Former President Donald Trump’s lawyers asked a federal judge on Tuesday to allow him to amend his answer to rape accuser E. Jean Carroll’s complaint in order to file a countersuit.
Skewering the ex-president’s lawyers during oral arguments stretching roughly an hour, the judge appeared inclined to reject that effort.
“Why isn’t amendment futile?” Senior U.S. District Judge Lewis Kaplan asked Trump’s lawyer Alina Habba at one point, leaving little doubt at the end of his questioning that he believed that it was.
Toward the end of the Trump presidency, Carroll filed a lawsuit, initially in state court, claiming that the then-president defamed her by falsely denying that he raped her in the dressing room of the department store Bergdorf Goodman in the 1990s, but for the better part of its life, proceedings have revolved less around her allegations than whether the case caption should even be Carroll v. Trump. The case went to federal court after the Department of Justice intervened.

I'm just catching up on this thread. I heartily recommend Judge Kaplan's decision for its calm, methodical, and complete vivisection of lawyer Alina Haba, her competence, her conduct, and the behavior of her client.

Judge Kaplan is an experienced, hard-assed judge, whose field of fucks has been barren for decades. Most of the decision consists of pounding the rubble, and one can only conclude that Kaplan is spending the time to do so because he wants to.

(Bloomberg) -- Former President Donald Trump’s lawyers were told by a federal judge to “stop wasting time” after they tried halting the deposition of former White House Press Secretary Stephanie Grisham in a defamation lawsuit minutes after it began, citing her painkiller medication.
Grisham -- who famously never held a press conference and resigned her subsequent post as chief of staff to the first lady after the Jan. 6 insurrection -- was deposed Thursday in Kansas by lawyers for New York columnist E. Jean Carroll.
“Stop wasting time,” US Distract Judge Lewis Kaplan in Manhattan said to Trump’s lawyers during a brief hearing held over the phone during a break in the deposition, according to a transcript. “It goes forward.”
The sworn testimony was briefly delayed after Trump attorney Michael Madaio tried to halt the deposition when Grisham confirmed she’d taken her prescribed painkillers, though a smaller dose than normal.
Trump is set to be deposed in the case on Oct. 19, though he’ll argue at a hearing Friday for Carroll’s suit to be put on hold pending the resolution of a key question on appeal. Carroll claims Trump raped her two decades ago and then defamed her by calling her a liar while he was in office.

Trump has lashed out in reaction to Judge Kaplan's ruling, and he might have shot himself in the foot worse than usual, by essentially repeating the defamatory remarks that were the predicate for Carroll's lawsuit. See the AP article linked to and quoted from below.
Carroll could bring a new action based on these statements. Since he's no longer president, there would be no basis for the federal government to intervene, substitute itself as defendant, and seek dismissal based on sovereign immunity.
Tristan Snell, a former lawyer in the New York Attorney General's office who worked on the Trump University case, has picked up on this.
And her lawyers might not bother to amend her federal case, since she will shortly be able to sue Trump directly for rape, under a recently-enacted New York statute of limitations revival statute.

Trump just ruined his entire defense against E. Jean Carroll.
He had argued that because he was President when he made the alleged defamation, he was immune. That issue is on appeal.

There would be no basis for the DOJ to withdraw from the existing action unless and until Carroll had amended her complaint to substitute claims based on Trump's latest comments for her original allegations based on Trump's statements while he was president.@TristanSnell
DOJ must now drop its defense of Trump in the E. Jean Carroll case. He just repeated the alleged defamation while no longer president. So the issue of whether he could be sued for a defamation he committed while president is now moot.
DOJ should withdraw from the case tomorrow.

Donald Trump answered questions under oath Wednesday in a lawsuit filed by E Jean Carroll, a magazine columnist who says the Republican former president raped her in the mid-1990s in a department store dressing room.
The deposition gave Carroll’s lawyers a chance to interrogate Trump about the assault allegations as well as statements he made in 2019 when she told her story publicly for the first time.
Details on how the deposition went weren’t immediately disclosed.
“We’re pleased that on behalf of our client, E Jean Carroll, we were able to take Donald Trump’s deposition today. We are not able to comment further,” said a spokesperson for the law firm representing her, Kaplan Hecker & Fink.

NEW YORK - Former President Donald Trump faces an unwelcome Thanksgiving Day entrée - a new lawsuit accusing him of battery in the alleged assault of E. Jean Carroll, former magazine advice columnist.
The latest legal trouble for Trump comes after he recently announced a 2024 White House run and Attorney General Merrick Garland tapped a new special counsel to handle investigations involving him.
Carroll, who's already suing Trump for defamation over his denials and comments about her following the assault allegations, will file the new battery lawsuit in Manhattan federal court on Thanksgiving Day, according to a court filing last week.
That's when New York state's recently approved Adult Survivors Act opens a one-year window for survivors of sexual assault that occurred when they were past age 18 to sue alleged abusers no matter when an assault may have occurred.
Until the law's enactment in May, many similar allegations were barred from being pursued in court by laws that set a maximum time period for suing.
Both cases focus on what Carroll alleges in the new lawsuit was playful banter in a New York City luxury department store roughly 27 years ago that "took a dark turn" when Trump suddenly "forced her up against a dressing room wall, pinned her in place with his shoulder, and raped her."

As one of the replies to the tweet suggested, get a DNA sample from Mary Trump. That won't prove that the semen was from Donald, but it will show if that is a possibility.
