NY Assembly Suspends Impeachment Investigation Into Cuomo's Actions

The New York Assembly will not move forward with its impeachment investigation of Governor Andrew Cuomo, Speaker Carl Heastie announced on Friday afternoon.

The Assembly's Judiciary Committee had been conducting an investigation of the governor's actions since March, and had requested evidence from the New York Attorney General's report outlining the governor's sexual misconduct and workplace violations. The committee had also given Cuomo and his legal team until 5 p.m. on Friday, August 13th, to submit any evidence they wanted the committee to consider. But Cuomo's decision to resign on August 24th raised questions about whether the legislature would be able to impeach him if he was already out of office. An impeachment would have meant that Cuomo would not be able to run for office again.

"First, the purpose of the impeachment investigation was to determine whether Governor Cuomo should remain in office. The governor’s resignation answers that directive," Heastie said in a statement. "Second, we have been advised by Chair Lavine - with the assistance of counsel - of the belief that the constitution does not authorize the legislature to impeach and remove an elected official who is no longer in office (see attached memo)."

The sex-crime case against former Gov. Andrew M. Cuomo was thrown into doubt on Friday after the Albany County, N.Y., district attorney delivered an extraordinary public denunciation of the local sheriff, saying the criminal complaint the sheriff filed last week was “potentially defective.”

In a letter to an Albany, N.Y., judge on Thursday, the district attorney, David Soares, took issue with the Albany County sheriff, Craig Apple, for “unilaterally and inexplicably” filing the complaint without the knowledge of Mr. Soares, whose own investigation was still active.

The letter underscored how the sheriff’s surprise decision to charge the former governor without coordinating with Mr. Soares could ultimately threaten the case against Mr. Cuomo. Such coordination is typical in long-term, high-profile law enforcement investigations.

In his letter, Mr. Soares noted several possible problems with the sheriff’s filing. He said it was “potentially defective” because it did not include a sworn statement from the alleged victim, Brittany Commisso, that would allow a prosecution to proceed.

Mr. Soares also wrote that it was “even more troubling” that the complaint excluded portions of testimony that Ms. Commisso had previously provided to investigators with the state attorney general’s office. He also asserted that one section of the complaint misstated the relevant law.

Cuomo Is Ordered to Forfeit Earnings From $5.1 Million Book Deal
The ex-governor ran afoul of ethics laws in writing a book focused on his leadership during the pandemic, a state panel had previously found.

Former Gov. Andrew M. Cuomo was ordered to turn over roughly $5.1 million in proceeds from his 2020 pandemic memoir within 30 days, after a state ethics board found that he had run afoul of state ethics laws.

The board, the Joint Commission on Public Ethics, directed Mr. Cuomo on Tuesday to relinquish the money to the state attorney general’s office, and authorized the office to enforce the collection.

Mr. Cuomo has vowed to fight the resolution, which owing to its unique circumstance would seem to have little precedent, in court. “JCOPE’s actions today are unconstitutional, exceed its own authority and appear to be driven by political interests rather than the facts and the law,” said Jim McGuire, a lawyer for Mr. Cuomo. “Should they seek to enforce this action, we’ll see them in court.”

The order, which is sure to set up a protracted legal fight, could be complicated by the fact that Mr. Cuomo already donated $500,000 of the book’s proceeds to charity, and placed another $1 million in a trust for his daughters.

This is the commission’s latest attempt to litigate the approval of Mr. Cuomo’s pandemic memoir, “American Crisis: Leadership Lessons from the Covid-19 Pandemic.”

The ethics panel previously found that Mr. Cuomo misrepresented the subject of the book, and how far along it was, in his request.

“You have a cynical public, they don’t believe anyone and when you start to see these prosecutors bring political cases, it just affirms everybody’s cynicism,” Cuomo told John Catsimatidis on Friday on WABC 770’S “The Cats Roundtable.”

“It’s a coincidence that Bragg goes after Trump and Tish James goes after Trump and Georgia goes after Trump. That’s all a coincidence,” Cuomo scoffed, referring to James’ investigation of the Trump Organization and the District Attorney of Fulton County’s probe into Trump’s efforts to overturn the 2020 presidential election.

“It feeds the cynicism and that’s the cancer in our body politic right now,” he added.

I'm at a loss as to what the motivation could be for this willful ignorance. No, it's not a coincidence that Trump is under investigation in at least four different venues, it is a predictable result of a veritable lifetime of flouting the law whenever and wherever it suited him and depending of privilege and audacity to insulate him from any consequences. Maybe Cuomo needs to see Trump as unfairly persecuted to maintain his denial that his own downfall was a result of his bad behavior. In any case, with this statement he's put himself in the same group as Alan Dershowitz and Jonathan Turley of people who spent decades building a reputation only to throw away any pretense of integrity for... not much.

Certainly he's bitter and defeated and itching to get back at those he sees as having unfairly brought him down, I'm just wondering what motivated him to make a public statement in the NY Post. Something stinks here, I just have no idea what the quid for this pro quo might be.

IMO, as a former Cuomo fan, this relates to how Tish James et al. went after him for sexual harassment. He has unloaded a lot of anger and resentment towards NY dems and AG office because of that.

After a semi-acknowledgement of some of his inappropriate behaviors, he went into denial/victim/grievance/attack mode when the groping the employee issue came to a head. He's been there ever since, and has been making stupid, resentful comments fairly regularly. He sounds like an idiot each time, and is not well-received by NY dems (duh).

So for me, this is another step along that journey; he won't become a Republican (his daddy would roll over in his grave), but he enjoys putting other people down, and since he no longer has a reason not to make enemies (his political career in NY is over), he's going for full enjoyment.

Bitterness and the desire to hurt people (a basic type of abuse) is the scourge of humanity.
