Hey, this case is bleeding into several topics between the DOJ and the dotard. It's going to be an issue through the midterms. We'll start to have duplicates in multiple topics and it's harder to find information. As reported on the Garland topic, he's expected to speak soon. The Justice Department had sought the return of classified documents it believed might still be at Mar-a-Lago before it sent F.B.I. agents this week to look for them.

Former President Donald J. Trump received a subpoena this spring in search of documents that federal investigators believed he had failed to turn over earlier in the year, when he returned boxes of material he had improperly taken with him upon moving out of the White House, three people familiar with the matter said. The existence of the subpoena helps to flesh out the sequence of events that led to the search of Mr. Trump’s Florida home on Monday by F.B.I. agents seeking classified material they believed might still be there, even after efforts by the National Archives and the Justice Department to ensure that it had been returned. The subpoena suggests that the Justice Department tried methods short of a search warrant to account for the material before taking the politically explosive step of sending F.B.I. agents unannounced to Mar-a-Lago, Mr. Trump’s home and members-only club.

Two people briefed on the classified documents that investigators believe remained at Mar-a-Lago indicated that they were so sensitive in nature, and related to national security, that the Justice Department had to act. The subpoena was first disclosed by John Solomon, a conservative journalist who has also been designated by Mr. Trump as one of his representatives to the National Archives. The existence of the subpoena is being used by allies of Mr. Trump to make a case that the former president and his team were cooperating with the Justice Department in identifying and returning the documents in question and that the search was unjustified. The Justice Department declined to comment. Christina Bobb, a lawyer working for Mr. Trump, did not respond to messages. It is not clear what precise materials the subpoena sought or what documents the former president might have provided in response. The subpoena factored into a visit that Jay Bratt, the Justice Department’s top counterintelligence official, made with a small group of other federal officials to Mar-a-Lago weeks later, in early June, one of the people said.

The officials met with Mr. Trump’s lawyer, Evan Corcoran. Mr. Trump, who likes to play host and has a long history of trying to charm officials inquiring about his practices, also made an appearance. During the visit, the officials examined a basement storage area where the former president had stowed material that had come with him from the White House. A few days after the visit, Mr. Bratt emailed Mr. Corcoran and told him to further secure the remaining documents, which were kept in the storage area with a stronger padlock, one of the people said. The email was reported earlier by The Wall Street Journal. Then, they subpoenaed surveillance footage from the club, which could have given officials a glimpse of who was coming in and out of the storage area, according to a person with knowledge of the matter. They received footage specifically from areas of the club where they believed the documents might have been stored, the person said.

During the same period, investigators were in contact with a number of Mr. Trump’s aides who had some visibility into how he stored and moved documents around the White House and who still worked for him, three people familiar with the events said. Among those whom investigators reached out to was Molly Michael, Mr. Trump’s assistant in the outer Oval Office who also went to work for him at Mar-a-Lago, three people familiar with the outreach said. Investigators have also reached out to Derek Lyons, the former White House staff secretary, whose last day was Dec. 18, 2020, and no longer works for Mr. Trump, with questions about the process for handling documents, according to a person familiar with the outreach. Federal officials came to believe that Mr. Trump had not relinquished all the material that left the White House with him at the end of his term, according to three people familiar with the investigation.

Less than two months later, about two dozen F.B.I. agents, intentionally not wearing the blue wind breakers emblazoned with the agency’s logo usually worn during searches, appeared at Mar-a-Lago with a warrant. The club was closed; Mr. Trump was in the New York area; the F.B.I. startled a crew fixing a large fountain, a maid who was dusting and a handful of Secret Service agents who guard the complex. The search warrant was broad, allowing the agents to investigate all areas of the club where classified materials might have been stored. They went through the basement, Mr. Trump’s office and at least part of his residence at the club. After hours of searching, they left with several boxes that were not filled to the brim and in at least some cases simply contained sealed envelopes of material that the agents took and were otherwise empty, one person familiar with the search said. The person said that the F.B.I. left behind a manifest of what was taken, which was two pages long. Mr. Trump’s team has declined to disclose the contents of the search warrant. A number of organizations, including The New York Times, are seeking in federal court to have it unsealed.

Some senior Republicans have been warned by allies of Mr. Trump not to continue to be aggressive in criticizing the Justice Department and the F.B.I. over the matter because it is possible that more damaging information about Mr. Trump related to the search will eventually become public. When Mr. Trump left the White House after refusing to concede that he had lost the 2020 election and seeking frantically to stay in power, a number of boxes of material made their way from the West Wing to Florida. In the boxes was a mash of papers, along with items like a raincoat and golf balls, according to people briefed on the contents. The National Archives tried for months after Mr. Trump left office to retrieve the material, engaging in lengthy discussions with representatives for the former president to acquire material that should have been properly stored by the archives under the Presidential Records Act. When archivists recovered 15 boxes of material this year, they discovered several pages of classified material and referred the matter to the Justice Department. But officials later came to believe that additional classified material remained at Mar-a-Lago. Some of Mr. Trump’s advisers have maintained that they were trying all along to cooperate with federal officials and had kept an open line of communication. But others familiar with federal officials’ efforts to recover the documents have painted a very different picture. They have said that Mr. Trump resisted returning property that belonged to the government, despite being told that he needed to. Some of Mr. Trump’s informal advisers outside his direct employee have insisted to him that he can claim the documents are personal items and keep them there.

AGOTUS: DOJ is moving in court to unseal the warrant and the inventory receipt. :yawn: Because Defendant To Be has essentially waived any purported privacy interest in it by whining so damn much.

AGOTUS Actual approved the decision to seek a search warrant.

The rest is the platitudes you'd expect from a career (read: sane) government lawyer.

Bob's right -- Garland just called Trump's bluff. Instead of waiting for the dotard to release the warrant and property log, they will. Excellent. Now the dotard's team has to reply whether or not to release the information. The Affidavit is not being unsealed, that's the 20-40 page document released to a defendant if charged.

Scheduling Order will be next. Judge probably gives T**** a week to respond, then the government probably gets a week. Elie Honig is saying he's never seen DOJ make a motion to unseal. The DOJ and FBI didn't say a word about this search warrant, it's all come from T****. So let's see how public he wants this. Still thinking of the line in Maggie's article:

He could join in the DOJ's motion, oppose it, or neither (or something else but essentially neither, legally speaking). The DOJ is saying it'll reveal what it presently can, and it forces him to pick a lane. The DOJ is taking the as-public-as-possible route, and daring him to oppose it.

I don't think there's anything "new" about him having received a subpoena months ago and, according to the right, he "cooperated fully" and very cordially.

To the people saying why didn't they issue a subpoena (looking at you, Mr. Turley) rather than a warrant, I'd direct you to the fact that obviously he did not comply fully with the subpoena then, and likely would not now do so and in the meantime it's possible whatever they were seeking and siezed would no longer be there. It is Trump, after all.

If I'm reading this correctly, the subpoena, issued last June, was to get the leftovers from the Jan. retrieval, but someone on the inside became aware trump didn't give everything back and was "hiding" the rest in the basement.
The subpoena issued before the June meeting, during which investigators were shown where documents were held in a basement room at the Trump residence and private club, shows how the investigation has escalated and suggests the discussions had become confrontational long before Monday's search.

(Aug. 10, 2022) — Some say he is not “presidential.” Some even say he is another Hitler! Maybe he is a little too rough around the edges for you. Not a typical smooth-talking salesman or glib politician (contrasted, for example, to Barack HUSSEIN Obama!). The TRUTH is that this man is unlike any other president in our country’s history. He is transparent (to a fault?) and a unique and fearless extemporaneous speaker. He has a big-time billion-dollar background in business (not politics!), and seems uncannily adaptable and resilient. He can “take a punch” and come back and knock you out cold before you know it. He is the expert in the “art of the deal.”

All of this, and Donald Trump professes authentic love for We the People, the United States of America, and for God Almighty. Our U.S. Constitution, too. I suppose these qualities are scary to some, primarily those who are his biggest opponents and, maybe most of all, those who are attempting to hide something “hugely” important and potentially dangerous from the public (once again, I cite Barack HUSSEIN Obama as an example).

Unfortunately, our federal government is fast becoming partisan and, in some if not all agencies, weaponized. Ever hear the not-so-funny joke about the well-dressed officious-looking man who knocks on your front door and tells you, “I’m from the government, and I’m here to help”? The FBI is an obvious example of what I’m talking about. In fact, these days whenever news-making federal crimes occur, I always have to ask, “What did the FBI know, and when did they know it?” I suppose we could ask the same thing about current President Joe Biden, except that in actuality he really doesn’t know much about anything and likely is not the one who is making the decisions and running our country (should I again cite Barack HUSSEIN Obama behind the scenes?!).

Anyway, permit me to share some ideas that I have about the recent actions of the FBI (Department of Justice) at Mar-a-Lago. First, can you say “POLITICALLY WEAPONIZED”? Next, let’s try “HOME INVASION ROBBERY,” “THIRD-RATE BURGLARY,” and “PERSONAL ITEMS RAID” using a generic take-whatever-you-can-see-and-touch warrant! Something tells me that I am not exaggerating too much.

I think those who describe what took place at Donald Trump’s home as being little more than a “fishing expedition” are correct. unless I am mistaken, some “personal property” belonging to President Trump was among the items injudiciously taken (stolen?): for example, a personal letter from Barack HUSSEIN Obama and personal correspondence between President Trump and Kim Jong-Un. Other items not subject to the “warrantless warrant,” signed by a magistrate who should have recused himself, are not yet known. So, all in all, I have to call this exercise a failure and a disgrace by a once-respected, impartial, crime-fighting agency of the U.S. government’s executive branch.

That is what I have to say (my opinion), and as far as I know, I am entitled by law to say it. I might add that I am NOT a racist, and I am not a WHITE SUPREMACIST. I have NO lethal weapons, just my pen. So I would appreciate being “left alone.” Thank you. God Bless America as it was envisioned and put in writing by our wise and brave Founding Fathers.

Just thinking about the documents recovered from MAL - We've talked about the fact that the site was not secure against enemies of the United States. I can't imagine that the location was safe against fire and other forces of nature. I would think that original copies of important government papers would normally be stored in safe, secure locations - safe from spies, safe from nature.

(Of course my comment omits the fact that Trump, himself, was the biggest threat to these documents.)

Will Trump ok the release of the warrant as long as the affidavit is also released? He knows that the DOJ would never do that, and he would love to see what's in the affidavit. So it would look like he's consenting without really consenting.

And a basement in Florida? You know that's a damp, musty place. Why not in a nice, dry safety deposit box?

That's probably the play he'll try to run. Because it will encourage the confusing-action-for-achievement types to sow discord and chaos.
He knows that the DOJ would never do that, and he would love to see what's in the affidavit. So it would look like he's consenting without really consenting.
He can certainly try. But ultimately it won't matter. Legally, of course; the base will eat up whatever he does or doesn't do.


An AUSA tomorrow mostly likely will file an exasperated response attempting to detail his refusal to either join or oppose the DOJ motion. Which will return the ball to the court. The court could further probe, but I'm guessing it'll just set a deadline for him to file something.

Nut that attacked Cincinnati FBI office revealed (of course) as a MAGAT who was at Jan. 6 insurrection. After 7 hour standoff with FBI and Ohio State Patrol, Patrol just revealed on evening news that subject has been terminated with extreme prejudice.
