Attorney Claims Trump Would Have Immunity Even If He'd Said To 'Burn Congress Down'

Donald Trump’s immunity shield was so all-powerful that he would have been protected from lawsuits even if he’d called on his followers to “burn Congress down” while in office, his attorney stunningly argued in a federal appeals court.

Lawyer Jesse Binnall insisted Trump would be immune from any lawsuits in a string of extreme scenarios presented to him Wednesday at a hearing before a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit.

The court is determining whether two police officers and 11 congressional Democrats can sue Trump for what they describe as a conspiracy to block Congress’ certification of the 2020 election results on Jan. 6 last year.

The complaints have focused on Trump’s tweets exhorting supporters to come to Washington, his lies that the election was stolen, and his remarks to supporters in a speech on the day of the insurrection to “fight like hell” and march to the Capitol.

A 1982 U.S. Supreme Court ruling held that presidents cannot be sued over their official acts. But U.S. District Judge Amit Mehta ruled in February that Trump’s incendiary speech before the Capitol riots was not part of the then-president’s duties, allowing the lawsuits to move forward. Binnall was challenging that ruling on Wednesday.

Asked by Chief Judge Sri Srinivasan if a president would be immune from lawsuits even if he urged his supporters to intimidate citizens at polling stations to prevent them from voting, Binnall said yes, while also admitting that such behavior would be “horrible,”Bloomberg reported.

Binnall also defended presidential civil immunity when Judge Greg Katsas asked about a president hypothetically calling to “burn Congress down.” Binnall noted, however, that a president could “theoretically” be subject to post-presidency criminal charges in such a case (though not lawsuits), Reuters reported.

Katsas noted that the case against Trump involved “at least colorable” — possibly justified — allegations that he incited the mob that stormed the Capitol last year.

Yet Binnall insisted that a president would not be subject to civil litigation even if it was determined that the president was “seeking to destroy our constitutional system.”

He claimed Trump’s inflammatory rhetoric railing against the election he lost was simply part of his right to express his perspective from the “bully pulpit” of the presidency.

Doral city commissioners held an emergency meeting Wednesday to comply with former President Donald Trump’s December deadline to accept his gift of surrendering development rights at his resort’s premiere golf course.

The unanimous vote to approve Trump’s offer of a conservation easement for the 184-acre Blue Monster course was hailed by city leaders as a historic win for open space in a municipality short on parks.

It also hands Trump a potential tax break while he continues to profit from the lucrative 18-hole course, touching on a hot topic for the 2024 presidential candidate days after a New York jury found his family business guilty of tax fraud.

By accepting the easement, Doral can ban any future expansion of the Trump National resort onto the acreage currently housing the golf course. That’s been a path followed by other courses in South Florida and beyond as the popularity of the sport ebbs and demand for new development sites continues to soar.

Golf clubs selling out for housing development is a big thing here in south Florida.. there is a huge golf club next to us in Lake Humidity that just went under agreement to be turned into a 'community' ...

eyeballing the size of it compared to our 'community' I'd guess it will be about 700 homes.

They've already developed all the old tomato farms. There is not much agriculture left around here, so moving on to the next source of land.

I understand that the Secret Service have a very limited duty for a former president, eg just save his live if attacked. The vetting of guests to be the role of the host. It's up to the host to prevent questionable characters attending lunch or dinner. Or it's up to the event organizers to set up extra screening if they think they will have an illustrious guest like an impotus. The agents will only act if a guest missbehaves and pulls out objects of massdestruction. I believe that access to the former guys personal living space will be controlled by the Secret Service, but not the premises surrounding it.

Well thzts no great loss, the tomato farms, that is. Florida tomatos are most tasteless rubbery skinned things ever foisted on an unsuspecting consumer. Of course the big supers love them, so the seed lines have escaped their natural habitat in the FSU ag labs to infest farms all over, so its not all good.

Yeah, today's supermarket tomatoes were bred in a lab at FSU to have tough skins that could ship easily without damage. They also have no taste to speak of and are an abomination (IMHO).
