He chose a bench trial because he lucked out and got the judge that is jealous that he missed out on all the fun of rioting in the Capitol. He has handed out 0 jail sentences so far.
There's a lot of things that need to change. One specifically? Police brutality.

Judge sentences Fracker, a star witness in prior Capitol riot trial, to one year probation with 59 days home confinement in Virginia.

(Defense asked judge to keep confinement term under 60 days to avoid disruption in military disability benefits for Fracker)
I believe Fracker cooperated and testified IIRC.

There is a judge that has a record of allowing these rioters to go with hardly a slap on the wrist. Including some of whom wrote startling things in their social media prior to Jan 6. It's well known among the rioters that if you land that judge, then ask for a bench trial instead of a jury trial because that judge so far has been extremely lenient toward the rioters. The original comment is referring to one of the guys that got lucky enough to land this particular judge, and I was simply explaining that this is likely the reason he chose a bench trial rather than a jury trial. Because that judge has been extremely lenient in sentencing, even for people who are clearly a danger to society.
There's a lot of things that need to change. One specifically? Police brutality.

NEW: The first four defendants in the 9-person tunnel assault case have waived their right to a jury trial and will now instead begin a bench trial before Judge McFadden on Aug. 29. They each face between 5-11 charges apiece, ranging from assaulting police w/ weapon to robbery.

Kyle Fitzsimons trial Day 1 has wrapped. DOJ says they expect to wrap tomorrow with four more witnesses, including two officers he's alleged to have assaulted. One is USCP Sgt. Aquilino Gonell. Defense expected to spend a lot of time on him in cross-examination.
:?: For these quick, one defendant two day bench trials, is it worth starting an individual thread for each trial, or just keep it here in the main thread?

No. These are judges who have demonstrated bias. The assumption was not automatic. It was based on the consistency of their actions.

Inside the D.C. courthouse today, a man who was shooting video for a Gateway Pundit blogger told Capitol Police Sgt. Aquilino Gonell that he should be ashamed of himself. Then he confronted Gonell and his lawyer in an elevator and outside the courthouse.

On the idea that an attorney shouldn't ask a question they don't know the answer to, this seems an unwise inquiry. Or does that apply only to prosecutors?
