SCOTUS Decisions That Affect Presidential Elections

#1

Post by sterngard friegen »

We're seeing how the Dobbs case seems to be strongly affecting the 2024 Presidential election (as well as other elections throughout the country since the decision). Obviously, the authors of the decision did not intend for this to happen, but here we are.

I can think of another fairly recent SCOTUS decision which also had an unintended effect on a Presidential election (but not on downstream elections).

Can any of you identify the case I am thinking of and its affect in that year's Presidential election?

Is this graded on the curve?

Any birther would tell you, inaction by the Supremes ("we're evading the issue") allowed Obama to serve a second illegal term. :biggrin:

I can think of one published decision. There may be others.

I am not grading this on a curve.

I mean, depending on your definition of "fairly recent".
But the sunshine aye shall light the sky,
As round and round we run;
And the truth shall ever come uppermost,
And justice shall be done.

“a Presidential election” would indicate a specific one.

That seemed obvious, but maybe not for overthinkers here.

Yeah, and Bush v. Gore wasn't exactly recent, being a quarter century ago. I give up.

Plus, in Bush v Gore, the consequences for a presidential election were not unintended.

Given Stern’s aeons of experience, his definition of “fairly recent” may be “fairly loose”. ;)
