John Eastman Asks Federal Judge to Reconsider Crime-Fraud Findings on Trump’s Knowledge About ‘Wrong’ Voter Fraud Claims

Former President Donald Trump’s election lawyer John Eastman is asking a California federal judge to reconsider his ruling that Trump knowingly filed false numbers regarding voter fraud, submitting a sealed email record that he says “clearly shows that the President’s lawyers took great care to ensure all court filings were accurate.”

In a 10-page motion filed Thursday, Eastman’s lawyer Charles Burnham asks U.S. District Judge David O. Carter to reconsider his Oct. 19 order that the crime-fraud exception applies to several privileged emails because Trump knew numbers regarding voters fraud “were wrong but continued to tout those numbers, both in court and in the public.” Carter also concluded that some emails “make clear that President Trump filed certain lawsuits not to obtain legal relief, but to disrupt or delay the January 6 congressional proceedings through the courts,” which Burnham’s filing said is not true.

“Dr. Eastman submits that the full email record demonstrates that the legal filings were all designed to obtain a ruling from the court on the contested election challenges,” according to the motion.

Burnham filed a sealed affidavit identifying documents Carter has already reviewed “explain the true import of the email record surrounding the Presidential certification submitted” in Trump’s federal lawsuit in Georgia. He said the affidavit and referenced documents “clearly show that no false information was knowingly submitted by the President or his attorneys, and that the complaint was not filed for an improper purpose.”

January 6 committee obtains eight emails showing possible planning of post-election crime
The House select committee investigating the January 6, 2021, attack on the US Capitol has obtained eight emails from late 2020 that a judge determined show Donald Trump and his lawyers planning to defraud courts and obstruct the congressional vote on the presidency.

A new court filing from Trump’s then-attorney John Eastman disclosed that the House said it had accessed the emails on Friday.

The House probe has been fighting for the records for months, and a federal judge cleared the way for the committee to receive them in recent weeks, calling them possible evidence of the planning of crimes on Trump’s behalf.

Just wanted to point out that it was Kagan this time ordering a temporary stay. Thomas entered a stay and some folks screamed it was inappropriate.

Thomas is an embarrassment to the court, the judiciary, the USA, and the law; however, in the case of stay, it was not unusual.

J. Kagan is assigned to the 9th Circuit, which includes Arizona.

J. Thomas is assigned to the 11th Circuit, which includes both Florida and Georgia.

C.J. Roberts has the Federal Circuit, including DC.

None of this should be too surprising. It’s how the courts work. You petition the Justice in the relevant circuit, and he or she (or much more likely, the clerks) will apply some basic gatekeeping rules.

MEMORANDUM OPINION
Former White House chief of staff Mark Meadows challenges the validity of subpoenas issued by the Select Committee to Investigate the January 6th Attack on the United States Capitol. His claims raise a number of unsettled questions, including whether a senior aide to a former President can be compelled to testify before Congress; whether a former President can validly assert executive privilege; and whether a sitting President may override a former President’s claim of privilege. Before the Court can wrestle with those issues, however, it must first address whether the Speech or Debate Clause bars this suit. The Court concludes that it does, and it therefore dismisses Meadows’s claims for lack of subject-matter jurisdiction.
Judge Nichols found a way to punt the EP whine by saying "speech and debate clause." In this case, it was Meadows suing, so it would trigger the speech and debate clause whereas a criminal case against Meadows for contempt would not.

Except no, he won't. Wouldn't it be nice if you could get executive privilege for running for president?

We had a guy serving time in the West Virginia prison system who ran for president and became one of Orly's clients plaintiffs back in 2012, didn't we? I think we have to let that guy out if he says he's running for president. How's he gonna campaign if he can't leave his prison cell?

And Trump is going to have the same problems, the poor bunny. :violin:

Gene Debs ran for President five times. The last time he was in federal prison for his participation in the Pullman Strike.

So there is precedent for letting Trump campaign from federal prison. We should not let his potential candidacy get in the way of Justice.
