Rudy Giuliani appealed a jury’s verdict ordering him to pay $148 million to two Georgia election workers for defaming them following the 2020 election.

Giuliani filed for bankruptcy days after the verdict was handed down in December, freezing the election workers’ case and their efforts to collect the staggering sum from the former New York City mayor, who once represented former President Trump as his personal attorney.

Hours after his bankruptcy judge unfroze the defamation case and enabled Giuliani’s attorney to continue representing him, he formally filed his notice of appeal late Tuesday.

“We very much appreciate the judge’s expeditious consideration of this matter and look forward to proceeding accordingly,” Ted Goodman, political adviser to Giuliani, said in a statement earlier in the day after the bankruptcy judge’s ruling.

A jury comprising eight Washington, D.C., residents ordered Giuliani to pay $148 million to the two election workers, Ruby Freeman and Shaye Moss, after making them a focal point of the Trump campaign’s baseless claims of mass voter fraud in the 2020 presidential election.

In a bankruptcy court filing on Friday, February 16, a law firm representing unsecured creditors for former New York City Mayor Rudy Giuliani demanded information about his donors. Giuliani recently filed for bankruptcy after being ordered to pay $148 million in damages to former Georgia election workers Ruby Freeman and Shaye Moss, who sued him for bankruptcy.

But Giuliani's financial problems could become even worse, as he is also facing a lawsuit from former employee Noelle Dunphy (who accused him of rape and is seeking $10 million in damages for allegations that include sexual assault, wage theft and harassment). And Giuliani is still a co-defendant in Fulton County, Georgia District Attorney's election interference/RICO case against former President Donald Trump.

According to Bloomberg Law reporters Evan Ochsner and Randi Love, "Rudolph Giuliani's creditors, as well as the judge overseeing his bankruptcy, are demanding details about who is paying his legal fees…. Gary C. Fischoff of Berger Fischoff Shumer Wexler & Goodman LLP, one of Giuliani's bankruptcy lawyers, said during a court hearing Friday that Giuliani hadn't contributed to the fund."

Oschsner and Love add, "But Judge Sean H. Lane of the U.S. Bankruptcy Court for the Southern District of New York pushed for a definitive answer, in writing…. Philip C. Dublin of Akin Gump Strauss Hauer & Feld, representing a committee of Giuliani's unsecured creditors, said Friday that the committee wants an itemized account of where the money came from, how it's managed, and how it's disbursed."

Rudy Giuliani’s bankruptcy filing, spurred by a multimillion-dollar verdict against him for defaming two Georgia election workers, has provided fresh insight into the former New York City mayor’s finances.

A federal jury in Washington, D.C., in December ordered Giuliani to pay Ruby Freeman and Shaye Moss a whopping $148 million for baselessly claiming they engaged in widespread voter fraud after the 2020 election. Days later, he filed for bankruptcy, acknowledging the severe strain the penalty put on his finances.

His bankruptcy judge late Tuesday allowed the longtime ally of former President Trump to appeal the defamation verdict, but in the meantime, his bankruptcy proceeding has cracked Giuliani’s finances wide open, shedding light on his debts and overall standing.

That standing includes thousands of dollars in taxes and credit card debt and millions more he could owe to voting technology companies Dominion Voting Systems and Smartmatic if he’s found to have defamed them, too.

Here’s what we’ve learned about Giuliani’s finances amid his bankruptcy.

A who’s who of creditors
In addition to Freeman and Moss, the creditors with the largest unsecured claims against Giuliani include banks, lawyers, government tax agencies, golf clubs and other entities.

Giuliani owes more than $900,000 in taxes, most of which are federal taxes.

Between two golf clubs in West Palm Beach, Fla. — including the former president’s Trump International Golf Club — Giuliani owes nearly $40,000 in unpaid membership fees, though he disputes a large chunk of that amount.

He could also owe millions of dollars in unresolved lawsuits, court filings show.

A New York man, Daniel Gill, sued Giuliani for $2 million after he was charged with assault for slapping the ex-mayor on the back and asking, “What’s up, scumbag?” The law firm Davidoff, Hutcher & Citron, lodged by Giuliani’s longtime lawyer Robert Costello in September over unpaid legal fees, is claiming $1.36 million. And the law firm Aidala, Bertuna & Kamins, which Giuliani hired after his apartment was raided by the FBI, is seeking more than $387,000.

Rudolph Giuliani’s homes in New York and Florida may be put up for sale to help bring in cash as he works through his bankruptcy, attorneys say.

The former New York mayor is facing nearly $153 million in debt, the bulk of which stems from a $148 million defamation judgment awarded to two Georgia poll workers he accused of rigging 2020 election results. Giuliani has reported having $10.6 million in assets.

A proposed listing agreement for Giuliani’s New York condominium is being fine-tuned, Heath Berger of Berger Fischoff Shumer Wexler & Goodman LLP said Wednesday during a status conference in the US Bankruptcy Court for the Southern District of New York. Giuliani’s Manhattan condo is valued at around $5.6 million, according to recent financial disclosures.

A committee representing Giuliani’s unsecured creditors, including the poll workers, is working to get his Palm Beach, Fla., house on the market as well. The home is valued at $3.5 million, according to court papers. The committee is in talks with Giuliani about the Florida property, Philip Dublin of Akin Gump Strauss Hauer & Feld LLP said in court Wednesday.

Dublin said the Florida home isn’t subject to the state’s homestead exemption that protects a debtor from being forced to sell a home in bankruptcy, but didn’t provide further explanation. He didn’t immediately respond to a request for comment Wednesday.

“If we are unable to convince the debtor to list that property, then we will come to the court on that issue,” Dublin said.

Guiliani filed for Chapter 11 in December following the defamation judgment. Giuliani said in February that Donald Trump’s 2020 election campaign and the Republican National Committee owe him about $2 million in legal fees. The unsecured creditors’ committee recently asked the bankruptcy court to allow it to probe Giuliani’s financial affairs—which could lead to his estate filing a bankruptcy lawsuit over the unpaid legal fees from Trump.

The committee will “continue to conduct our analysis of the debtor’s finances on an informal basis,” as it waits for a bankruptcy judge’s decision on the request for a probe, Dublin said Wednesday.

The case is In re: Rudolph W. Giuliani, Bankr. S.D.N.Y., No. 23-bk-12055, hearing 3/13/24.

LOL at no homestead exemption for the FL home.

I'm curious about who the other unsecured creditors are (besides the GA poll workers). I assume the two real properties have debt, so those secured creditors are probably first in line for proceeds from the sale of those houses.

It would be great if the court could also attach any income he's earning and make a plan for that to be paid to the unsecured creditors, esp Shaye and Ruby.

Maybe not. He has been claiming for many months that he has no cash to pay his bills. If he had defaulted on mortgages for those properties, wouldn't we have heard by now that the creditors were foreclosing?

:fingerwag: Giuliani seems to have forgotten Deadbeat Rule 1, which is to (a) buy an enormous house in Florida, and (b) establish a Florida domicile.

The bigger the house the better, as long as the size of the grounds doesn't exceed half an acre if the property is in town, 160 acres if it's in the country.

The house and grounds are exempt from creditor claims in bankruptcy. :brickwallsmall:

Here's the meat:
On several occasions, the Debtor has emphasized his limited assets available for
distribution to creditors—according to the Debtor’s counsel, “there’s no pot of gold at the end of
the rainbow.”

Of this purported limited pool of assets disclosed by the Debtor, the Florida
Condo is a key asset, and the proceeds thereof will be available to satisfy the claims of his
creditors. Critically, the Debtor—a New York domiciliary who has elected New York State
exemptions
—has not and cannot claim a homestead exemption with respect to the Florida
Condo. Since it is a nonexempt asset, the Debtor cannot retain the Florida Condo, and he has no
credible argument that he is entitled to live there following the conclusion of his chapter 11 case.
Any proposal by the Debtor to both claim a New York State homestead exemption for the NYC
Apartment and retain his nonexempt multimillion-dollar Florida Condo cannot withstand legal
scrutiny.
2. Despite having no legal basis under the Bankruptcy Code for retaining the Florida
Condo, the Debtor has made no effort to monetize this nonexempt property of the estate.
Moreover, according to his limited financial disclosures in the chapter 11 case, the Debtor incurs
tens of thousands of dollars of maintenance fees for the Florida Condo every month
. Concerned
by this drain on estate resources, the Committee, through its counsel, repeatedly has asked the
Debtor’s counsel what the Debtor’s plan is for the Florida Condo. To date, these entreaties have
been fruitless, and the Debtor has exhibited no motivation to list, market or otherwise take steps
to sell the Florida Condo, the proceeds of which necessarily must be distributed to his creditors.
3. To make matters worse, and given that the Florida Condo and NYC Apartment are
the Debtor’s most valuable reported assets in his Schedules (as defined below), the Committee is
troubled by the Debtor’s recklessness in not maintaining any homeowners insurance for the
Florida Condo or the NYC Apartment
. The Debtor has chosen to avail himself of the protections
of the Bankruptcy Code to obtain a breathing spell from his creditors, but in return he must
exercise due care in protecting his assets and avoiding loss, since these are the assets that he, as a
debtor in possession, is holding in trust for his creditors.
4. Accordingly, the Committee respectfully requests that this Court compel the
Debtor to take all necessary steps to sell the Florida Condo and obtain homeowners insurance in
order to preserve and protect estate resources and abide by his duty to maximize the value of the

I interviewed with Giuliani, when he was a junior partner at a white shoe firm, before he became a United States Attorney. He seemed smart, energetic, and quite cordial. He was the protege of former Judge Harold Tyler, and pretty intense, but he didn't seem any more psychotic than is typical for a young litigation partner.

The firm made me an offer, but I didn't accept it.
