A judge dismissed a lawsuit Wednesday by Donald Trump supporters who sought to inspect absentee ballots from last year’s presidential election, a decision that came a day after Georgia investigators told the court they were unable to find any counterfeit ballots. Superior Court Judge Brian Amero’s ruling ended the last remaining major lawsuit over Georgia’s 2020 election and prevented an outside review of Fulton County’s 147,000 original absentee ballots. The judge’s order is the latest in a series of decisions against supporters of the former Republican president who have asked the courts to help them pursue suspicions of fraud or reverse the results of the election.

State election officials have said there’s no indication of fraud after three ballot counts and multiple investigations. Democrat Joe Biden defeated Trump in Georgia’s presidential election by about 12,000 votes. Though Amero’s decision was based on the legal principle of standing — the plaintiffs hadn’t suffered a specific injury that would give them a right to sue — he reviewed the evidence before making his ruling. State election investigators couldn’t find any fraudulent or counterfeit ballots within ballot batches cited by Republican vote-counters who participated in a statewide audit last November, according to a court filing on behalf of Secretary of State Brad Raffensperger on Tuesday. There were no indication of “pristine” ballots with perfectly filled-in ovals and no creases, as alleged in the lawsuit. All ballots in those batches appeared to be authentic. “While no election is perfect, there was no widespread fraud or illegal voting large enough to overturn the election,” Raffensperger, a Republican, said Wednesday. “The results were, as we reported, that President Trump came up short in the state of Georgia.”

Fulton Commission Chairman Robb Pitts called the dismissal of the lawsuit “a win for democracy.” “This lawsuit was the result of the ‘big lie,’ which is nothing more than a meritless conspiracy theory being spread by people who simply cannot accept that their side lost. Its defeat here today should echo throughout the nation,” Pitts said. The lead plaintiff in the case, Garland Favorito of the group VoterGA, said an in-depth inspection of absentee ballots was necessary to search for the counterfeit ballots that state investigators couldn’t find. “All citizens of Georgia have a right to know whether or not counterfeit ballots were injected into the Fulton County election results,” Favorito said. “It is not adequate for any organization to secretly tell us there are no counterfeit ballots and refuse to let the public inspect them.” Amero had previously dismissed the case against Fulton’s elections board and the county itself, but he allowed it to continue against individual members of the elections board. Amero’s decision Wednesday dismisses remaining claims against three Democrats and two Republicans who were members of the board. The plaintiffs had sought to allow the case to move forward against only the board’s Republican members, who didn’t oppose the ballot review.

“This litigation really was just a waste of the taxpayers’ money. And hopefully, this will bring it to a final conclusion,” said Amanda Clark Palmer, an attorney for the defendants. “Judge Amero was very careful to base his rulings on what was in the record evidence before him.” The plaintiffs had alleged that their votes were diluted because of a “substantial likelihood” that fraudulent ballots were introduced into the election. But Amero wrote in his dismissal order Wednesday that the plaintiffs failed to allege that they had been specifically harmed, a requirement for bringing lawsuits in both state and federal courts. Amero based his ruling on a decision by the 11th U.S. Circuit Court of Appeals last December that rejected an effort by attorney L. Lin Wood to overturn the presidential election in Georgia. While original paper ballots remain confidential government records, digital images of absentee ballots have been made public. The ballot images don’t contain the kind of perfectly filled-in ovals and lack of fold marks that the plaintiffs had alleged.

They don't have to be found guilty of a crime to be arrested, they need to be suspected of having committed a crime with probable cause and evidence to back that up. They are suspected, we have evidence, and there is probable cause. They should and could be arrested right now. If it were you or I, we'd be arrested. The ruling political class is held to a different standard than us, they don't need you standing up for them. They should have been arrested weeks ago.

So here is what happened. Last night Raffensperger had his election officials open up the "Judge ordered sealed ballots" and fold all of the pristine ballots. He submitted a report to Judge Amero stating that after inspection of all of the ballots in the alleged batches, they found no pristine ballots. Then just hours ago, Amero dismissed VoterGA's case.

Any enlightenment on all those missing ballots or ballot images. Does Georgia keep ballot images the same as AZ? Were ballots already destroyed cause retention period has expired?

David Perdue files election lawsuit with recycled, already-disproven claims of fraud
Georgia Republican David Perdue, whose run for governor launched this week featuring lies about the 2020 election, has filed a lawsuit that recycles claims of fraud already disproven by investigators and rejected by the courts.

In a Friday filing, the former U.S. senator and a Georgia voter claim that thousands of "unlawfully marked" absentee ballots were counted in Fulton County's presidential election, despite three separate counts of the results and no evidence of so-called "counterfeit" ballots included in the vote totals.

The lawsuit repeats claims of "pristine" ballots observed by a Republican monitor that investigators could not corroborate, includes debunked claims about ballots counted at State Farm Arena on election night and demands an inspection of absentee by mail ballots, after a Henry County judge dismissed a similar suit in October.

The legal challenge also wants the court to fire any employees that committed or knew about alleged fraud — something a judge would be unlikely to do — and to command Fulton to "certify the correct vote total to the Secretary of State," which is impossible to do since the election is already certified.

f) ORDERS to unseal absentee ballots, absentee ballot return envelopes, the absentee ballot election reports, and other paper and electronic information election materials from the General Election and to permit Petitioners to review, examine, inspect, and duplicate such materials including electronic images of electronic drives used by Respondents in the General Election;
g) ORDERS Respondents to terminate all employees, agents, and contractors shown to have had knowledge of or acquiesced in the improper acts described herein;
h) GRANTS Petitioners request for this case to remain active through the 2022 statewide elections in order for the Court to supervise the 2022 elections in Fulton County;
i) Upon completion of the forensic examination, based upon the evidence, enter an Order commanding Respondents to certify the correct vote total to the Secretary of State.
j) GRANTS Petitioners’ attorney fees for having to prosecute this civil action; AND, GRANTS other relief, both general and special, at law and in equity, that the Court DEEMS just and proper.

ATLANTA, Dec 10 — Weeks after the 2020 election, a Chicago publicist for hip-hop artist Kanye West traveled to the suburban home of Ruby Freeman, a frightened Georgia election worker who was facing death threats after being falsely accused by former President Donald Trump of manipulating votes. The publicist knocked on the door and offered to help.

The visitor, Trevian Kutti, gave her name but didn’t say she worked for West, a longtime billionaire friend of Trump. She said she was sent by a “high-profile individual,” whom she didn’t identify, to give Freeman an urgent message: confess to Trump’s voter-fraud allegations, or people would come to her home in 48 hours, and she’d go to jail.

Freeman refused. This story of how an associate of a music mogul pressured a 62-year-old temporary election worker at the center of a Trump conspiracy theory is based on previously unreported police recordings and reports, legal filings, and Freeman’s first media interview since she was dragged into Trump’s attempt to reverse his election loss.

Kutti did not respond to requests for comment. Her biography for her work at the Women’s Global Initiative, a business networking group, identifies her as a member of “the Young Black Leadership Council under President Donald Trump.” It notes that in September 2018, she “was secured as a publicist to Kanye West” and “now serves as West’s Director of Operations.”

When Kutti knocked on Freeman's door on Jan. 4, Freeman called 911. By then, Freeman said, she was wary of strangers.

Starting on Dec. 3, Trump and his campaign repeatedly accused Freeman and her daughter, Wandrea “Shaye” Moss, of illegally counting phony mail-in ballots after pulling them from mysterious suitcases while working on Election Day at Atlanta’s State Farm Arena. In fact, the “suitcases” were standard ballot containers, and the votes were properly counted, county and state officials quickly confirmed, refuting the fraud claims.

But Trump and his allies continued to accuse Freeman and Moss of election-rigging. The allegations inspired hundreds of threats and harassing messages against them and their family members.

By the time Kutti arrived, Freeman needed help but was cautious and wouldn’t open the door because of the threats, according to Freeman and a police report.

So Freeman asked a neighbor to come over and talk with Kutti, who was with an unidentified male. Like Freeman, Kutti and the other visitor were Black. Kutti told the neighbor that Freeman was in danger and that she’d been sent to provide assistance. Freeman said she was open to meeting them. She asked Cobb County Police to send an officer to keep watch so she could step outside, according to a recording of her 911 call.

Two election workers who counted votes for the 2020 presidential election filed a defamation lawsuit Thursday against the parent company of One America News, senior staff at the far-right TV network and Rudolph W. Giuliani, who served as a personal lawyer to former president Donald Trump.

Ruby Freeman and her daughter Wandrea “Shaye” Moss, who worked in Fulton County, Ga., allege that One America News and Giuliani, who frequently appears on the network, knowingly spread misinformation about them, including falsehoods that they logged illegal ballots for Joe Biden in the election.

The two women “have become objects of vitriol, threats, and harassment … because of a campaign of malicious lies,” their attorneys wrote in the suit, filed in the U.S. District Court for the District of Columbia. “Deliberate efforts to spread disinformation about America’s election workers undermine the integrity of American elections … and accordingly, threaten democracy.”

False claims that there were thousands of ballots cast in the names of dead Georgia voters can now rest in peace.

Election investigators found just four absentee ballots in the 2020 presidential election from voters who had died, all of them returned by relatives.

The State Election Board referred the cases to the attorney general’s office this month after investigators reviewed dozens of allegations. Almost all voters were found to be alive.

The tiny number of ballots actually cast on behalf of deceased voters contrasts with then-President Donald Trump’s false accusation that there were 5,000 dead voters in Georgia’s election.

It’s the latest in a series of unsubstantiated claims of fraud that have since been debunked, including allegations of counterfeit ballots, ballot stuffing and forged absentee ballot signatures. Three vote counts showed that Trump lost by about 12,000 votes in Georgia.

In one case, a 74-year-old widow submitted an absentee ballot on behalf of her husband, William Nelson, after he died in September 2020.

“He was going to vote Republican, and she said, ‘Well, I’m going to cancel your ballot because I’m voting Democrat.’ It was kind of a joke between them,” Barry Bishop, an attorney for Sharon Nelson of Canton, told the State Election Board. “She received the absentee ballot and carried out his wishes. ... She now realizes that was not the thing to do.”
