So, last I bothered reading up on this was 2018, so my info is not current, but at that time, the U.S. had no federal law to acknowledge or try Crimes Against Humanity; the only body that could is the International Criminal Court to which we are not a signatory power; and the ICC lacks the death penalty as a remedy.

Eh, I hate to say it, but I kinda agree with him on this. The rather poorly named Espionage Act has always been kinda iffy and historically has been used as a bit of a swiss army knife to go after political opponents with their 'disloyal' speech. What started as a wartime power by a fairly isolationist nation has morphed into a rarely (if erratically) used catchall for 'don't embarrass the US'.
