After billionaire Elon Musk — who is in the process of acquiring Twitter — said Tuesday he would let former President Donald Trump back on the platform if the deal is completed, former California Rep. Devin Nunes, the executive behind rival app "Truth Social," spoke to Fox News.

Nunes previously insisted that Trump will not return to Twitter if the ban was lifted (though there are reasons to be skeptical of that claim) and doubled down Tuesday when speaking to host Martha MacCallum.

"Look, we’re very supportive of what Elon is saying," Nunes said. "The question is, will he accomplish what he’s saying, dealing with all the employees, dealing with all the algorithms. But the goal has been for us, for President Trump, is to give the American people their voice back, and open the internet back up, and that's what we're trying to create.

"I would just add, though, I think there's an important point that's lost on people: Truth Social is wide open right now in the Apple app store, and you don’t have to ask anyone’s opinion. There’s no big tech tyrant that can cancel you, you don’t have to go to a billionaire to ask permission. You’re let on: Democrat, Republican, whoever you are. And we’re not going to censor you for political speech, so we are accomplishing what the mission of our company is, which is to get this internet open back up, and we're glad that Elon is saying the right things. Let's see if he backs that up."

Nunes, for whatever it's worth, is emphatic Trump won't tweet again. Nunes said his goal is to turn Truth Social into a platform reaching "tens of millions of Americans, ultimately" that is "a fun, safe place to be."

Company buying Truth Social warns investors about Trump business failures

The company merging with Donald Trump’s social media company to take it public in a filing Monday warned about the former president’s previous failed business ventures.

In the registration filed by Digital World Acquisition Corp (DWAC) — a special purpose acquisition company that has raised over $1 billion — and Trump Media & Technology Group (TMTG), the groups also warned that the Securities and Exchange Commission could still halt the merger.

The merger document, known as an S4, details several risks related to Trump’s chairmanship of TMTG.

“A number of companies that were associated with President Trump have filed for bankruptcy,” the document warns, listing Trump Shuttle, University, Vodka, Mortgage and Steaks.

Among other risk factors included in the filing is that Trump is “involved in numerous lawsuits and other matters that could damage his reputation.”

The filing noted the former president is “generally obligated” to post on Truth Social, where he has roughly 2.7 million followers, and “not make the same post on another social media site for 6 hours.”

However, there is an exception to that requirement for “political messaging, political fundraising or get-out-the-vote efforts.”

Former President Donald J. Trump could be paid to post for his own start-up company and it remains unclear if securities regulators would allow its merger with a cash-rich shell corporation to go forward, according to a securities filing on Monday.

The long-anticipated registration statement filed by the Digital World Acquisition Corporation said it anticipated completing the merger with the Trump Media & Technology Group in the second half of the year. But the document, known as an S4, said the Securities and Exchange Commission, which began investigating the proposed merger last year, could “disapprove this transaction and issue a stop order” that would block it.

Digital World said that Mr. Trump could be paid to post streaming videos on Trump Media’s video-on-demand service in certain circumstances. The licensing deal also does not require him to exclusively use Truth Social, Trump Media’s Twitter-like social media platform, and permits him to “post from a personal account related to political messaging, political fund-raising or get-out-the-vote efforts on any social media site at any time.”

If the former president does anything “illegal, immoral, or unethical,” it is not considered a breach of his agreement with the company, according to the filing.

The unusual licensing deal is unlikely to quiet concern that Mr. Trump will return to Twitter if Elon Musk completes his deal to acquire the much bigger social media platform. Mr. Musk, the world’s richest man, has said he would lift Twitter’s ban on Mr. Trump if he acquires the company; Mr. Trump has said he “probably wouldn’t rejoin Twitter if he could.”
