Only slightly o/t but Matthew Gertz (a guy on twitter who, sadly, gets a lot of incorrectly-directed anti-Gaetz sass) tweeted today that this wasn't going to go well for him (meaning Gertz).

I'm having a hard time seeing Gaetz as being truly in any kind of trouble. From what has been reported now he found out she was under age after his various kinds of "contact" with her, not before. I'm not seeing a mostly rwnj Florida jury finding any issue with that. Unless they can come up with any evidence he continued any sexual relations after he found out she was underage, I'm not really seeing big trouble for him. If he got scared and started to cover up (payments, bribes, etc) the fact that he had contact with her maybe that will amount to something, but honestly I can see a whole lot of people giving him a pass for that because who wouldn't start getting that "oh shit, maybe I better cover up that I ever had any contact with her" after the fact.

I can't stand the mofo, and I sure hope there is something there, mainly because as many of these trump humpers we can get rid of, the better. But I'm not holding my breath on this one to be honest.

It is my understanding that this is a federal investigation, and does not depend on state law. One possible charge is Section 2423 of Title 18, which makes it an offense to transport anyone under the age of 18 in interstate commerce with the purpose of engaging in a "commercial sex act." The term "commercial sex act" is defined as any sex act on account of which anything of value is given by or received by any person. 18 USC Section 2423(f)(2), incorporating the definition set out in 18 USC Section 1591. The statute provides that that the defendant's "reasonable belief" that the person had obtained the age of 18 is a defense, albeit one that "the defendant must establish by clear and convincing evidence." 18 USC Section 2423(g).

Not knowing she was 17 isn't good enough, and regardless of her age, paying to take her across state lines for sex is a charge that isn't any fun. Greenberg pleaded guilty to a charge with a minimum 12 year sentence, and generally plea deals try to get bigger as they go up, don't they?


Aside from the phone call where he worked to get his story straight with at least two people who have since testified about the call (can you say "Obstruction of Justice", I know that you could) and about 30 other things I'm sure they have heard about him from the half of the hookers in the Florida panhandle who have so far talked to the FBI. Matt is well and truly phucked. Count on it.
