THe FBI has arrested and charged Jan. 6 rioters who entered the Senate chamber and sat in the seats of Sens. Cramer and Toomey during the riot. (They would later resist and assault officers, according to investigators)

I haven't read the papers, but, from the blurb, ineffective assistance of former counsel seems like an uphill battle.

Chansley has to argue he wouldn't have accepted the plea deal if his counsel had access to even more evidence. But Chansley was there; he knew what he did.

I looked at the papers; pretty weak stuff.

Argues a Brady violation (for not disclosing some of the footage from the interior cameras; thanks, Tucker!) and ineffective assistance of counsel for recommending taking the plea that included an upward adjustment for violence and threats, which, natch, the Tuck footage "disproves." :roll:

This seems to go nowhere, as the papers concede Chansely told his former lawyer about being escorted. It is just an attempt to make hay about Chansley's being "led" into the Senate chamber. :yawn:

The government likely will respond the crux of the crime was violent breach of the Capitol; what happened after was immaterial to pleaded charge.

And to answer the implicit question: it is possible the court could agree with Chansley on the Brady claim, vacate his conviction, and dismiss. But even if the court grants Chansley relief (which is unlikely), the court more likely would just vacate the conviction and let the government decide how it wants to proceed.

Chansley is now represented by William Shipley. :yawn:

Olbermann recently went in-depth on the issue of Chansley and the CCTV tapes*.

Assuming he has the story straight, all but ten seconds of the CCTV in which Chansley appeared were handed over to his legal team in the fall of 2021 (when he was with his first lawyer). Ten seconds of CCTV footage were not handed over at that time, because they were deemed to show escape plan information. Those ten seconds were handed over to legal team I think in early 2023 (and did not show anything exculpatory...duh).

Tuckums didn't have anything that Chansley's team didn't already have.

I don't recall the details from Chansley's papers, but I believe he's complaining about more than 10 seconds.
Tuckums didn't have anything that Chansley's team didn't already have.
Chansley disagrees; he wants diiiiiiiiiiiiiiiscovery! on this topic. :roll:

But the major premises stand: Chansley before he pleaded had access to much of the footage, and he was aware some footage had not been disclosed (due to security concerns). And nothing since discovered or disclosed exculpates Chansley from the charged crime.

If you were in prison for several years, you'd want out too. Is he getting the organic food his body so magically requires?

Also, he needs to be out there shouting at people in parking lots like in the good ol' days.

A Powell man who was convicted for his participation in the Jan. 6, 2021 insurrection at the U.S. Capitol — and who continued to spread misinformation about that day and the 2020 election to his more than 67,000 Twitter followers — is now facing federal prison.

Alexander Sheppard, 23, was sentenced Thursday in U.S. District Court for the District of Columbia in Washington to seven months in prison. Federal prosecutors had asked for 15 months.

U.S. District Judge John D. Bates also ordered Sheppard to pay $500 in restitution. Bates moved forward with the sentencing despite Sheppard’s request on Wednesday to postpone sentencing while he files a request for a new trial.

In January, a federal jury convicted Sheppard of five criminal counts, including obstruction of an official proceeding and disorderly or disruptive conduct in a restricted building. The jury found Sheppard not guilty of remaining on the floor of Congress.

Bates called the events on Jan. 6 an extremely disturbing assault on the country's democratic values and the peaceful transition of power.

Florida man gets prison term for role in attack on Capitol

WASHINGTON (AP) — A Florida man has been sentenced to four years and two months in federal prison for attacking police officers during the insurrection and storming of the U.S. Capitol on Jan. 6, 2021.

Christian Matthew Manley, 27, of Fort Walton Beach, Florida, was sentenced Tuesday in federal court in the District of Columbia, according to court records. He pleaded guilty in November to assaulting, resisting and impeding law enforcement while using a dangerous weapon.

According to court documents, Manley joined with others in objecting to Democrat Joe Biden’s 2020 election victory over then-President Donald Trump. A mob stormed the Capitol in an attempt to stop Congress from certifying election results for Biden over Trump, a Republican, authorities have said. Five people died in the violence.

According to the criminal complaint, Manley was captured on video outside the Capitol wearing a flak jacket and armed with bear spray, a collapsible police baton and handcuffs. Video shows Manley spraying bear spray at U.S. Capitol Police and Metropolitan Police Department officers as they defended an entrance from rioters.

Manley threw the empty bear spray container at officers, then sprayed a second cannister at officers before throwing it at them, prosecutors said. A short time later, Manley accepted a metal rod from another rioter and threw it at the officers, investigators said. They added that Manley also wedged his body against a wall in a tunnel and used force to push the security door against officers defending the Capitol.

In a just world, the case would be remanded, he's go to trial and get a longer sentence than he had with the deal he wants to toss.

Ahead of sentencing next week, Jan 6 defendant Peter Schwartz called into protest outside of DC jail. He said Congress should be considering impeachment of judges for how judges are handling Jan 6 cases

Schwartz faces a recommended 24 years in prison on May 5

Convicted J6er Yvonne St Cyr had a mandatory psychiatric evaluation. I bet telling the psychiatrist that she’s a “starseed” really helped.

Per feds: "Several officers were injured as a result of the explosion."
