Rhodes is getting skeert. He doesn't like the reality his lawyers are presenting to him as they 1) prepare him for trial OR 2) ask him to consider a plea deal.

I don't know how many times I had some form of this conversation with my client:

Client: I don't like what they're offering. I want to go to trial.

Me: Here's what's going to happen at trial. The government is going to call the agents to testify about the (drugs/child pornography/military property) they found in your possession. No military judge or jury is going to believe that it was planted, didn't belong to you, or that you didn't know you had it. And you'll get convicted. Then your sentence will be way longer than what was offered.

Client: OK, I'll plead guilty

Next day:

Client: I don't like what they're offering. I want to go to trial.

Me: :roll:

Divorce cases were much the same. Some clients were very much invested in the "I am the wronged party, give me everything".

I *very briefly* practiced family law. The hardest part about that was trying to convince the client that the *only* thing the court could do was divide up the property and make decisions about custody. It will never punish your spouse for treating you like shit; it will never tell you you were right about your spouse being the spawn of satan; and it will never reward you or compensate you for putting up with your spouse's shit as long as you did. And the more you fight over the assets, the less there will be to divide up when the time comes.

I have an older sister that I have never mentioned on this board. We were practically best friends until my late 30's but that's way too long a story. I no longer recognize her, I mean her face I recognize, but her behavior became super toxic, which is a big part of our estrangement. She is the the kind that will cut off her own nose to spite someone else. Her third ex-husband was willing to leave with nothing but the clothes on his back and his toolbox. Just to make his life difficult, she decided to sue him for divorce instead of just agreeing that she gets the house and everything except his clothes and tools. A judge forced them into arbitration. Let's just say that he ended up with way the hell more than his toolbox and a few ragged clothes. :cantlook:

Judge won't delay trial for Oath Keeper Elmer Rhodes during tense hearing

Mehta was often blunt during the hearing and remarked that Rhodes’ assertions left him “frankly bewildered.”

He told Tarpley it would be “humanly impossible” for him to be ready for trial even if he granted a 90 day-minimum delay, as Rhodes had requested.

”I’m sure Mr. Tarpley is a fine and talented lawyer,” Mehta said. “But no lawyer is going to be ready to try this case in 90 days, let alone three weeks.”

Mehta ordered Bright and Linder to remain on the case and said he wouldn’t allow Rhodes or Tarpley to wreak “havoc” on the docket.

judge acknowledged that preparing for trial from prison is difficult but it was Rhodes, he said, who opted to hire lawyers located in Texas instead of Virginia where he is currently detained.

“That’s his decision,” Mehta said as he reiterated his skepticism.

He had not heard a ‘whiff of discontent” with Linder or Bright until Tuesday. And further, he questioned why Rhodes would seek to replace his lawyers based in Texas with a lawyer based in Louisiana.

Mehta ultimately eviscerated Rhodes’ complaints one by one, emphasizing how thin the premise was for each grievance.

HAPPENING NOW: Kellye SoRelle, the Oath Keepers general counsel who was charged as part of the conspiracy related to Jan. 6, has been arraigned. Prosecutors say they don't plan on superseding her into any of the larger Oath Keeper cases.

Do you think he has any idea what a special master does, or under what circumstances one can be appointed?

I don't. As you said, he probably just saw that Trump got one, which delayed the investigation, and figured "What the hell, its worth a shot".

Mostly, before TFG reinvented the concept, it was when a lawyer got raided, and they do "third party sweeps" so that none of the lawyer's clients files fall into the hands of law enforcement. Also, if they raid an office and seize 40 boxes of evidence but the defendant says "some of those are my letters to and from an attorney and is covered by Attorney-Client privilege". Outside of that it's pretty rare but the general idea is sometimes when the cops take stuff there is some stuff that they can't have. If it's a big enough deal and there is reason to not trust the cops to return themselves what they shouldn't have, courts appoint a Special Master.

Now, normally, when the cops raid a place and take 40 boxes of documents they have a detail that does this 'in house' but sometimes that's not good enough.
