This argument was made by a defense attorney seeking leniency for Jan 6 defendant Robert Packer at sentencing tomorrow ====>

("In" Jan 20, 2017 .. and alleging hundreds of thousands marched in protest in Jan *20*, 2017)

Elsewhere in Capitol riot world, Josiah Kenyon, of Nevada, pleaded guilty today to two counts of assaulting police w/ a dangerous weapon, including one w/ an enhancement for causing bodily injury. Sentencing set for Dec. 15.

Josiah Kenyon wore a full-body Jack Skellington suit to the Capitol riot, but his conduct was serious. He admitted in his statement of offense to using a flag pole to damage a window and then a table leg to repeatedly assault police.

I'm perfectly OK with McFadden deciding the government didn't prove their case. And I'm looking forward to all the poor folks learning to ask for a bench trial from this judge and seeing him acquit them whenever the government fails to meet their burden.

Sentencing at 2pm in Jan 6 case of Anton Lunyk of New York. In his plea deal, he admits posting on social media ahead of Jan 6 "Biden can't get inaugurated bro it just cannot happen"

Feds seek 20 days jail, arguing he went into private office of Sen. Jeff Merkley on Jan 6

Some Presidential Candidate, I assume, wrote:“When MAGA sends its people, they’re not sending their best. […] They’re sending people that have lots of problems, and they’re bringing those problems with us. They’re bringing drugs. They’re bringing crime. They’re rapists. And some, I assume, are good people”

I feel I can safely say many of those folks had already been arrested a few times for guns, drugs and domestic abuse loooooong before Jan. 6.

It's almost bedtime, so I won't unpack this in my mind until tomorrow, but worth posting.

(Thread.)

This New York Post opinion column hides the ball, but it would appear that the conservative FBI special agent here wanted to be a "conscientious objector" to... the arrest of members of a militia group who were at the western tunnel on Jan. 6.
https://nypost.com/2022/09/21/fbi-hero- ... americans/
Bombshell allegations by FBI Special Agent Steve Friend contained in a whistleblower complaint filed late Wednesday with the Department of Justice inspector general reveal a politicized Washington, DC, FBI field office cooking the books to exaggerate the threat of domestic terrorism, and using an “overzealous” January 6 investigation to harass conservative Americans and violate their constitutional rights.

Friend, 37, a respected 12-year veteran of the FBI and a SWAT team member, was suspended Monday, stripped of his gun and badge, and escorted out of the FBI field office in Daytona Beach, Fla., after complaining to his supervisors about the violations.

He was declared absent without leave last month for refusing to participate in SWAT raids that he believed violated FBI policy and were a use of excessive force against Jan. 6 subjects accused of misdemeanor offenses.

This American hero, the father of two small children, has blown up his “dream career” because he could not live with his conscience if he continued to be part of what he sees as the unjust persecution of conservative Americans.
:snippity:
He also has reported his concerns about a politicized FBI to Republican members of Congress, among 20 whistleblowers from the bureau who have come forward with similar complaints.

The White House switchboard connected a call to a rioter while the Capitol was under siege on January 6, 2021, according to former January 6 committee staffer Denver Riggleman.

“I only know one end of that call,” Riggleman said.

"It was impossible to go against the tidal wave of
people, all moving all in the same direction"

This irks me. “FBI has been politicized! They’re only arresting conservative Republicans!”

Well, now, son, you bring up an interesting point. Could it be that conservative Republicans, having suddenly realized there’s very little downside to breaking the law and very little up$ide to playing by old rules, make up the majority of white collar law breakers now? I didn’t see any Democrats take a dump on the sacred marble or break windows or batter the thin blue line with pipes and shields or whatever they could grab inside the Capital on Jan 6, did you? Or steal voting machines? Or vote more than once for their cheap Jeebus? Betchya dollars to donuts the vast majority of COVID relief fraudsters were of the elephant persuasion, too.

I would like you to shut up now.
