Gun Maker Offers $33 Million To Settle Suit By Sandy Hook Families

HARTFORD, Conn. (AP) — The maker of the rifle used in the Sandy Hook Elementary School shooting has offered some of the victims’ families nearly $33 million to settle their lawsuit over how the company marketed the firearm to the public.

Lawyers for now-bankrupt Remington filed the offers late Tuesday in Waterbury Superior Court in Connecticut. The nine families suing the company, who are being offered nearly $3.7 million apiece, are considering the proposals, their lawyershootings.

A Bushmaster AR-15-style rifle made by Remington was used to kill 20 first graders and six educators at the Newtown, Connecticut, school on Dec. 14, 2012. The 20-year-old gunman, Adam Lanza, killed his mother at their Newtown home before the massacre, then killed himself with a handgun as police arrived at the school.

Relatives of nine victims killed in the shooting say in their lawsuit that Remington should have never sold such a dangerous weapon to the public and allege it targeted younger, at-risk males in marketing and product placement in violent video games. They say their focus is on preventing future mass shootings

So where will Remington get the settlement money from considering...

"Remington, based in Madison, North Carolina, filed for bankruptcy last year for the second time in two years. Its assets were later sold off to several companies."

I was kind of wondering that myself... where would a lawsuit settlement fall in the line of distribution of assets during bankruptcy?

More likely that underperforming kids have less of a lifetime earning value than their higher achieving classmates. :vomit: Lifetime earnings are one factor in wrongful death damages.

This request makes me more livid than anything else I remember being furious about. :smokeears: Also too, what’s the idea concerning SOME, rather than ALL the children? The thought of needing any records at all is disgusting, but still........

EDUCATIONAL RECORDS, EDUCATORS’ WORK RECORDS, AND TO DELETE
OBSOLETE PROTECTIONS FOR REMINGTON’S PROPRIETARY INFORMATION

The plaintiffs seek expansion of the categories of protected information in light of two
recent subpoenas issued by Remington. One of those subpoenas directed the Newtown Public
School District to release to Remington employment files of the four educators whose deaths are
at issue here.
In addition to employment files of the adult decedents, Remington also subpoenaed
the School District to produce the kindergarten and first grade educational records of Jesse
Lewis, Daniel Barden, Dylan Hockley, Benjamin Wheeler and Noah Pozner – the five
schoolchildren for whom claims have brought in this case. There is no conceivable way that
these children’s “application and admission paperwork, attendance records, transcripts, report
cards, [and] disciplinary records,” to name only some of the things sought by the subpoena, will
assist Remington in its defense, and the plaintiffs do not understand why Remington would
invade the families’ privacy with such a request. Nonetheless, this personal and private
information has been produced to Remington
.
The plaintiffs therefore move the Court to expand
the categories of protected information to include private educational, employment and medical

records and information. A copy of the proposed, modified protective order is attached hereto as
Exhibit A.
