Relax. This is a typical motion in child pornography cases, and it’ll fail. “Knowledge” is hard to prove, so, in addition to the images themselves, they prove it with circumstantial evidence (like the presence of software on your computer designed to defeat monitoring software, for example).

I'm not surprised that this motion was filed. I'm disturbed by the claim. But, a good lawyer does whatever they can do for their client. As they should.

Still, how absurd of a claim!
Also, they lawyer is playing a long game. He lost at trial. If he doesn’t file this motion, he potentially opens himself up to a claim of ineffective assistance, which would also fail for similar (but not necessarily identical) reasons.

Josh Duggar was just sentenced to 12.5 years.

The maximum he was facing was 17 years.

I rarely expect the maximum and do not anticipate the prosecutor's recommendations will be followed.

Of course, this varies by color as I would tend to expect closer to the max if the defendant is non-white because people claim we are color blind but that is either wishful thinking or an outright lie.

I agree. I think I assumed he'd get a slightly longer sentence because the CSAM was so horrific.

I wish I could know more about the judge’s reasoning for the sentence given.

McCandless is pretty thorough about the judge's reasoning while refraining from sensationalism. (Josh Duggar's youngest known SA victim (his sister was five at the time) had to leave court at one point after his rape of her was described by the prosecutor.)
