I think anytime you put Donald Trump under oath is a perjury trap. There is no way on the good earth that thing can talk for 8 hours and not lie. If he makes it past the part where you say and spell your name he'll be beating the book.

In fairness, he does sometimes legitimately forget that there's no definite article before 'Donald'. Legit forgetting is not perjury.

I think the earlier iteration of tfg was one to be cautious with his answers under oath.

The tfg 2.0 has been emboldened over the past six years. He knows he can say and do anything without dire consequences. He survived two impeachment trials in the Senate. He has 80% of the Rethuglican Party groveling at his feet. He has unfettered support from the unwashed masses who believe everything he says. He is still the poster child for Faux News and their bobble heads.

He will perjure himself as he sees fit because he feels that there is no way some government lawyer lackey can outfox the Master of Them All. The only question is whether there is enough perjury to file criminal (not civil) charges of perjury. I wonder how often civil perjury charges are prosecuted and what the penalties are.

Just some random thoughts from a non lawyer.......

Perjury is a crime; there is no (civil) tort of perjury.

This is primarily a policy choice: If someone injured by perjurious testimony could sue the witness, the inevitable result would be lawsuits all the way down, and no one would ever testify.

In theory, one could (to paraphrase PopeHat) "do the RICO" and allege, in a civil suit, that the perjury was part of a corrupt enterprise.


A verdict based on perjured testimony can be later undone, but it is not easy, and foremostly requires convincing the trial judge that perjury did occur.

Is it wrong that the Taitzian shreik of the word is now forever replaced in my head with a Disco version of "Do the RICO!" to the tune of "Do the Hustle!"? Because I think it means I'm growing as a human being. Or regressing to childhood in my old age. One of the two.

Cushman and Wakefield, the real estate firm used by Trump to allegedly inflate the value of his real estate properties, has been ordered by a New York judge to pay a daily $10,000 contempt fine for failing to turn over evidence to state investigators.

Trump’s ‘American Freedom Tour’ scheduled for this Friday in NC was canceled and ticket money refunded (supposedly) after he, Junior and Ivanka were ordered to testify under oath in NY on the same day.

The US Justice Department, which represents former Attorney General William Barr and other government defendants in the suit, also sought dismissal of the case at a hearing Tuesday in federal court in Manhattan.

Cohen claims the former president and Barr rescinded his release to home confinement in the early days of the pandemic, forcing him to spend 16 days in solitary confinement, in retaliation for his plan to write a tell-all book.

Trump’s lawyer Alina Habba argued the former president can’t be sued because he was in office at the time of the alleged conduct.

“This is a very clean cut case where absolute immunity does apply,” Habba said.

Asked by the judge if a president would still be immune from a civil suit if he ordered his valet to kidnap a political opponent and hold them for two weeks before an election, Habba replied “absolutely not.” Immunity “doesn’t mean they can go around willy nilly committing crimes,” she said.
