The congressional panel investigating the January 6 attack on the US Capitol has published its final report, accusing Donald Trump of a “multi-part conspiracy” to thwart the will of the people and subvert democracy.

Divided into eight chapters, the 845-page report includes findings, interview transcripts and legislative recommendations and represents one of the most damning official portraits of a president in American history.

That's what I was wondering, since I didn't think you'd invoke the 5th just to avoid being exposed as a run-of-the-mill liar. (Like we don't already know.)

10. Knowing that a violent attack on the Capitol was under way and knowing that his words would incite further violence, Trump purposely sent a social media message publicly condemning vice-president Pence at 2.24pm on January 6.

11. Knowing that violence was underway at the Capitol, and despite his duty to ensure that the laws are faithfully executed, Trump refused repeated requests over a multiple-hour period that he instruct his violent supporters to disperse and leave the Capitol, and instead watched the violent attack unfold on television. This failure to act perpetuated the violence at the Capitol and obstructed Congress’s proceeding to count electoral votes.

17. Trump had authority and responsibility to direct deployment of the National Guard in the District of Columbia, but never gave any order to deploy the National Guard on January 6 or on any other day. Nor did he instruct any federal law enforcement agency to assist. Because the authority to deploy the National Guard had been delegated to the Department of Defense, the secretary of defense could, and ultimately did, deploy the Guard. Although evidence identifies a likely miscommunication between members of the civilian leadership in the Department of Defense impacting the timing of deployment, the committee has found no evidence that the Department of Defense intentionally delayed deployment of the National Guard. The Select Committee recognizes that some at the department had genuine concerns, counselling caution, that Trump might give an illegal order to use the military in support of his efforts to overturn the election.

Legal Eagle's explainer:

The part I found interesting was about the referral under 18 U.S.C. sec. 1001, aka lying to the feds. And, in this instance: the fake electors.

Executive summary: Stone suggests the actual fake electors were just useful idiots, and quite possibly didn't have the necessary criminal intent. This presumes their defense would be along the lines of that they sincerely believed their "alternative slates" would be used only if the duly authorized slates were tossed.

This requires the leap of faith that, had courts tossed the original slates, states' executives would have certified them. But the rub in a criminal case would be in proving the electors didn't believe that. In other words, plenty of room for one juror to doubt reasonably.

Stone, on the other hand, says the committee showed the higher-ups (i.e., Eastman and his elk) knew the fake slates were worthless but nonetheless hoped Pence would bite on them as a fig leaf to toss some states' electoral votes.

LAS VEGAS (AP) — New transcripts of closed-door testimony to the Jan. 6 House committee show Donald Trump and his allies had a direct hand in the Nevada Republican Party’s scheme to send a phony electoral certificate to Congress in 2020 in a last-ditch attempt to keep the former president in power.

The documents made public Wednesday evening included interviews with state party leader Michael McDonald and Republican National Committeeman Jim DeGraffenreid in February. Both men served as fake electors in Carson City on Dec. 14, 2020.

That day, six Nevada GOP members signed certificates falsely stating that Trump won Nevada in 2020 and sent them to Congress and the National Archives, where they were ultimately ignored. The House committee investigating the Jan. 6 attack on the Capitol is digging into the role that these fake electors in key battleground states had in Trump’s attempt to cling to power after his 2020 defeat.

McDonald and DeGraffenreid invoked Fifth Amendment protection hundreds of times in their separate interviews with the Jan. 6 committee, refusing to answer questions about their involvement and the extent to which Trump’s top allies had helped in orchestrating the plot.

Still, the transcripts provide an unprecedented view into the Trump team’s coordinated efforts in Nevada to overturn the results of the election — efforts that included direct communication between McDonald and the president himself.

On Nov. 4, 2020, for example, the day after the election, McDonald had a conference call with Trump, his then-chief of staff Mark Meadows, attorney Rudy Giuliani and son Eric Trump.

Former Trump White House aide told Jan. 6 panel Mark Meadows burned documents a dozen times during the transition period

Washington (CNN) — The January 6 committee released another batch of transcripts Tuesday, including two more of its interviews with blockbuster witness Cassidy Hutchinson and testimony from several other Trump White House officials.

The transcripts shed new light on how then-White House chief of staff Mark Meadows regularly burned documents during the transition period, according to Hutchinson. She also described how Meadows occasionally told staffers to keep some Oval Office meetings “close hold” and potentially omitted from official records.

There were also additional details about Hutchinson’s dueling loyalties that led her to ultimately switch lawyers and provide damning testimony about what she saw and heard at the White House after the 2020 election.

The latest cache of transcripts also revealed some of the rumors, gossip and wild conspiracies that were floating around the White House – including conversations about QAnon conspiracies – while then-President Donald Trump refused to concede and tried to overturn the election results.

Meadows told White House staffers to keep some Oval Office meetings “close hold” during the transition period, potentially leaving meetings off the books, according to Hutchinson, who was a top Meadows aide.

Hutchinson also testified that there “were certain things that had potentially been left off” the Oval Office diary.

Hutchinson said she recalled Meadows having a meeting at the end of November or early December 2020 in which he told outer Oval Office staffers: “Let’s keep some meetings close hold. We will talk about what that means, but for now we will keep things real tight and private so things don’t start to leak out.”

The text was regarding a voicemail apparently meant for GOP Sen. Tommy Tuberville as part of Giuliani’s attempt to sway Republican Senators into blocking the Electoral College votes.

Utah Sen. Mike Lee (R) texted an aide to former President Donald Trump the evening of the 2021 Capitol attack to disparage Rudy Giuliani after the former New York City mayor sent Lee a voicemail message by mistake.

“You’ve got to listen to that message. Rudy is walking malpractice,” Lee texted national security adviser Robert O’Brien on the evening of Jan. 6, according to an 845-page final report from the House Jan. 6 committee on Thursday. The report details the many ways Trump and his associates planned to disrupt the electoral process.

Lee, who helped Trump push schemes to overturn the election, received a voicemail from Giuliani just before 11 p.m. on the day that left several people dead and 140 law enforcement officers injured. The voicemail was apparently meant for GOP Sen. Tommy Tuberville as part of Giuliani’s attempt to sway Republican Senators into blocking the Electoral College votes.

“You can’t make this up,” Lee texted O’Brien. “I just got this voice message [from] Rudy Giuliani, who apparently thought he was calling Senator Tuberville.”

Lee then texted that Giuliani was “walking malpractice.”
