember there was some earlier reporting that among the documents was a document that detailed military capabilities and nuclear weapon status of some other country - I bet this is the document in question.

But it will be difficult to establish that Mr. Trump crossed the line from vigorously and lawfully defending his conduct to engaging in criminal obstruction.
No citizen is required to cooperate in a Department of Justice criminal investigation, as President Biden and others have commendably done. Nor can he actively obstruct such an investigation by unlawful means. The government will have a hard time proving beyond a reasonable doubt that Mr. Trump willfully crossed this line.

There is no category of crimes called “process crimes”, no matter what wikipedia says about it. That’s some made-up construct intended to diminish the culpability of the offender.
Back when this came up, I did a Lexis search on the term “process crime.” There were seven hits, IIRC. In each case, the term was immediately followed by the word “scene.”

One thing that seems confirmed and obvious now, to me at least, is that it was Corcoran who dropped the dime and ratted out Trump for the false statement in response to the subpoena.
