Rep. Scott Perry (R-Pa.) has been fanning false claims for years, long before his efforts to overturn the 2020 election based on former president Donald Trump’s baseless allegations drew the attention of the House committee investigating the Jan. 6 attack on the Capitol.

In the fall of 2017, Perry claimed a former House aide to Rep. Debbie Wasserman Schultz (D-Fla.) orchestrated “massive” data transfers that amounted to a “substantial security threat,” according to Fox News. The Pakistani American staffer, Imran Awan, was later cleared of stealing government secrets by federal prosecutors.

Around the same time, Perry suggested then-CNN host Chris Cuomo was exaggerating the lack of water and electricity in hurricane-devastated Puerto Rico. “You’re simply just making this stuff up,” Perry said. Hurricane Maria was later tied to nearly 3,000 deaths.

In January 2018, Perry speculated about an Islamic State connection to the mass shooting in Las Vegas the previous year, contradicting law enforcement’s assertion that the accused gunman was working alone. “I smell a rat like a lot of Americans,” he said.

Perry’s incendiary remarks in recent years made bold headlines that quickly faded. Now, the five-term congressman and incoming chairman of the hard-right House Freedom Caucus has drawn the scrutiny of the bipartisan House panel probing the deadly insurrection by a pro-Trump mob.

On Tuesday, Perry rebuffed the committee’s request for communications and voluntary testimony, the first significant action the panel has taken to obtain information from a sitting member of Congress.
I think we're going to be hearing a lot more about him, none of it good. Also note that he will soon be the chairman of the Freedom Caucus. He could be very powerful if the republicons take back the House next year.

I remember this guy now, although I had forgotten about him as he has been pretty quiet recently. He is a nasty piece of work and should fit right in with the caucus.

Penn Live: FBI delivers subpoenas to several Pa. Republican lawmakers: sources say:
Federal investigators delivered subpoenas or paid visits to several House and Senate Republican offices in the Pennsylvania Capitol on Tuesday and Wednesday, according to multiple sources.

At least some of the individuals receiving subpoenas were told they were not targets of an investigation, according to at least six sources reached by PennLive, but that they may have information of interest to the FBI. All of the sources had been briefed on the investigative moves in some way, but demanded anonymity in order to discuss them.

The information being requested centered around U.S. Rep. Scott Perry, R-Pa., and the effort to seek alternate electors as part of former President Donald Trump’s efforts to remain in office after the 2020 election, several sources said.

The Washington Post on Wednesday, citing a source familiar with the probe, also reported that Perry’s cellphone was seized Tuesday as part of the Justice Department’s criminal investigation into the use of fake electors to try to overturn President Biden’s victory. The Post’s source also spoke on the condition of anonymity.

Rep. Scott Perry is suing to block the Justice Department from reviewing the contents of his cell phone, which was recently seized as part of an apparent investigation into the Pennsylvania Republican’s connections to former President Donald Trump’s effort to overturn the 2020 election.

FBI agents seized Perry’s phone on Aug. 9 and transported it to the custody of DOJ’s inspector general, which has helped lead the inquiry into the push by Trump and his allies to replace department leadership as part of a broader drive to keep Trump in power. Investigators have cited Perry as a key participant in that effort given his help connecting Trump with Jeffrey Clark, a DOJ official whom Trump viewed as an ally in his push.

But Perry indicated in his recent filing that DOJ has not yet accessed materials on his phone and is in the process of obtaining a second search warrant that would guide its review, including a process to screen out potentially privileged materials. Perry is objecting to that bid, demanding that the government be blocked from scouring his phone and that it return any data in its possession.


“[F]ederal agents should not be given carte blanche to root around in Rep. Perry’s phone data looking for evidence that they hope might further their investigation,” Perry’s attorneys John Rowley and John Irving wrote in the 16-page suit, which was filed last week in Washington D.C. federal court but not publicly docketed until late Tuesday.

The case has been assigned to Judge Jia Cobb, an appointee of President Joe Biden.

Perry indicated that after his phone was seized, he and his attorney conferred with DOJ about an alternative solution to litigation. One framework proposed by the department would permit Perry’s attorneys and its investigators to jointly review Perry’s phone and hash out potential privilege issues together. But, according to Perry, DOJ demanded that he waive his immunity under the Constitution’s speech and debate clause as part of the process, which Perry says he declined.

Perry contends that the data on his phone includes material protected by attorney-client privilege, marital privilege and the constitutional provision that limits most legal action against members of Congress related to their official duties.

A federal appeals court panel has put a secret hold on the Justice Department’s effort to access the phone of Rep. Scott Perry as part of a broader probe of efforts by Donald Trump and his allies to subvert the 2020 election.

In a sealed order issued earlier this month, the three-judge panel temporarily blocked a lower-court ruling that granted prosecutors access to Perry’s communications. The Dec. 28 ruling by U.S. District Court Judge Beryl Howell was the product of a secret, monthslong legal battle by prosecutors who have been fighting the Pennsylvania Republican’s attorneys on the matter since August.

The existence of the legal fight — a setback for DOJ reported here for the first time — is itself intended to be shielded from public scrutiny, part of the strict secrecy that governs ongoing grand jury matters. The long-running clash was described to POLITICO by two people familiar with the proceedings, who spoke candidly on the condition of anonymity.

The fight has intensified in recent weeks and drawn the House, newly led by Speaker Kevin McCarthy, into the fray. On Friday, the chamber moved to intervene in the back-and-forth over letting DOJ access the phone of Perry, the House Freedom Caucus chair, reflecting the case’s potential to result in precedent-setting rulings about the extent to which lawmakers can be shielded from scrutiny in criminal investigations.

We just learned that Judge Howell said it’s ridiculous for Scott Perry to claim speech or debate clause protection for communications he had with exec branch officials prodding them to interfere with the electoral vote count like a seditious king would. 👀

WASHINGTON – A federal appeals court returned a case Wednesday to U.S. District Court, to determine what access to grant Justice Department special counsel Jack Smith to the contents of Rep. Scott Perry’s cellphone, as part of the investigation into Donald Trump’s attempts to overturn the 2020 election.

Smith subpoenaed the phone because Perry, R-Pa., urged Trump to pursue false claims of election fraud and reject presidential electors for President Joe Biden from his state and others.

But Perry opposed the prosecution move by arguing his phone was an extension of his congressional office and therefore off limits to an executive branch investigation because of the Constitution’s speech and debate clause.

The three-judge panel of the D.C. Circuit Court of Appeals issued a 29-page sealed ruling in the case. A docket entry accompanying the decision said the panel unanimously sent the case back to U.S. District Judge Beryl Howell, "to apply the correct standard" as described in the opinion for Perry's communications with people in the executive branch or outside the federal government.

Both sides in the case were asked to file written arguments by Sept. 19 about whether to unseal documents in the case.

As Rep. Scott Perry was making clear he wanted to contest Donald Trump’s loss of the presidency in the 2020 election, his conversations with a Justice Department official took him inside the then-president’s management of the agency.

Perry’s text messages, revealed for the first time in court filings on Wednesday, included several communications in late December 2020 and early January 2021 with DOJ’s Jeffrey Clark, a Trump appointee sympathetic to contesting the election, as Trump considered installing Clark as attorney general.

Perry texted Clark, “POTUS seems very happy with your response. I read it just as you dictated,” according to court records.

Then, Clark responded: “I’m praying. This makes me quite nervous. And wonder if I’m worthy or ready.”

“You are the man. I have confirmed it,” Perry wrote back, late at night on December 30, 2020. “God does what he does for a reason.”

The messages represent the never-before-seen extent to which Perry and Clark discussed Clark’s ascendance in Trump’s sphere as the then-president sought ways to hold onto his elected office. The tenor of Perry’s messages and his connection to Clark was generally known before, but court records posted publicly for a brief time on Wednesday and captured by news organizations provide a new level of detail on what Perry was saying to others about contesting Trump’s loss of the presidency.

Though I am an atheist and cannot wrap my head around nine-tenths of the monotheistic dogmas and entry exams (TM), I have a lot of friends who belong to various religions; I respect them like hell for their compassion and philosophical complexity.

This amounts to 1,650 emails and texts, out of a total of 2,055 that Judge Howell had earlier ordered Perry to disclose, a decision which was temporarily stopped by the court of appeals.

Chief Judge Beryl Howell of the federal district court in Washington, D.C., ruled against Rep. Scott Perry's attempt to shield over 2,000 messages that are relevant to the Justice Department's investigation into efforts to subvert the 2020 election.

This ruling came to light through newly unsealed court filings. Rep. Perry, a Republican from Pennsylvania, had sought to block the Justice Department from accessing 2,219 documents stored on his phone, which was seized by the FBI as part of the investigation into the 2020 election.

Perry claimed these records were part of his legislative decision-making process and should be protected under the Constitution's speech or debate clause. However, Judge Howell rejected this view, stating that it would effectively place members of Congress above the law.

She ordered the disclosure of 2,055 of the documents Perry sought to withhold, including all 960 of his contacts with executive branch members, which she stated are not constitutionally protected.

Some 161 items were deemed proper to withhold.

The investigation has closely scrutinized Perry's contacts with then-President Donald Trump and Jeff Clark, a top Justice Department aide whom Perry pushed Trump to install as attorney general.

Despite the appeals court temporarily staying Howell's ruling, the stay remains in place as the appeals court considers whether to leave Howell’s ruling in place, set it aside, or modify it.

Judge Howell's ruling was initially sealed, and media outlets have sued to make it public.

The ruling was posted on a public court docket and then sealed again, indicating that its disclosure might have been inadvertent.

The ruling ordered the release of over 2,000 text messages between Perry and others, detailing his efforts to assist Trump in overturning the election.

Howell's ruling challenged Perry’s assertion that his communications should be protected under the Constitution’s “speech and debate clause,” noting that his activities went beyond merely gathering information.

An activist has filed a petition to knock Scott Perry off the Pennsylvania primary election ballot for his role in trying to decertify the 2020 election results.

Gene Stilp, who ran for the state House of Representatives in 2014, filed the lawsuit in the Commonwealth Court saying that Perry’s connection to the Jan. 6 insurrection is enough to bar him from running for office under the Fourteenth Amendment.
