Greg Doucette, a lawyer admitted in Texas who has a good track record for reliable online posts, lays out the reasons why the punitive damages award will be reduced to $750k.

Depending on how the verdict reads (I haven't seen the actual text anywhere), there may be multiple awards of $750k against more than one of the four defendants.

It looks as though there will be two $750k awards, one for each plaintiff.


Folks seem to be misinterpreting my earlier tweet about Texas's punitive damages statute, so let me simplify it:

Punitive damages against Alex Jones will be in the range of $0 – $750,000 regardless of how the jury rules

The jury does not know this yet

1/

The Texas Civil Practice and Remedies Code has the statutes that will apply here

Section 41.001 splits out "economic" vs "non-economic" damages

2/

Section 41.008 is the "tort reform" statute that caps punitive damages

The punitive damage cap formula is:
[2 x economic damages]
+ [up to $750K non-economic damages]

If that number ends up less than $200K, the cap on punitives is instead $200K

3/

Subsection (e) of 41.008 prohibits telling the jury about that cap, because the idea is you don't want to artificially influence the jury's decisionmaking

So the jury can come up with whatever number it wants. If it's over the cap, the judge will then reduce the award

4/

The jury has already awarded compensatory damages of $4.1M

None of that was economic; it was all non-economic

So the punitive damages cap formula will be:
[2 x $0]
+ [up to $750K of $4.1M]

Which equals $750,000

5/

There are several types of lawsuits where that cap doesn't apply (most are cases where someone injured someone else while committing a felony of some sort or another)

None of those exceptions apply to this case

Your formula looks to match Doucette's, but Doucette assumes none of the original damages counted as "economic" damages:

Which equals $750,000
Economic damages are compensation for financial losses, things like medical bills. The large amounts are for pain and suffering or mental anguish and those don't count as economic damages. Farther down in the posted thread he indicates some uncertainty on this -- it might be that a small portion, perhaps $50 - $100 K, did count as economic damages, and that could push the cap up into the $900 K range.

ETA: By the end of the long thread, Doucette winds up more certain the economic damages were 0. A small chunk, $60K each parent, was for reputation damage, but that is also considered non-economic, he says.

The last 10 minutes or so of the punitive damages hearing yesterday afternoon. And the whole "that's not true" exchange lasted for probably over a minute. Every time the attorney said something, the Judge contradicted him and made a very sarcastic comment towards the end about him (paraphrasing) expecting her to take his word for something instead of believing the document in front of her, that HE submitted.

And when the older attorney was whispering in his ear, he also had his hand on his shoulder back like he was pushing him to sit down. It was pretty weird.

She is a Yale-educated (both undergrad and law) Democrat, Latina child of immigrants, with extensive civic engagement history, honored by both the State and Federal Attorney General, and seemingly in a long-term stable marriage.

I sincerely hope she is not Milkshake Ducked, because I want to enjoy her as a minor judicial celebrity for awhile.

I've been reading a blog called "Juanita Jean's: The World's Most Dangerous Beauty Salon" for several years, and I have no idea how I found it originally. Maybe here on The Fogbow? She gives a refreshing perspective on Texas politics, though I haven't been reading her much lately because I find the goings on in Texas too depressing.
