As if Dodger fans didn't have enough to nauseate them during Saturday's playoff game against the San Diego Padres, the telecast featured an openly racist commercial blaming President Biden and other Democrats for illegal immigration.

Airing during the mid-fourth inning break of the game that eliminated the Dodgers from the post-season, the ad consisted of video images depicting a torrent of obviously Latino immigrants pouring over the border.

"This giant flood of illegal immigration is draining your paychecks, wrecking your schools, ruining your hospitals, threatening your family," stated the overwrought narrator, over the obligatory ominous soundtrack. "Mixed among the masses are drug dealers, sex traffickers and violent predators."

Vote to keep our borders, jails and bathrooms open. Vote progressive

Who's behind this commercial? The ad identifies its sponsor only as "Citizens for Sanity," but that last line should give you a further clue: It's an organization of several former Trump aides who spearheaded his administration's attacks on immigrants.

The ad's characterization of immigrants as criminals almost exactly echoes Trump's line during his announcement of his presidential campaign in 2015 about Mexican immigrants: "They’re bringing drugs. They’re bringing crime. They’re rapists."

The leaders of Citizens for Sanity are associated with the America First Legal Foundation, which was founded by Stephen Miller, its president.

I agree. This was not the best judgment for someone running for office but at least he is showing an interest in adults and not underage people.

Also note that the "crime wave" took place in 2020 - when Trump was still president. The FBIs best estimate is that crime was flat in 2021.

I wasn't sure where else to put this. It's a fascinating article by Barton Gellman called "The Impeachment of Joe Biden" and looks at why he believes it's inevitable that Republicans will Impeach him once/if they take the House.

Sometime next year, after an interval of performative investigations, Republicans in the House are going to impeach Joe Biden. This may not be their present plan, but they will work themselves up to it by degrees. The pressure from the MAGA base will build. A triggering event will burst all restraints. Eventually, Republicans will leave themselves little choice.

This prediction rests, of course, on the assumption that Republicans will win control of the House next month, which appears likely: Democrats would need to win an improbable number of toss-up races to keep their majority. And an impeachment resolution requires just a simple majority to pass the House.

Nothing in the public record offers the slightest reason to believe that the Senate, even if it is under Republican control, would convict and remove Biden from office. Still, House Republicans will come to see plenty of advantages in impeaching Biden—and, possibly, several other top administration officials.

Already, there is enormous demand for impeachment. A University of Massachusetts Amherst poll in May found that 68 percent of Republican voters think the House should impeach Biden. A majority expect that it will impeach him. Thwarting those expectations would be dangerous for any House Republican.

Gov. Laura Kelly told reporters in June that an RGA ethics complaint was a "nothingburger." On Tuesday, with a week to go until Election Day, the Shawnee County Sheriff's Office declined to criminally investigate after an RGA referral.

The sheriff in the state's capital city declined a week before Election Day to pursue a criminal investigation of the incumbent governor previously called for by a Republican political action committee.

The Republican Governors Association Kansas 2022 PAC had requested that Shawnee County Sheriff Brian Hill, a Republican, investigate Democratic Gov. Laura Kelly's administration and re-election campaign.

"After a preliminary review of this matter, it has been determined that no criminal investigation will occur at this time," Deputy Abigail Christian, the Shawnee County Sheriff's Office spokesperson, said in a Tuesday email. "However, should additional information come to light, the matter will be re-examined by our Criminal Investigations Division."

Former Congressman Jeff Fortenberry appeals conviction

OMAHA, Neb. (WOWT) - Former Congressman Jeff Fortenberry has appealed his conviction following what his legal team says was an “unprecedented prosecution.”

Fortenberry was convicted earlier this year and sentenced to probation for lying to the FBI. An earlier appeal was filed the day after his conviction.

The former Congressman filed an appeal Friday evening with the U.S. Court of Appeals for the Ninth Circuit following an “unprecedented prosecution in which the Department of Justice hauled a sitting member of Congress across the country to stand trial in a foreign jurisdiction on charges of making false statements more than a thousand miles away.”

“The case against Jeff Fortenberry never should have been brought in the first place, and certainly never should have resulted in charges in California or a conviction,” said Glen Summers, a leading member of Fortenberry’s legal team and a partner with Bartlit Beck LLP.

The appeal claims the conviction should be overturned for having an improper venue and inadequate jury instructions.

Fortenberry’s appeal says the venue was improper because his alleged false statements were made in Nebraska and Washington, D.C., but the charges were filed in California.

The appeal also says inadequate jury instructions existed as they “failed to appropriately define a key element of the charge – the materiality of Fortenberry’s statements.”

“For a statement to be material to an investigation – and thus eligible for a false statements charge – the law requires it to be capable of influencing a particular governmental decision,” Fortenberry’s legal team said in a press release. “Fortenberry’s statements were not material to the government’s investigation because prosecutors already knew from their own investigation, before interviewing Fortenberry, that he had no knowledge of the illegal contributions to his campaign.”

Donald Trump’s push to overturn his 2020 loss was roundly rejected by courts. Now dozens of lawyers who argued the cases are working for Republican campaigns and groups.

At least three dozen lawyers and law firms that advanced Donald J. Trump’s failed attempt to overturn the 2020 election are now working for Republican candidates, parties and other groups, filing lawsuits and other complaints that could lay the groundwork for challenging the results of midterm elections, according to a New York Times analysis of campaign finance records and legal filings.

Though the 2020 legal push failed, with just one victory out of more than 60 lawsuits, scores of lawyers behind it have continued to work on election litigation.

Election lawyers and administrators say they fear 2020 may have ushered in a sea change in election law. Previously, campaigns and parties challenged election rules before Election Day and, typically, accepted a court’s ruling and the results of the vote. But after many of Mr. Trump’s pre-election lawsuits failed and he lost the election, his allies returned to similar legal arguments — now citing falsehoods, rumors and exaggerations as evidence — to claim that all votes were fraudulent.

With less than a week to go before Election Day, the 2022 midterms have had an avalanche of litigation. More than 115 cases have been filed this year, with a roughly even split between groups aligned with Republicans and Democrats, according to Democracy Docket, a left-leaning website that tracks election litigation. At this point in 2020, fewer than 70 lawsuits had been filed.

As in 2020, much of this litigation has focused on absentee ballots, including disputes over how election officials count ballots that are incomplete, contain errors or arrive late. Many of these cases are unlikely to be resolved before Election Day on Nov. 8.
