If a mistrial would the judge have to opportunity to declare the charges dismissed with prejudice based on the defences claims above?
(Before the matter could be put in front of a different justice)

Oh, great question, Dave! I would like to know the answer to that, too.

I would think that as long as the judge allowed it to go the jury that he has lost the opportunity to declare a mistrial, but I sure as heck don't know that. I'm pulling that out of my "common sense" bag, which may not apply when it comes to the law.

Standard disclaimer and all that, but I don’t think that’s necessarily true. He has a motion currently pending before him. as long as he still has jurisdiction over the case, I think he can rule on it anytime, potentially even after the verdict, depending on what the verdict is. Rittenhouse is acquitted of all charges, I don’t think the judge can declare a mistrial. But if Rittenhouse is convicted on some or all of the charges, I think the judge probably can declare a mistrial while the case is still before him. But again, I don’t know about Wisconsin

If life were a TV show, Rittenhouse going to work for Gaetz would make for a fantastic train wreak of a season.

Though I suspect that if Rittenhouse is indeed acquitted, Gaetz will quietly forget his offer since the appearance of support is beneficial but I can not imagine he would make a good staffer.
