HAPPENING NOW: Sentencing in Jan 6 case of Richard Watrous of Cortland, New York. He's accused of video recording the chaos, while in the Capitol. He's also accused of contacting the Proud Boys in October 2020 to get info about the organization

Feds are seeking 14 days jail

NEW: Court has unsealed US Capitol riot case against Barry Ramey of Florida who's accused of "spraying an orange substance consistent with pepper spray into the face of a law enforcement officer"

Why do learned people like lawyers split infinitives? :fingerwag: To "voluntarily" dismiss is ugly and grates on one's ears. "To dismiss voluntarily" is euphonious.

Or, if one is so inclined, recast the locution to something like "Motion for Voluntary Dismissal of Appeal."

I keep a very sharp knife on my desk for the sole purpose of splitting infinitives. On occasion, they are absolutely necessary.

Starting with the greatest split infinitive of them all:

"To boldly go where no man has gone before!"

Unsplit that one and tell us about euphonious. :biggrin:

The proscription against the use of split infinitives appears to be of relatively recent origin and is not really consistent with actual usage patterns:

With respect to the QAnon Shaman’s voluntary dismissal of his appeal, my guess is that the best hope for the Shaman was an “ineffective assistance of counsel” argument. When defendants attempt to raise ineffective assistance on direct appeal, the Court of Appeals almost invariably declines to consider the issue, because it ordinarily requires the introduction of facts outside the record, e.g. what did the lawyer tell the defendant? Ineffective assistance issues are typically litigated in a new section 2255 case. I would bet dollars to doughnuts that a habeas petition making ineffective assistance claims is soon filed.

Sentencing at 11am in Jan 6 case of Christian Kulas of Illinois. Feds to seek TWO WEEKS of jail for Kulas, who's not accused of assault or damage -- but is accused of recording images and laughing amid the riot... and raising his arms and cheering when mob broke down a door

Court has unsealed another Florida case in the US Capitol riot prosecution

Matthew Montalvo is accused of being amid the mob inside the Capitol for at least 25 minutes while carrying a tan backpack.

Yeah, appreciating what they did can be difficult, but it is important to respect when somebody we may despise does the right action for the right reason. If folks did not, those who may actually choose the better path won't.

This does not mean they are absolved of all their past choices or are now somebody we want elected to office, but we can appreciate the good choices they did make.

I find Pence's politics to be despicable, but AFAIK, he is not under investigation for any crimes, such as tax fraud. The things he has done have been done within the law, and he has tried to make laws that I don't approve of, but it is the power of the government to make laws, and for the governor of a state or the VP of the US to advocate for laws or government policy.

So, I have to give him a little credit for upholding the rule of law, and for understanding that there are limits to what he, his former boss, or his party can legally do to remain in power. If the majority of voters choose a Republican candidate, so be it, but if they choose a Democrat, we must all abide by that result and not attempt to undermine the entire election process.
