P&E: Citizen Demands Senate Judiciary Committee Remove “Treasonous” Jurists, Restore Constitutional Governance:
In September 2010, New Jersey citizen, military veteran and constitutional scholar Nicholas Purpura and co-plaintiff Donald R. Laster filed a 19-point lawsuit challenging the Affordable Care Act, colloquially known as “Obamacare,” which eventually was appealed to the U.S. Supreme Court in late 2011. The law, passed in December 2009 without a single Republican “yea” vote, was unconstitutional, Purpura and Laster maintained, because as a revenue-raising bill, it should have originated in the House of Representatives in accordance with Article I, Section 7 of the Constitution.
For the newbs: Purpura is a birther; he was the plaintiff in a 2012 New Jersey ballot challenge in which Purpura's attorney, Mario Apuzzo, got schooled.

Continuing:
Purpura’s latest communication with The Post & Email concerned a new project which he believes could restore constitutional governance in all 50 states, not only in regard to New Jersey Second Amendment issues, but also the U.S. Constitution and Bill of Rights.

Nearing age 80, Purpura said he sees this latest effort as a mission. The documents he drafted, which contain extensive citations of case law, demand that the U.S. Senate Judiciary Committee act to remove judges who have committed “high crimes and misdemeanors” by failing to uphold the principles contained in the U.S. Constitution and Bill of Rights.
He and Laity should go in together on postage for their pointless paper-throwing crusades.
“Selective enforcement by the judiciary places the Court and the ruling jurist above the law,” Purpura wrote in a Writ of Mandamus directed to the committee. “Such actions would be a violation of their oath of office and equates, on the part of the Court, to a seditious and treasonous crime. This is according to Supreme Court concurring ‘stare decisis’ authorities.”
Purpura's "writ." A petition for a mandamus writ is a request for an order to direct someone to do something. Legislatures don't entertain writs; if you want a legislature to do something, you just ask, like ... in a letter. And if you want an order to force the legislature to do so something, you file that petition in a court. ("For completeness," Purpura now is just recycling some paper he had thrown at SCOTUS.)
“Two weeks ago, Donald Trump, Jr. came out and said he wants to form a task force on the Second Amendment,” Purpura said. “If you read my Writ carefully, you can’t argue with me. Every liberal and conservative judge has ruled on these cases. This is not just a Second Amendment argument. The First Amendment is free speech.” As for the Sixth and Seventh Amendments, Purpura said, “Habeas corpus was abandoned with the January 6 arrests.”

“So I’m putting out my brief. I’ll wager that no one at the Supreme Court or the entire judiciary can stand before me and try to prove me wrong; you cannot. So what they’re going to do is ignore. That’s been the modus operandi of our Congress and the Judiciary.
Unlike Laity, Purpura's bright enough to know he'll be ignored (just not for the reasons he believes).
“This is a national issue, and it’s time to go public. The Writ of Mandamus puts everybody on the spot. It goes to the First Amendment, protection of the 14th Amendment, addressing the abuses of the Sixth and Seventh — the entire Bill of Rights. All of them swear to it and then violate their oaths of office. Most people don’t realize there is no expiration date when you take that oath.

“I’m on a ‘hit list’ for uncovering corruption back in the 80s,” Purpura said, “but they wouldn’t give me a carry permit in New Jersey. The FBI came here and said, ‘You’re on the jihadist kill list.’ In the Writ, there is a special note: I have carry permission in other states, but not in New Jersey.
Last week, Purpura informed us, he sent his documents to all Republican members of the U.S. House of Representatives and Senate. “It’s a waste of time and money to send it to the Democrats,” he said.
I'm no constitutional scholar like Purpura, but last time I counted noses, there aren't enough votes for the Republicans to unilaterally impeach, convict, and remove any federal officer.

Bonus:
“I know as a pro se I won the case against Sebelius and all the way up there,” Purpura told The Post & Email. “I won the Second Amendment against Christie; I did one against [current New Jersey Gov. Phil] Murphy.

* * *

The Supreme Court denied the plaintiffs’ petition for a Writ of Certiorari in January 2012 [against Sebelius], and a petition for rehearing was “denied without comment” the following month.

* * *

“The lower courts repeatedly violated the [Second Amendment] and ignored all the case law examples in there,” Purpura said, for which the Supreme Court ultimately denied certiorari on October 30, 2017.
Getting fact-checked by Rondeau in her puff piece bout you.

To be very generous, it sounds like Purpura pulled some Klaymans, i.e., threw papers at a court, and his papers accomplished nothing, but they were aligned with others' cases that did ultimately persuade a court. In other words, taking credit for a result you didn't create.

“I’m on a ‘hit list’ for uncovering corruption back in the 80s,” Purpura said,
Funny how his wife filed for divorce in 1985 and he spent at least 23 years suing her and I think everybody else involved including judges, lawyers, and probably the guy who cleaned the courtrooms at night. I wonder if this is the "corruption" he refers to.

The case was in New York, but after spending 20 years losing there, he chose to sew everybody in the NJ Federal Court (in 2008). Of course, he included RICO.
https://www.casemine.com/judgement/us/5 ... 493475eab7

In 2016, he sued Chase because they ended up with his WaMu mortgage. Oddly, he had defaulted earlier on it but resolved it with Chase and created a new agreement.

P&E: How Close were the FBI and Perkins Coie when the Obama “Birth Certificate” was Released?:
Toward the end of Tuesday’s edition of Fox News Channel’s “Tucker Carlson Tonight,” Rep. Matt Gaetz (R-FL1) told host Tucker Carlson that a “whistleblower” informed him that for at least a decade, the FBI has maintained a “working space” within the Washington, DC office of the international law firm Perkins Coie.
This unnamed "whistleblower"'s gossip serves as Rondeau's springboard for re-re-re-rehashing of the usual birther greatest "hits."

P&E: Congressman Responds on January 6 Prisoners:
OR DOES HE?

On Monday, reader [and birther, but I repeat myself] Michael Jackson of Illinois’s 18th congressional district contacted his congressman, Darin LaHood (R), on several issues expressed as questions and providing links for additional information.
Birther pens rambling screed, gets FOAD'ed.

At least Jackson has an ounce of self-awareness:
Jackson (to LaHood) wrote:One dare not question the king of lies, Barack Hussein Obama’s election fraud from 2008, 2012 or you are a conspiracy theorist, racist, birther and domestic terrorist also.

Weird how the Congresscritter's reply changes typeface for the one paragraph. The voice reads a bit different as well. It's entirely possible that a form paragraph was inserted into a form letter. But then again, this is P&E.

Looking at it, I would say they have an extra "customized for situation" block that inserts a form paragraph that address certain requests in more detail. However, whoever set up their system for that merge did not remember to set the block text to be the same font as the rest of the generated text. As somebody who works with many system-generated documents, dumbass mistakes like that annoy me (and I have seen them too often). If your IT tech people are not good at the visual elements, don't let them maintain the source template. Their talents are better used on coding anyway.

At this point I'm legitimately wondering what they are actually after, an asterisk? Or a time machine? Cause honestly even with the sunk cost fallacy it is LITERALLY impossible for this to be worth the effort even if they were completely vindicated at the end.

And, if BHO were ruled by some authoritative source to be ineligible to be POTUS, every bill he signed and every executive order would suddenly go "POOF" and cease to exist. That means that that socialist monstrosity, Obama Care, would be null and void.

P&E: Hearing Scheduled on Minnesota Eligibility Lawsuit:
A case filed early last month with the purpose of ascertaining the constitutional eligibility of two candidates in Minnesota’s fifth congressional district Democratic primary by another candidate, AJ Kern, is scheduled for a hearing on June 23 at 2:30 PM in the state’s Fourth Judicial District courthouse in Minneapolis.
"Hearing" is doing too much work; Rondeau "forgot" to mention the hearing is for the defendants' motions to dismiss.

To recap: candidates Omar and Samuels shined on AJ Kern's totally-not-racist "papers, please" demands, so gadfly (and perennial candidate) Kern sued them (and the SoSoMN).

Inevitable dismissal forthcoming.

Oh:
“Both the SOS and Omar attorneys are making the claim that I am contesting an election and I should file after the August primary,” [Kern] told us on Thursday. “They are wrong. I am not contesting an election. Omar’s attorney is also claiming this is a ‘birther’ thing. It is not. I don’t need her birth certificate. I don’t care if she was born in 1981 or 1982, etc. I seek her official naturalization record.”
NARRATOR: "It was, in fact, a birther thing."

Remember Mark Small? The Indiana lawyer who filed a birther-esque SCOTUS petition to undo the 2016 election?

In 2020, he ran in the Republican primary for Indiana's CD-5 and got around one percent of the vote. (The Republican who won the primary also won the general election.)

IIRC, Small said he ran as a Republican because that was the only way to get a seat at the table in a red state. Fair enough, I suppose.

Now, in 2022, Small won, unopposed!, the Republican primary for Indiana's House of Representatives (state assembly) District 86. On the Democratic side, the sitting representative won, also unopposed. That representative has been serving since 2008.

Which might explain why literally no else bothered to run for either party.

Birtherism always has been a solution in search of a problem.

Birthers want to live in a world where they can make up the most ridiculous lies and then place the burden on the candidate to show that the lies are wrong. Which takes effort, and is both distracting and detracting.

In the meantime, the birther-heckler will have moved on to the next lie.

:fingerwag: : P&E: Minnesota Eligibility Case Not Dismissed:
NOR DID PLAINTIFF MAKE THE CLAIM

Contrary to claims made by commenter "[some jerk*]" in response to our recent articles about a Minnesota case asking a court to compel two foreign-born candidates to prove they are U.S. citizens and therefore constitutionally eligible to office, the Facebook page of challenger AJ Kern does not report that her case, heard on Thursday by Judge Bridget Sullivan, is or will be “dismissed.”
Trolling Rondeau (with reality) is newsworthy!
[some jerk]’s initial comment is invisible to readers due to the number of comments submitted in response to our latest article on the subject, an issue of which The Post & Email was unaware until today. However, the comment appears below the article in the Dashboard [visible only to Rondeau].
DAMN THAT OVERACTIVE SPAM FILTER!
Despite [some jerk]’s assertions, other than posting the comment that “Minnesota does not vet the citizenship of federal candidates but provides the appearance of doing so through the Affidavit of Candidacy” (shown above) following the hearing, Kern has not commented on the hearing or what she expects Sullivan’s ruling might be. Rather, it is [some jerk] who has prognisticated at length as to what he believes, or desires, the outcome to be.
If Kern sued Minnesota to compel it to vet Omar, and then acknowledges that Minnesota doesn't vet candidates, what else is Kern saying?
As most of our readers are aware, knowingly posting false information is cause for a commenter being permanently banned.
A "rule" that applies only when Rondeau disagrees with the commenter.
The Post & Email will report on Sullivan’s decision after it is issued.
The Post & Email will not acknowledge [some jerk] was correct all along.

P&E: Is Bret Baier a Journalist or Commentator?:
On Tuesday afternoon, “Fox News Staff” posted a transcript and video of “Special Report” host Bret Baier’s opining on the testimony to the January 6 Committee of Cassidy Hutchinson, a former aide to Trump White House Chief of Staff Mark Meadows.
What follows is long list of grievances about Hutchinson's testimony.

Rondeau runs out of steam, so of course:
In a January 2017 broadcast announcing then-former Maricopa County, AZ Sheriff Joseph Arpaio’s attendance at a retirement sendoff following his six terms in office, Baier mentioned the 5+-year criminal investigation into Barack Hussein Obama’s long-form birth certificate but did not include the final press conference held less than three weeks earlier on December 15, 2016, in which investigator Mike Zullo revealed that two forensic document examiners, working without knowledge of the other and from different disciplines, found the birth-certificate image to be fraudulent, corroborating Zullo and Arpaio’s claims from earlier in the probe.

On January 3, 2017, The Post & Email wrote:
P&E wrote:Baier instead reported that “the president and the White House” called the posse’s findings “ridiculous,” even though neither Obama nor the White House has issued a public response to the conclusions reached by investigators. Baier then reiterated that President-Elect Donald Trump, who Baier said “launched his own investigation” into the birth certificate image, “has said the president was born in the United States.”
Rondeau's five-old-year birthering is newsworthy!
