Graham's motion argues Speech & Debate Clause and legislative immunity.

Graham unsurprisingly argues that his calling Georgia was legitimate legislative activity relating to the Senate Judiciary Committee and certification of the electoral vote.

Graham claims he was just investigating and not attempting to influence. His evidence?: 'Cuz he said so.

Imma hafta review the transcript of the call, if available, but were I a court, I think I would be reticent to wade into what is legitimate legislative activity relating to the Senate Judiciary Committee and what isn't. :twocents: As much as I want to see Graham eat it.

  • The Federal Election Commission issued a warning to a Trump-connected political action committee.
    The FEC said the Make America Great Again PAC made several mistakes in its most recent April quarterly report.
    Trump's campaign and political committees have faced numerous accusations of mistakes and wrongdoing.

A political action committee connected to former President Donald Trump is under increased scrutiny from federal officials because of apparent discrepancies in its financial disclosures.

According to a July 6 letter the Federal Election Commission sent the committee, Trump's Make America Great Again PAC made several mistakes in its first-quarter 2022 financial report, including discrepancies in its reported cash on hand in addition to calculation errors.

The Make America Great Again PAC, which until early 2021 operated as Trump's 2020 presidential-campaign committee, has until August 10, 2022, to respond to the FEC's letter and will not receive an extension. If the PAC fails to respond in time, the FEC said this could lead to an audit or "enforcement action."

As of March 31, the Make America Great Again PAC reported having about $5.5 million in available cash. It's one of several political committees within the post-presidency political operation of Trump, who continues to mull a run for president again in 2024.

And that's basically Graham's point: "legitimate legislative activity" is broadly interpreted.

I could see a judge doing some petard hoisting: How is the judge to know if Graham was engaging in legitimate legislative activity or illegitimate election influencing? Maybe the judge will issue Graham a special, legally binding invitation, to tell his version of the story to a federal judge, all in an effort to avoid a special, legally binding invitation from a state grand jury.

But the more likely result is the judge reviewing the available evidence and quashing the subpoena.

Well, they feel completely different when its a Democrat exercising legitimate legislative activity, they say that's why they don't have to answer those subpoena's because legitimate legislative activity doesn't include anything but actually passing laws.

Funny how that works, ain't it?

Graham's motion has a brief shoutout:

Although SCOTUS agreed requesting tax returns was a legitimate legislative purpose, requesting the president's had separation-of-powers concerns.

Graham will likely me-too that with "federalism concerns."

The FEC is broken. 3Rs and 3Ds, and it takes 4 commissioners to do anything. I don't expect it occurred to the creators of the commission that half the commission would turn a blind eye to any wrongdoing by their own party.
