A public college in Idaho is coming under pressure to explain why it has removed from an upcoming exhibition in its Center for Arts & History several artworks dealing with reproductive health and abortion.

The American Civil Liberties Union (ACLU) and the National Coalition Against Censorship have jointly written to Lewis-Clark State College expressing “alarm” at the decision to remove several pieces.

Their letter says that the college’s response demonstrated the potential abuses of new laws that have come into effect in Idaho banning the use of public funds to “promote” or “counsel in favor” of pregnancy terminations.

Titled Unconditional Care, the show invites artists to reflect on some of the most pressing health issues today – from chronic illness to disability and pregnancy. The participants share the stories of people directly affected by the challenges.

Items that touch on abortion have been singled out for removal from the exhibition. Artists were told their work violated Idaho state law that kicked in after the US supreme court overturned the right to an abortion enshrined in Roe v Wade.

The federal judge in a closely watched lawsuit that seeks to overturn federal approval of a widely used abortion pill has scheduled the first hearing in the case for this week, but he planned to delay making the public aware of it, according to people familiar with the case.

Judge Matthew J. Kacsmaryk, of the Northern District in Texas, told lawyers in the case Friday that he was scheduling the hearing for Wednesday morning. However, he asked them not to disclose that information and said he would not enter it into the public court record until late Tuesday evening.

One person familiar with the case, which is being heard in federal court in Amarillo, Texas, said such steps were “very irregular,” especially for a case of intense public interest.

Wyoming Governor Mark Gordon on Friday signed into law a bill outlawing the use or prescription of medication abortion pills that was passed by the state's Republican-controlled legislature earlier this month.

Gordon, a Republican, signed the law as a federal judge in Texas considers ordering a nationwide ban on the abortion pill mifepristone in response to a lawsuit by anti-abortion groups.

The crux of the two-page Wyoming bill is a provision making it illegal to "prescribe, dispense, distribute, sell or use any drug for the purpose of procuring or performing an abortion."

An Idaho hospital has planned to stop delivering babies, with the medical center’s managers citing increasing criminalization of physicians and the inability to retain pediatricians as major reasons.

Bonner General Health, the only hospital in Sandpoint, Idaho, announced on Friday that it would no longer provide labor, delivery and a host of other obstetrical services.

The more than 9,000 residents of Sandpoint are now forced to drive 46 miles for the nearest labor and delivery care, the Idaho Statesman reported.

In a statement, the hospital’s leadership said that the decision to eliminate the obstetrics unit stemmed from the “political climate” in Idaho.

“Highly respected, talented physicians are leaving. Recruiting replacements will be extraordinarily difficult,” hospital officials said in a press release.

“We have made every effort to avoid eliminating these services,” the hospital’s board president, Ford Elsaesser, added in the statement.

“We hoped to be the exception, but our challenges are impossible to overcome now.”

The strictest abortion law in the US doesn’t allow exceptions for medical emergencies – and efforts to change it face powerful opposition from the right

Months after the implementation of the most stringent abortion ban in the country, conservative lawmakers in Tennessee have publicly acknowledged that the state’s ban poses grave risks to the lives of women.

Now a political debate over how to change the law is centered on questions that would have been considered unthinkable before last June’s reversal of Roe v Wade: like how close to death a woman must be before a doctor may legally treat her if it means terminating her pregnancy, and whether women should be forced to carry embryos with fatal anomalies to term.

Will Brewer, the powerful lobbyist of Tennessee Right to Life, a Christian anti-abortion group that wrote the current ban, has been accused of waging a campaign of intimidation against lawmakers who he has said are seeking to “weaken” the law. In public testimony and private meetings, Brewer has said women should only be offered terminations if they are facing acute emergencies – such as when they enter an emergency room “bleeding out” – and suggested some complications can “work themselves out” without medical intervention.

Speaking last week before the West Knoxville Republican Club, Brewer also questioned the veracity of medical diagnoses involving what is known as lethal fetal anomalies.

“Who’s to say with any kind of certainty what a medically futile pregnancy is or a fatal fetal anomaly, which is some condition with the baby that will not allow it to live outside of the womb?” he said.

The political debate is expected to come to a head this week, when two competing proposals – one of them endorsed by Brewer – will face votes in the state’s Republican-controlled legislature.

The fractious political fights shows how radically the battle lines over abortion have shifted since the US supreme court’s decision last June to reverse Roe v Wade, which in effect allowed every state to determine its own rules. In Tennessee, one of 13 states where abortion is currently banned, a “trigger law” came into effect that had been passed in 2019 in the event that Roe was ever overturned. The law states that any doctor who performs an abortion is committing a felony, and must defend themselves in court in order to prove the procedure was done to save the life of the pregnant patient.

In Tennessee, doctors who spoke with the Guardian on the condition of anonymity say anecdotal evidence suggests the state is already seeing an uptick in teenage births and that – since it has been about nine months since the trigger ban took effect – they are anticipating an increased number of babies being born who have life-threatening conditions that will immediately require treatment in neonatal units.

Ending a pregnancy in 14 states leaves few options. Some look to Europe and India for help
States with abortion bans struggle to stop mailed abortion pills from overseas


The pills came in a dark salmon-colored envelope sealed with a plastic covering that traveled more than 7,000 miles, over a dozen time zones from Nagpur, India, in almost exactly one week.

They were placed partially under the doormat of a home in a state with one of the most restrictive abortion bans in the United States, where zero clinics or pharmacies dispense the medication and the closest option for an in-person procedure is at least an hour to four hours away.

It is, advocates say, one of the only options left for those seeking abortions in one of the 14 states with criminal penalties for health care providers who perform the procedure.

The process of ordering the medication from Aid Access, a nonprofit organization founded by Dr. Rebecca Gomperts in 2018, is cobbled together in segments. From the organization’s headquarters in Austria, Gomperts acts as the prescribing gynecologist for the person ordering the pills on the Aid Access website. It’s one of the only services that allows people to order the medication as a “just in case” option, as the pills don’t expire for two years with proper storage.

Payment of $105 (about 98 euros) is made separately via PayPal, and once payment is complete, Gomperts sends her prescription to the pharmacy. There is also an option for financial assistance.

Mifepristone and misoprostol are used in combination to end a pregnancy, typically before 12 weeks of gestation, and the drugs are used to help manage early miscarriages. Mifepristone is taken first to stop the production of the progesterone hormone, which is needed to continue a pregnancy. Misoprostol is then taken to induce contractions in the uterus to expel the pregnancy.

Mifepristone was approved by the U.S. Food and Drug Administration in 2000, but it is under legal challenges in court. And legislatures across the country are attempting to restrict access to the drug. On Friday night, Wyoming’s governor signed into law a ban on medication-induced abortions.

A lawsuit challenging the FDA’s approval process for mifepristone is ongoing in Texas, where a federal judge could order the agency to revoke its approval after more than two decades. Other states are attempting to restrict access by threatening legal action against retail pharmacies and any other suppliers of the drug.

An email notification is sent when the package ships, with detailed instructions about how to take the medication, the potential risks involved, side effects and pain management and when to seek medical attention. The email also includes resources for hotlines with people available for emotional support or to provide answers to medical questions.

The package itself includes a box with one mifepristone pill and four misoprostol pills, and a separate package contains 12 misoprostol pills. The combination box is enough for pregnancies that are less than 12 weeks’ gestation, while the 12 pills are designed for pregnancies of more than 12 weeks.
By email, Gomperts told States Newsroom her organization is receiving more than 1,000 emails per day from individuals looking for help. Many of them also cannot afford the full price of the drugs. In February, Gomperts said 57% of those who paid for the drugs were able to pay less than 50 euros, or about $53.
