Inside the Washington, D.C., jail, where a group of defendants charged in the Jan. 6, 2021, attack on the U.S. Capitol have been held for as long as a year or more, a bitter divide is growing, current and former inmates say.

A combination of that intense proximity, the stress of criminal cases and a fight over more than a million dollars donated to support the defendants has contributed to the rift.

One inmate described the situation to NPR as "too many rats together in a small cage for too long."

"Tempers naturally get short," he said, with "cliques solidifying further into independent 'camps' as time progresses."

That inmate, like several others, told his story to NPR on the condition of anonymity to describe the pressure-cooker environment inside the jail. A dozen current or former inmates of the D.C. jail ultimately spoke to NPR and said that the divisions among some of the highest-profile defendants in the country are now boiling over.

Judge removes Griffin from office for engaging in the January 6 insurrection

SANTA FE — A New Mexico judge ordered Otero County Commissioner Couy Griffin be removed from office, effective immediately, ruling that the attack on the Capitol was an insurrection and that Griffin’s participation in it disqualified him under Section 3 of the 14th Amendment. This decision marks the first time since 1869 that a court has disqualified a public official under Section 3, and the first time that any court has ruled the events of January 6, 2021 an insurrection.

Section 3 of the 14th Amendment, also known as the Disqualification Clause, bars any person from holding federal or state office who took an “oath…to support the Constitution of the United States” as an “officer of any State” and then “engaged in insurrection or rebellion” or gave “aid or comfort” to insurrectionists. Griffin, as an Otero County Commissioner since January 2019, took an oath to “support and uphold the Constitution and laws of the State of New Mexico, and the Constitution of the United States.”

“This is a historic win for accountability for the January 6th insurrection and the efforts to disrupt the peaceful transfer of power in the United States. Protecting American democracy means ensuring those who violate their oaths to the Constitution are held responsible,” said CREW President Noah Bookbinder. “This decision makes clear that any current or former public officials who took an oath to defend the U.S. Constitution and then participated in the January 6th insurrection can and will be removed and barred from government service for their actions.”

Under New Mexico law, any private citizen of the state may file a lawsuit to remove a disqualified county official from office. A group of New Mexico residents were represented in this case by Citizens for Responsibility and Ethics in Washington and the New Mexico-based law firms of Freedman Boyd Hollander and Goldberg P.A, Dodd Law Office, LLC, and the Law Office of Amber Fayerberg, LLC, as well as by Cohen Milstein Sellers & Toll PLLC.

A New Mexico judge ruled Tuesday that Couy Griffin, a county commissioner and co-founder of Cowboys for Trump, is disqualified to continue serving in office because of his role in the Jan. 6, 2021, attack on the U.S. Capitol in Washington. Plaintiffs in the case argued that Griffin’s presence among the rioters that day disqualified him from serving under Section 3 of the 14th Amendment, which prohibits anyone from holding federal or state office who took an oath to support the Constitution and then “engaged in insurrection or rebellion” or gave “aid or comfort” to insurrectionists.

The decision marks the first time since 1869 that a court has disqualified a public official under the provision and the first time that any court has ruled that the events of Jan. 6 were an insurrection, according to Citizens for Responsibility and Ethics in Washington, which represented New Mexico residents in the case. District Court Judge Francis Mathew agreed that Griffin’s actions, though nonviolent, met the definition of disqualifying behavior.

In March, Griffin, an Otero County commissioner, was found guilty of a misdemeanor charge of illegally entering or remaining on restricted grounds by a federal judge. Griffin is one of the founders of the group Cowboys for Trump and a fervent supporter of the former president. Griffin had claimed he was a victim of political persecution — although his judge in March, U.S. District Judge Trevor N. McFadden, was appointed by Trump in 2017.

Among the evidence used to convict Griffin at the trial was video recorded by a videographer Griffin brought with him to Washington. That video showed Griffin climbing over a stone wall that marked the Capitol’s security perimeter and spending more than an hour on the front railing of the inaugural stage with a bullhorn, leading the crowd below in prayer. Griffin “crossed over three walls” McFadden wrote in March. “All of this would suggest to a normal person that perhaps you should not be entering the area.” In 2018 Griffin was elected county commissioner, with 65 percent of the vote, easily defeating a Democratic challenger.

Mathew, the judge in New Mexico, held a two-day bench trial on the case last month and gave both sides additional time to submit written closing arguments. “Nonviolent members of the mob, including Griffin, camouflaged violent members of the mob, contributed to law enforcement being overwhelmed by a ‘sea of potential threats,’ ” attorneys for the plaintiffs wrote in the closing statement. “Griffin did more than just join the mob: he incited, encouraged, and helped normalize the mob’s violence on January 6.” Griffin argued in a written closing statement that those seeking to remove him from public office “missed their mark” and failed to prove that the assault on the U.S. Capitol on Jan. 6, 2021, was an insurrection, according to the Albuquerque Journal.

An appeal would be risky because an appellate decision saying insurrections can be tossed off the ballot may quickly spread to other states (and federal courts). Might be better for "the movement" to cut its losses and abandon Griffith.

Ha ha ha... that would be smart which is a pretty good indicator that they won't and he will be the next Fox News celebrity oppressed white guy. Without knowing for sure I will take all bets at 3:1 that he will be on Hannity by the end of the week.

The jail said they're "taking extraordinary care to avoid cross contamination."

BREAKING: A federal grand jury has indicted Hatchet Speed, the Naval Reserves petty officer already charged in the Capitol riot, on three new felony counts for allegedly possessing unregistered silencers. Speed made his initial court appearance at 2 p.m.
