Court tosses Jan. 6 sentence in ruling that could impact other low-level Capitol riot cases

A federal appeals court on Friday ordered a new sentence for a North Carolina man who pleaded guilty to a petty offense in the Capitol riot — a ruling that could impact dozens of low-level cases in the massive Jan. 6, 2021 prosecution.

The appeals court in Washington said James Little was wrongly sentenced for his conviction on a misdemeanor offense to both prison time and probation, which is court-ordered monitoring of defendants who are not behind bars.

Little, who entered the Capitol but didn't join in any destruction or violence, pleaded guilty in 2021 to a charge that carries up to six months behind bars. He was sentenced last year to 60 days in prison followed by three years of probation.

Simple
You can't be sentenced to a greater sentence (generally).

Since they likely have served their time, probation will end. But a fair amount of it has been served anyway.

Many states have laws that permit this kind of sentence, i.e., "probation is granted on the condition the defendant first serves 60 days in jail."

I think I read in one story that this adds the 5 months on before he begins serving any time for the things he is convicted of.

So much for maybe time served...

News 9 has learned that a top Trump New Hampshire campaign official was present at the U.S. Capitol on Jan. 6th, 2021.

Tweets obtained from the suspended account of Trump's New Hampshire deputy state director show him claiming to have been tear-gassed while peacefully protesting that day.


Dylan Quattrucci is the deputy state director of Donald Trump's New Hampshire campaign.

The posts News 9 obtained are no longer publicly available, but there are some archived tweets that show @realDylanQuatt was active with posts and photos featuring Quattrucci until the account was suspended in January 2021.

Capitol riot defendant Brandon Fellows alarmed jurors hearing his case with outbursts about what he called "a kangaroo court" and a "Nazi court" after he was found in contempt of court Thursday.

Some of the jurors in the case wrote a note to Judge Trevor McFadden, a 2017 appointee to the D.C. court, to ask about any risk that Fellows could obtain their personal information, including their home addresses.

"1 question," they wrote. "We wanted to confirm that the defendent [sic] does not have any personal information on individual jurors, since he was defending himself. Includes home address, etc."

Judge McFadden had a brief response for the jurors. "Both parties are given limited biographical information on prospective jurors at the outset of the trial," he wrote. "The court collects those sheets from the parties at the conclusion of the trial."

I have always believed that Sund is a Trump Humper and that he took deliberate steps to make sure the Capitol Police were not able to effectively prevent the insurrection.

Absolutely. Believed that from get go. He should be saying vehemently how horrific these crimes were. He doesn’t. Would like a deep investigation into him.
