It's been a while since I looked at removal, but _if_ the Supreme Court's Calvin-Ball-like decision on presidential immunity created a new basis for federal jurisdiction (I doubt it), it's possible that Trump was entitled to a new and different bite at the apple. The law of federal removal has a surprisingly large number of tricky bits. But even if that were the case, I'm pretty sure that Trump had a deadline of 30 days from the date of the decision in which to file his notice of removal. It's not a deadline that can be extended.

I'd forgotten that this is federal officer removal of a criminal prosecution, and thus the 30-day deadline for removal of civil cases doesn't apply.

IIRC, removal from state court in criminal cases prevents the state court from entering a judgment, but it doesn't otherwise toll proceedings.

Is there any caselaw on removal of criminal cases after the completion of trial? I no longer have access to Westlaw or to Wright & Miller ...

The magic sentence is Smith saying that he's ready at the drop of a hat to detail not only what elements of the case survive the effing immunity ruling, but to also detail all of fuckhead's crimes, particularly those that haven't appeared in in the public docket. yet.

(And no, it doesn't have anything to do with Bragg, so yes, it was misplaced.).

Manhattan District Attorney Submits Response To Trump's Attempt To Stay Proceedings

The Manhattan District Attorney's Office has officially submitted its response to Donald Trump's second request to remove his criminal case from New York state court to New York federal court, along with his request to stay the state court matters until the issue of removal is dispensed with.

District Attorney Bragg's office begins the letter by noting that federal law is clear that a stay of the state court matter, specifically Justice Merchan's disposition of Trump's motion to vacate, should not be stayed pending the removal issues.

The response goes on to lambast Trump for creating the delays that he now takes issue with by stating that the delays are "a function of his own strategic and dilatory litigation tactics." In addition, the District Attorney's Office dispels with Trump's arguments that the January 6th indictment in D.C. would impact this schedule noting that the D.C. case has nothing to do with the New York case.

It is likely that Justice Merchan will reject Trump's second attempt, streamlining the case to a likely sentencing of Donald Trump later this month.

Team T made an error in the formalities: once the case in the circuit court has advanced past a certain point the defendant has to request leave to file in the Federal Court. Now they are nicley asking the judge to accept their filing. Expectations are that they will get a rejection.

Particularly the last sentence: "Nor does the pre-trial schedule in defendant's federal prosecution for corruptly interfering with the peaceful transfer of power after the 2020 election have anything to do with the post-trial schedule in this case."
