The article also specifically notes that the decision of the Arbitrator is not precedent but is "suggestive" to other arbitrators.

Cohen was a VP at the organization; I would guess it was either him, or someone who worked for him.

The money shot of that case it it might lead to all of the NDAs signed by anyone around him being unenforceable. He should have settled that case.

"For completeness," this 2018 article has the text of the NDA. And here is the arbitrator's decision.

No indicator who drafted (or signed) the NDA for the organization, but doesn't read like something written by a bottom-quartile graduate.

Trump Loses Attempt to Toss Eddy Grant’s ‘Electric Avenue’ Lawsuit

A judge ruled Tuesday that a copyright lawsuit brought by “Electric Avenue” singer Eddy Grant against former President Donald Trump can go forward. The parties are now expected to proceed to discovery.

U.S. District Court Judge John Koeltl rejected Trump’s motion to dismiss, which said the song’s use in an online ad for Trump’s unsuccessful re-election bid was “a different and transformed purpose from that of the original Song” and was useable due to fair use. Koeltl said the use was essentially “wholesale copying of music to accompany a political campaign ad.”

“While it is true that the animation is partisan political commentary and the song apparently is not, the inquiry does not focus exclusively on the character of the animation; rather, it focuses on the character of the animation’s use of Grant’s song,” he said.

Lawyers for Grant wrote in the complaint, reviewed by TheWrap, “Despite Plaintiffs having sent Defendants a letter the very next day objecting to Defendants’ infringement and demanding the removal of the infringing video and that Defendants refrain from further infringing Plaintiffs’ copyrights, and despite numerous comments on Mr. Trump’s August 12, 2020 tweet linking to articles reporting on the infringement, Defendants have continued to willfully and wrongfully infringe Plaintiffs’ copyrights.”

Doesn’t matter that he wasn’t in uniform. The DOD regulation draws a both a smudgy line and a fairly bright line: You can go to rallies in civilian clothes, but you cannot “participate” (whatever that means, presumably it’s more than merely attending, so, smudgy), and you definitely cannot “speak” (that’s pretty clear).

I’m of two minds about this (well, maybe a mind and a half). Military members should be permitted to attend partisan political rallies, and they shouldn’t be permitted to speak. But when a military member is put in the spot by a former president to come up and speak, should he be punished for that? Is the member supposed to embarrass the former president by declining?

Ordinarily I’d say no. Except that, and this is where he loses me, he either managed to let trump or his handlers know he was there, or he came by invitation. I mean, the likelihood that trump recognized him in the crowd is zero. So I wouldn’t be heartbroken if the Marines stomped on him a little for this.
