DC chief judge Beryl Howell blisters requests for community service by some Jan 6 defendants:

"I don't feel like I need to impose on the community somebody who has demonstrated significant anger, the kind of rhetoric that believes in conspiracy theories"
Edit:
Judge Howell sentences Simon to 8 months prison. Slightly less than Justice Dept recommended

Holy Crap!!!! I know people were predicting this shit but I thought Shirley it was hyperbole.

Guess not.

Helluva way to commit suicide by cop, even if he did shoot himself. He knew he wasn't walking away from that.

So much for supporting the Blue.

The GQP needs to adopt the thin blue line flag, but change it to the thick red dripping line.

US Justice Department sets sights on Capitol rioters who tried to profit from their involvement

Rioters who charged the US Capitol have sought book deals, released riot-themed rap songs and sold branded T-shirts.

Key points:
Some Capital rioters have tried to profit from the January 6, 2021 insurrection
Defendants face jail time, fines and steep legal bills
Prosecutors are citing these activities to push for harsher sentences

Faced with jail time and hefty legal bills, some defendants have used their participation in the January 6, 2021 insurrection to drum up cash or boost their business.

He chose a bench trial because he lucked out and got the judge that is jealous that he missed out on all the fun of rioting in the Capitol. He has handed out 0 jail sentences so far.

Ok. Correction. He got ONE of the pro-rioter judges.

Judge sentences Fracker, a star witness in prior Capitol riot trial, to one year probation with 59 days home confinement in Virginia.

(Defense asked judge to keep confinement term under 60 days to avoid disruption in military disability benefits for Fracker)
I believe Fracker cooperated and testified IIRC.

Court unseals Capitol breach case against Antonio Lamotta. Justice Dept says a DC police body cam reveals a recognizable image of Lamotta's face amid the Jan 6 mob

**Lamotta had been arrested in Philadelphia two days after 2020 election for carrying firearm**, per investigators

A Gateway Pundit author harassed the witness on his way out of the courthouse. You’ll probably see an ALL CAPS video about how he REFUSED to ANSWER her QUESTIONS.

Are we looking to top Klayman in assigning automatic bias to Trump appointees? Makes us no better than the right.

There is a judge that has a record of allowing these rioters to go with hardly a slap on the wrist. Including some of whom wrote startling things in their social media prior to Jan 6. It's well known among the rioters that if you land that judge, then ask for a bench trial instead of a jury trial because that judge so far has been extremely lenient toward the rioters. The original comment is referring to one of the guys that got lucky enough to land this particular judge, and I was simply explaining that this is likely the reason he chose a bench trial rather than a jury trial. Because that judge has been extremely lenient in sentencing, even for people who are clearly a danger to society.

Amid a bunch of Jan. 6 activity at the D.C. federal courthouse, there was a massive police and fire response this afternoon to a report of white powder, a Fire and EMS spokesperson tells
@lizbrownkaiser
.

An alarm went off in the building.

NEW: The first four defendants in the 9-person tunnel assault case have waived their right to a jury trial and will now instead begin a bench trial before Judge McFadden on Aug. 29. They each face between 5-11 charges apiece, ranging from assaulting police w/ weapon to robbery.

Kyle Fitzsimons trial Day 1 has wrapped. DOJ says they expect to wrap tomorrow with four more witnesses, including two officers he's alleged to have assaulted. One is USCP Sgt. Aquilino Gonell. Defense expected to spend a lot of time on him in cross-examination.
:?: For these quick, one defendant two day bench trials, is it worth starting an individual thread for each trial, or just keep it here in the main thread?

No. These are judges who have demonstrated bias. The assumption was not automatic. It was based on the consistency of their actions.

Defense is now cross-examining Sgt Gonell. Asking about his social media usage and asking if "he's mad" about how Jan 6 cases have been handled so far.

Gonell: "People need to learn that what happened on January 6 was horrendous"

Inside the D.C. courthouse today, a man who was shooting video for a Gateway Pundit blogger told Capitol Police Sgt. Aquilino Gonell that he should be ashamed of himself. Then he confronted Gonell and his lawyer in an elevator and outside the courthouse.
A bit more at the link/thread, but :torches:

On the idea that an attorney shouldn't ask a question they don't know the answer to, this seems an unwise inquiry. Or does that apply only to prosecutors?
