UPDATE FROM OATH KEEPERS TRIAL: A very different story today. Seven of the first nine juror candidates were stricken after expressing difficulty being impartial, some who had closet followed news coverage. One juror expressed fear about his own safety if he were IDed during trial

What will the prosecutors argue?

As they cast the Jan. 6 assault on the U.S. Capitol as an attack on American democracy, prosecutors will be able to draw on the extensive documentation of the attack, including thousands of hours of footage. They are also likely to point to Rhodes’ call for an armed “civil war” to keep former President Donald Trump in power.

Prosecutors allege that members of the Oath Keepers organized, trained, and equipped themselves months before Jan. 6, 2021. “We aren’t getting through this without a civil war. Too late for that. Prepare your mind, body, spirit,” Rhodes privately messaged a group of Oath Keepers in an encrypted app on Nov. 5, according to his indictment.

On Jan. 6, the group of Oath Keepers went to the Capitol ready “to answer Rhodes’ call to take up arms,” according to the indictment. They coordinated their actions on that day using encrypted messaging apps, hand signals, and walkie-talkies, and several were photographed wearing tactical vests, helmets, and other equipment as they breached the doors of the Capitol Rotunda.

What will the defense argue?

The rare charges are expected to be met with an even rarer defense. Rhodes’ lawyers have indicated they will argue that he believed Trump was going to lawfully invoke the Insurrection Act, a 1807 statute that allows the president to call up militias in the case of national emergencies.

“What the Government contends was a conspiracy to oppose United States laws was actually lobbying and preparation for the President to utilize a United States law to take lawful action,” Phillip Linder and James Bright, Rhodes attorneys, argued in a court filing.

I would think part of the problem with that defense is two fold.

Trump did not invoke the insurrection act, and Stewie knew he wasn't gonna after he got ghosted trying to call him on Jan 5th.

Stewie went ahead and they attacked the Capital anyway.

So now, it looks to me like Stewie thought he might be able to invoke the insurrection act himself.

Kids, the only insurrection going on here was the people who came to stop the counting of the votes. There were no ANTIFA crowds, holding Congress at the point of a gun to count the votes (Exactly as the states had sent them in, BTW). Just a bunch of cosplay commandos who didn't like how an election went, and dammit if they lost that must mean they need to go take over by force.

IANAL but if that ain't Sedition, and doing it with bunches of your friends ain't conspiracy, then someone is gonna have to explain why not. To me at least.

And..... at 11th hour.... one of the defendants, Kelly Meggs, requests a "bench trial" (trial by judge, not by jury)

Very, very late request. We'll see how judge responds, when court opens next hour

Now there's discussion around hand grenades that were found in a RV that alleged co-conspirator Jeremy Brown brought to D.C.

Kenneth Harrelson attorney Brad Geyer says the RV was heavily used by the Brown family, including by a dog.

"Was it the dogs' hand grenade?" Mehta asks.
Sounds like a lot of Hail Marys at the last minute...
