As always, Bob is right. Her Highness Dr. Orly Taitz Esq BBQ WTF, the Birther Queen, graced the "Trial of the Century" IIRC. Southern Poverty Law Center covered it with the seriousness it deserved. And to stay on track, James David Manning was a huge supporter of Walt Fitzpatrick, he never called him the Long-Legged Mack Daddy as he did President Obama. Don't remember Walt being there. Overall, we rate Law Enforcement Today far-Right Biased based on story selection and editorial positions that align with the conservative right. We also rate them Mixed for factual reporting due to the use of poor sources, lack of transparency, and failed fact checks.

Analysis / Bias
In review, Law Enforcement Today publishes news through either a generic staff label or through outside writers. Story selection almost always favors the right and utilizes emotionally loaded headlines such as this: Protester throws first punch at Trump supporter. Immediately regrets it. and this Police-bashing, tax-dodging Al Sharpton got $1 million last year from own charity, records show. WASHINGTON, DC — The National File has reported that evidence it received suggests that the FBI under former director Robert Mueller staged a hoax in 2010 to falsely entrap a man on a rare gun charge. Despite several questions and contradictory information, the 2010 case is now being used as a precedent to prosecute a protester who was at the Capitol building on Jan. 6 of this year.

According to National File’s Patrick Howley, the FBI staged a hoax in Madisonville, Tennessee in 2010 to falsely entrap a man on a rare gun charge. The man who was allegedly framed was Darren Wesley Huff. Howley reported that evidence suggests that Mueller’s FBI completely invented the details of an alleged militia attempt to take over a courthouse in Tennessee that supposedly involved Huff.

The Washington Post also reported that prosecutors in court filings said Reffitt brought an AR-15 rifle and a Smith & Wesson on his trip and that he was recorded telling his family he carried them to the Capitol. Reffitt’s attorney, William L. Welch, had argued in an unsuccessful hearing for bond on May 13 that his client harmed no one and that there were no government recordings or photographs showing he was armed at the Capitol. Furthermore, the attorney pointed out that no police officers mentioned Reffitt having a weapon, and he had not been charged with weapons offenses. Howley reported that there is a “big problem” with prosecutors using the Huff case as precedent in prosecuting Reffitt:

“It turns out, according to massive evidence including eyewitness sworn affidavits and photographic evidence provided to this outlet, Darren Wesley Huff never actually tried to take over the courthouse in Tennessee, and Robert Mueller’s FBI allegedly fabricated the case.”

Walter Fitzpatrick, a witness in the Huff case, told National File the case against Huff was fabricated and that this fabrication is now being used against Reffitt:

“The DOJ/FBI are using a DOJ/FBI manufactured domestic terrorist hoax gun charge conviction as precedent to target Mr. Guy Reffitt for prosecution on a gun charge regarding Mr. Reffitt’s attendance at the U.S. Capitol rally on 6 January 2021.

“The federal precedent results from the DOJ/FBI targeting Mr. Darren Wesley Huff in 2010 accusing Navy Veteran Huff of traveling from Georgia to Tennessee on 20 April 2010 to a trailer park courthouse in Madisonville, Tennessee.

“The federal accusation accuses of traveling across state lines with guns with intent to riot. It’s all an FBI manufactured hoax.

“Mr. Huff was never at the courthouse. The 12 or so other men Van Balen talks about are ghosts. No one at the courthouse on 20 April 2010 was armed, saving for law enforcement officials.”

Howley reported that at the time, Fitzpatrick was calling for then-President Barack Obama to be investigated.

Fitzpatrick was accused of attempting to make citizens arrests of local officials who refused to investigate Obama, prompting Huff and others to come to his defense in Madisonville.

Huff was ultimately convicted of one count and acquitted of another, though the jury initially came back hung.

Fitzpatrick told National File:

“The FBI under Mueller declared his anticipated activity on 20 April 2010 a federal police emergency. Their law enforcement presence is the stuff of legend around East Tennessee.

“Hundreds of officers, many in camo, snipers on roofs and in windows, roadblocks into and out of Madisonville, helos (plural) airborne, pixelated pole cameras.”

Howley included footage of a traffic stop of Huff on April 20, 2010, who he said “never actually went to the courthouse.” The footage was allegedly taken by Carl Swenson.[sic] The video includes commentary by Huff, who says he was pulled over for failing to stop completely at a stop sign. In the video, Huff says guns were drawn on him. Five police vehicles are seen in the video. Huff also says various police agencies, including SWAT personnel, state troopers and sheriff’s deputies, were at the traffic stop. Huff said police disarmed him and then asked permission to search his pickup truck for explosives, but he did not consent. Huff also said an officer had requested to hold his weapon until the event in Madisonville was done, but he did not consent to this request either and was later released from the traffic stop with a warning ticket regarding his failure to come to a complete stop.

Howley included a photograph of attendees at the courthouse protest and wrote:

“No one was arrested on the date in question. Huff was arrested 10 days later on April 30 after he was pulled over on Interstate 35 based on a warrant stemming from a federal affidavit from Mueller henchman Mark Van Balen that witnesses claim is fabricated.

“Van Balen’s affidavit is dated April 26, six days after the protest.

“A photo of the crowd of protesters outside the courthouse that day shows women and children, and clearly shows that Huff did not lead a band of 12 armed men to take over the courthouse.

“Huff is not in the photograph because he was not at the courthouse. In fact, Darren Wesley Huff was at a restaurant during the peaceful protest.”

Van Balen claimed in his affidavit:

“HUFF had traveled interstate with one or more weapons to accomplish his planned takeover of a courthouse and/or arrests of persons together with more than three persons.”

The Tennessee Bureau of Investigation opened an “investigative case file” on Mueller’s conduct, according to a 2018 document that Howley provided in his article.

Fitzpatrick had talked with TBI investigators about the case, as documented on audio recordings, according to Howley.

Howley also provided a copy of a 2013 sworn affidavit by Huff’s companion, William R. Looman, who stated that neither he nor Huff “were ever located at the R. Beecher Witt Government/Judicial Building, 405 Tellico Street, Madisonville, Tennessee at any time on Tuesday, April 20, 2010.”

In another sworn affidavit from 2013, John Ivens attested he saw no one other than law enforcement with weapons in the vicinity of the courthouse and “heard no derogatory comments about the government or anyone involved in this situation that would have caused alarm in anyone.”

At the conclusion of his article, Howley includes a copy of blogger PJ Foggy allegedly admitting in writing his involvement in getting a huge police presence to come to Madisonville.

Foggy allegedly wrote:

“We’re the ones who got more than 100 cops ready for Cdr. Walt Fitzpatrick, when he showed up on April 20 with a group of armed men who thought they’d take over the Monroe County courthouse.”


Howley points out that since Van Balen’s affidavit contradicts other sworn affidavits and evidence that National File received regarding Huff, the 2010 case should not be used as precedent to go after another U.S. citizen in 2021 due to the contradictions and questions it brings up.

2. The rest of the story is very, very vague and disjointed. I 'helped' Robert Mueller get 100 cops to this little dinky burg in East Tennessee. Nothing happened and there were no arrests. Is this Foggy dood responsible for nobody being arrested that day? Good work. Is this Foggy dood responsible for the Van Balen affidavit that Walt claims is false? No, that was days later. Is Foggy responsible for Huff being arrested and prosecuted? No, the arrest was 10 days later, after Huff, in his genius, decided to go back to Tennessee. The sad truth is, Walter Francis Fitzpatrick III was himself responsible for the arrest of Darren Huff. When he tried his idiotic "citizens' arrest" on Gary Pettway (the grand jury foreman) he got one of his buddies to record it on video. And Walt thought he was a BFD in the anti-government birther movement during the Obama administration. He was publicizing himself relentlessly, with letters on US Naval Academy stationery, no less, accusing Obama of treason and a few even more serious crimes, and in those days he used to get the whackjob media sites to use headlines like "Military Accuses Obama of Treason". Because Walt used to be in the military. In the previous century. And got "you're fired".

He was enough of an anti-Obama sensation on the internet that we started paying attention to him. Then on April Fool's 2010, he tried to arrest the grand jury foreman inside the grand jury hearing room, and he was arrested for interfering with the grand jury and some other crimes, I forget.

So he released the video and NOW HE WAS SOMEBODY. He didn't just talk about Obama being ineligible. He DID SOMETHING ABOUT IT.

He went to the local grand jury, in person, and demanded they indict Obama. When they wouldn't do that (Obama was never within 100 miles of Monroe County, it's tiny) he tried to arrest the foreman! And he was a military veteran! This was big news in the birther world.

And it meant that maybe Walt was finally the leader he never was in the Navy. To this day, his blog says "Obama is my enemy; make him yours" by following his example. This is how Darren Huff learned about Walter, and he learned that Walt was going to be arraigned on April 20, and a bunch of whackjobs decided they'd try to take over the courthouse and "Free Walter".

Before leaving for Tennessee, Huff told a bank employee that he was going to be on the Tee Vee the next night for taking over the court house.

But it was all about Walter, that glorious April morn when he was set to be arraigned. All we did was we alerted the authorities that anti-government protesters were planning to take over and interfere with the arraignment. They sent so many cops that it was intimidating, so nobody did anything. But according to Darren Huff, they surely would have done some serious criming if'n we hadn't told the cops what was coming.

Huff was convicted for crossing state borders with the intent to create a civil disturbance, which he bragged about openly to the FBI. The fact that 100 cops showed up and scared the little band of troublemakers so they never did anything is not evidence that they had nothing planned. It was fortuitous that we had alerted the authorities, and the troublemakers wet themselves when they saw snipers on the rooftops in the tiny little town.

We're heroes, and Walter is scum, bottom line. We prevented a seriously violent incident, and Walter is a convicted felon.

And if it wasn't for Walter tooting his own horn and pretending to be some kind of tough-guy birther asshole, Darren Huff would never have been arrested. Maybe if I had something like that on my conscience, I would still be obsessing about it, like Walter is doing. He still feels guilty about Huff being arrested and convicted, because he's the one who got Huff to visit Tennessee.

I wish to now confess that I am responsible for there being no violence and no arrests that day. Might as well, I think the statute of limitations for preventing violence is long expired.

Yeah, and I skated away from all my treasonous criming because I am THIS CLOSE to Barry Soetoro and Bobby Mueller. I can't even count the number of serious felonies, they'd probably have to keep my body in a prison cell for 150 years after I die. The smell wouldn't be so bad after a while.

But I have nothing on my record more serious than a traffic ticket. I'm the Teflon Rooster. :rotflmao:

Y'know, those early days of the birther movement and the Obama administration were exciting as hell. I sometimes miss them. I was part of this incredible web community, the infamous Politijab, and met all these super intelligent people, who all had a wicked sense of humor and were tired of the enormous flood of bullshit that sloshes back and forth across this great land of ours. It was a great time to be a knee-jerk urban weenie liberal aging hippie with a computer and an internet connection.

But those days are OVER. They are pining for the fjords. They're dead, Jim. Gone.

Walter seems to be having a bit of trouble leaving the past behind.
Edit: I will give him credit where credit is due - he is the only birther who used his birtherism to go on a lengthy crime spree, and managed to be convicted and sent to jail or prison on several occasions. No other birther came close to his record of criminal behavior. He's a menace to polite society.

WASHINGTON — As Guy Reffitt made his way up a set of stairs outside the US Capitol on Jan. 6, not turning back as Capitol Police officers deployed pepperballs, projectiles, and chemical spray, he served as “the tip of the mob’s spear,” a prosecutor told jurors on Wednesday.

With the jury finalized the night before, Assistant US Attorney Jeffrey Nestler began the third day of Reffitt’s trial — the first in the Justice Department’s Jan. 6 prosecution effort — with the government’s opening presentation. Nestler told jurors that although the Wylie, Texas, man wasn’t accused of going inside the building, Reffitt showed the crowd around him a path forward and created the opportunity for them to overwhelm police, all while he was carrying a holstered pistol on his hip. Reffitt became, in his own words, the “match” that lit the fire, the prosecutor said.

“This mob was determined to physically prevent Congress from meeting inside the Capitol building that afternoon,” Nestler said. “A mob needs leaders.” Reffitt, he said, stepped up to “fulfill that role.”
