Then there are all of the GIL cases.
But there's little reason for Fitton Actual show up at court. It would be rare for Fitton's presence to be required. Or even useful.

If Fitton was pulling a Klayman, i.e., using the courthouse to tout something, Fitton would have been, well, touting.

But it appears Fitton was mum, which further suggests Fitton received a very special invitation (i.e., a subpoena) to appear.

"Heavily" is relative; yes, Fitton did jibber jabber about the 2020 election, but I don't recall how close he was to that inner circle in 2020-2021. (But closer than Klayman. )

Fitton, on the other hand, was heavily involved in the Mar-a-Lago documents affair, which also is part of Smith's portfolio.

Former national security adviser Robert O’Brien has been subpoenaed by special counsel Jack Smith in both his investigation into classified documents found at former President Donald Trump’s Mar-a-Lago residence and the probe related to efforts to overturn the 2020 election, according to a source familiar with the matter.

O’Brien has been asserting executive privilege in declining to provide some of the information that prosecutors are seeking from him, the source said.

CNN has reached out to O’Brien for comment.

The F.B.I. is searching Mike Pence's home after an aide recently found classified documents there, two people familiar with the matter said.

I don't think Pence is in any trouble at all. I believe it's been established that he's cooperating with the FBI doc searches. Thought it was clear that he, like Biden, had found docs that were marked classified that perhaps should not have been there (depending on what they are).

Doc handling. My favorite utterly boring topic.

Correct. from above article:
Mr. Pence’s aides have also emphasized cooperation.

Last month, Mr. Jacob disclosed that a “small number of documents” with classified markings had been “inadvertently boxed and transported” to Mr. Pence’s home in Indiana during the waning days of the Trump administration.

“Vice President Pence immediately secured those documents in a locked safe pending further direction on proper handling from the National Archives,” Mr. Jacob wrote.

Honestly, at this point you know they're going to search Obama's house(s). They have to. Trump is sending a team of investigators to Hawaii and you won't believe what they'll find!

Isn't this between DoJ and Pence? How can a third party dive in?

To claim executive privilege (presumably).

Generally speaking, third parties can seek to intervene to protect their rights.

Right, but what rights? The government wants their papers back. Literally none of that guy's concern.

I'm thinking you can't claim executive privilege when you're not the executive.

There are two separate issues.

Can third parties stick their noses into subpoenas not directed at them? Yes.

Will this particular nose be successful at quashing a subpoena? Most likely no.

Like MSW, err, wrote: the intent is likely just delay.

Trump attorney Christina Bobb appeared before a federal grand jury in Washington, DC, in recent weeks in connection with the investigation into former President Donald Trump’s handling of classified documents, two sources have told CNN.

Bobb’s appearance marks the second Trump lawyer involved with Trump’s handling of government documents to meet with the grand jury recently. CNN reported that Trump attorney Evan Corcoran appeared before the grand jury last month.

The Wall Street Journal first reported Bobb’s appearance.

The disclosure of the testimony by the Trump lawyers comes amid a steady drip of recent moves by special counsel Jack Smith to obtain grand jury testimony from very close contacts of the former president, in many cases about what Trump was told and what he said at the end of his presidency and afterward.

I don't think they're talking about intervening with the documents, but with the subpoena for Mike to testify about Jan 6 and what Trump said to him. pence, if he's truthful, could really hurt trump

Well, yes, but I meant pence could hurt trump in a criminal case IF we ever get that far. The fact that they're subpoenaing pence gives me a tiny little glimmer of a flicker of a smattering of something like hope, but I'm still not gonna make any bets on it happening.

Pence to fight subpoena from special counsel

Brett Samuels
Tue, February 14, 2023 at 1:32 PM GMT+1

Former Vice President Mike Pence is expected to resist a subpoena for testimony as part of a Justice Department special counsel’s investigation into former President Trump’s efforts to overturn the 2020 election, a source familiar with Pence’s plans confirmed to The Hill.

Pence is preparing to fight a subpoena from Jack Smith, the special counsel assigned by Attorney General Merrick Garland to oversee investigations into Trump, including one focused on the events of Jan. 6, 2021, and Trump’s efforts to remain in power.

Pence and his team say that serving as the former president of the Senate essentially makes him a member of the legislative branch and he would therefore be shielded from the subpoena under the “speech and debate” clause of the Constitution.
