I don’t know why anyone would be shocked at the notion that Giuliani would be talking openly about claiming the election was stolen or voter fraud before it had even taken place. Trump was talking about it openly, told reporters that he’d only accept the results for sure if he won, and otherwise, “we’ll see,” or something like that. We all know at the time this was the plan.

I'm not shocked by any of Guiliani's gross, vile, disgusting behavior. I'm only shocked that he was so stupid as to allow Ms. Dunphy to record him at all times. As the Complaint alleges, he believed he was untouchable. So glad to see these disgusting creeps get their comeuppances.

Rudy is 78 years old. The Complaint alleges that he drank morning, noon, and night. He was drunk constantly and he gobbled Viagra. How is he still alive?

I ask because I am 71 and I enjoy some white wine in the evening, for which I get lectured by my doctors. I'll bet no doctor dared to lecture Rudy.

A little odd.

New York state has a screwy procedure for starting a lawsuit without serving a complaint, just a "summons and notice." See NY CPLR § 305(b) ("If the complaint is not served with the summons, the summons shall contain or have attached thereto a notice stating the nature of the action and the relief sought, and, except in an action for medical malpractice, the sum of money for which judgment may be taken in case of default.").

The "notice" is a very short description of the type of case and the relief sought. E.g., "Beach of contract for sale of a tractor-trailer, License number XXXX, seeking damages of $50,000." Or "Negligence resulting in automobile collision at Maple and Elm streets on February 14, 2022."

Once the defendant has been served and makes an appearance, she can make a demand for service of a full complaint.

It's a sloppy and risky way to start a lawsuit, usually used only by personal injury firms with a big portfolio of sketchy, low-value claims. In theory, though, it could be used in a dire emergency, when a client comes in days (or hours) before expiration of the statute of limitations, and the lawyer doesn't have time to do anything else.

The plaintiff, Noelle Dunphy, appearing pro se, commenced the action against Giuliani on January 3 with an eight-page summons and notice, which I've only glanced at.

I would guess that it was actually drafted for Dunphy by a lawyer who wasn't willing to take the case but was willing to help her get it started while she looked for counsel.

Giuliani appeared pro se on February 4 and demanded service of a complaint. On February 24 the plaintiff wrote to the judge requesting an extension:
Due to the high profile nature of the defendants, it has been a hardship securing legal advice and I request time
to vet candidates to assist with this claim.
May I have an extension to finish legal research to make a professional claim?

Lawyers from a smallish mid-sized firm appeared for the plaintiff on April 3, and filed the complaint today.

So. What puzzles me is why apparently no one noticed the notice when it was filed on January 3. It's not as graphic as the full complaint, but it would have been newsworthy.

A former aide to former Trump attorney Rudolph Giuliani says he told her the ex-New York City mayor and then-president Donald Trump were offering to sell presidential pardons for $2 million apiece, according to court documents.

The bombshell allegation was levied in a complaint filed against Mr Giuliani by Noelle Dunphy, a New York-based public relations professional who is suing him for “unlawful abuses of power, wide-ranging sexual assault and harassment, wage theft, and other misconduct” committed while she worked for him in 2019 and 2020.

Well, there's the offer, and then there's the taking. You can offer anything, and you're only guilty of deceit. You don't cross the line until you actually accept the money. And for that prosecution would need proof.

The court process is so strung out, so obscene, nobody of note will get restitution.

Mutts like those two aren't subject to consequences.

Dunphy’s 70-page suit cites multiple audio recordings and accuses Giuliani, 78, in graphic detail of subjecting her to sexual assault and harassment throughout her employment, forcing her to engage in “violent sex” and attend work video conferences naked and work in short shorts he bought printed with an American flag.

“He often demanded oral sex while he took phone calls on speaker phone from high-profile friends and clients, including then-President Trump. Giuliani told Ms. Dunphy that he enjoyed engaging in this conduct while on the telephone because it made him ‘feel like Bill Clinton,’” reads Dunphy’s suit.

“[Some] of the individuals who Giuliani spoke with on these calls were law clients of Giuliani (such as Mr. Trump), who were unaware that Ms. Dunphy was in the room and could overhear their conversations,” the suit details, describing some of the conversations as highly sensitive.

“These discussions included, for example, strategies as to how to deal with the investigation being conducted by Robert Mueller, and whether it might be possible to distract, intimidate, or otherwise dissuade Mueller from proceeding against Trump.”
