In a motion filed Thursday, Giuliani, who owes election workers Ruby Freeman and Shaye Moss $148 million for defaming them, asked a bankruptcy court in the Southern District of New York to let him keep his Florida condominium, valued at $3.5 million, as he fights the judgment on appeal.

The former New York mayor’s attorneys wrote in the 12-page motion that the recommendation by the Committee on Unsecured Creditors that he sell the home since declaring bankruptcy was premature.

“It appears that the Committee is assuming that most if not all of the Freeman judgment will survive on appeal, and is proceeding as if all of the Debtor’s assets need to be liquidated now to satisfy a potentially inflated claim. The debtor could be irreparably harmed if the Florida residence is sold and later it turns out that the Freeman judgment is vacated,” the instant motion states.

The committee told him there was “no legal basis” for him to keep the property.

Giuliani does not oppose the sale of his property in Manhattan, however. That property could be sold so he could make his primary residence in Florida, he contends. His lawyers noted that the New York property is expected to be listed by Sotheby’s soon for $5 million.

With that home sold, Giuliani said he expects “his monthly expenses will be significantly reduced.”

Though he claims creditors are accusing him of operating with “reckless abandon and improper judgment” in his attempt to hold onto the Florida property, Giuliani says he is “using sound business judgment” by acknowledging that one property must be sold while he keeps the other to “grow his broadcast income,” the motion states.

NEW YORK (Reuters) - A U.S. bankruptcy judge said Thursday that Rudy Giuliani could be headed for a "pyrrhic victory" in a dispute over whether he should sell his $3.5 million Florida condo.

U.S. Bankruptcy Judge Sean Lane said at a court hearing in White Plains, New York, that he would not immediately rule on creditors' attempt to force Giuliani, who is Republican former President Donald Trump's ex-lawyer, to list the property for sale, and he encouraged Giuliani and the creditors to work out a compromise.

Lane warned that creditors may escalate their efforts to control Giuliani's bankruptcy if their current request is denied, describing that as a possible pyrrhic victory in which someone wins a battle but loses a war.

"The debtor may succeed in fending off this motion, only to be faced with far more draconian requests for relief in the future," Lane said.

  • A lawsuit in Georgia is seeking the return of one of the biggest donations to the legal defense fund for Rudy Giuliani, who had been a top lawyer for former President Donald Trump.
    The suit argues that the $100,000 contribution by Matthew Martorano properly belongs to consumers who were defrauded with the help of software marketed by the donor and his business.
    A federal judge in January certified a nationwide class in a federal civil lawsuit against Martorano, his wife, a company called Konnektive LLC, and other corporate entities.
    Giuliani, Trump and other defendants are charged in a criminal case in Georgia with conspiracy in their efforts to reverse Trump’s loss in the 2020 election in the state to President Joe Biden.
One of the largest donations to Rudy Giuliani’s legal defense fund is at the center of a new lawsuit that argues the $100,000 contribution rightfully belongs to victims of an alleged online fraud scheme.

The donation by Matthew Martorano in September accounted for nearly 13% of all the money that Giuliani, the former attorney for Donald Trump and onetime New York City mayor, raised in the fund.

The fund was intended to help Giuliani pay for lawyers in the Georgia election interference case — where Trump is a co-defendant — and in a civil defamation case that Giuliani lost, brought by two Georgia election workers.

But the plaintiff in the new civil suit — filed after CNBC reported on Martorano’s donation earlier this year — claims that $100,000 flowed from Martorano’s participation in an alleged online skin care product scam. They are seeking “to unwind” the donation to Giuliani.

There is no public evidence that Giuliani and Martorano know each other. CNBC has asked a spokesman for Giuliani if they did.

Still, the claim adds another layer of legal wrangling to the fight over Giuliani’s remaining assets. The former mayor filed for bankruptcy protection in December, after a judge ordered him to pay the election workers $146 million.

Giuliani “should give all the money back” that he received from Martorano, said Kevin Kneupper, the attorney who filed the lawsuit alleging fraudulent transfer in Fulton County against Martorano, his wife and corporate entities on behalf of his client, LeAnne Tan, who is also the named plaintiff in the federal racketeering lawsuit in California.

Giuliani spokesman Ted Goodman, in an email to CNBC, said, “This is a lawsuit unrelated to us.” He had no immediate additional comment.

CNBC requested comment from lawyers for Martorano, his wife, and the other defendants in both the Georgia lawsuit and a federal civil racketeering and fraud lawsuit in California related to the alleged skin care cream scam. None of them responded to the requests.
The scam

In early January, a judge in San Diego overseeing the federal lawsuit certified a nationwide class in the lawsuit against the alleged skin care sales scammers, as well as against Martorano, his wife Kathryn Martorano, their company called Konnektive LLC, and other connected entities, collectively known as the Konnektive defendants.

In her ruling, the judge wrote the plaintiff “has shown by a preponderance of the evidence that Konnektive Defendants deceived banks and credit card companies.”

The suit alleges many people around the country were duped into signing up for a purported “free trial” of skin care cream products under the brand name La Pura.

“The scammers’ only goal is to fraudulently obtain the victim’s credit card or bank account information,” the suit says. “And once they have it, they begin billing their victims for subscriptions they never signed up for, never agreed to, and about which they were never properly informed.”

According to the complaint, Martorano’s company, Konnektive, provided software known as a “load balancer” to the entities that sold La Pura products and began charging people despite them being told it was a free trial offer.

The load balancer allegedly helps sellers hide from Visa and Mastercard the number of chargebacks from their customers. A high number of chargebacks — or reversal of charges to a customer’s account — is viewed by Visa and Mastercard as a sign of potential fraud, the suit notes.

“The Konnektive software was designed specifically for the purpose of facilitating automated bank fraud,” according to the federal suit. That complaint also says the software was specifically marketed to ” ‘free trial’ scammers at conferences which those scammers attend.”

Giuliani's attorney, Gary Fischoff, said at Thursday's hearing that Giuliani's creditors do not have legal authority to force a sale of the Florida condo at this stage in the bankruptcy, and that Giuliani intends to live there after selling his $5.6 million New York apartment.

Rachel Biblo Block, the attorney representing the creditors, said that Giuliani will not have enough money to pay all of his creditors and keep a luxury home in Florida. "The math doesn't work, you have to sell the Florida condo," Block said. Even if Giuliani can succeed in reducing the $148 million defamation judgment by 95%, it would wipe out his remaining assets, and his other creditors deserve to be paid too, Block said.

Giuliani's creditors also expressed alarm at the high maintenance costs incurred at the Florida property, which far exceed the $8,416 per month that Giuliani estimated at the beginning of his bankruptcy.

Lane said Giuliani should work quickly to clear up any question about the actual cost of maintaining Florida condo, after creditors said he has already spent more than $160,000 on maintenance costs since September 2023. "The numbers are sort of all over the place," Lane said. "The lack of financial information is a solvable problem, and it needs to be solved promptly."
Wonder if Roodles has any idea what's going on, these are all complex matters and he doesn't seem to be as healthy or sharp as he used to be. NYC's Mayor forced out of NY is tragic... and completely of Roodles' own doing.

Rudy Giuliani has lost his bid to dismiss the $148 million defamation judgment against him from late last year. The judgment was won by former Georgia election workers Ruby Freeman and Wandrea "Shaye" Moss.

"Giuliani's renewed motion urging this Court to reverse its prior findings and rulings and to override the jury's considered verdict on the basis of five threadbare arguments falls well short of persuading that 'the evidence and all reasonable inferences that can be drawn therefrom are so one-sided that reasonable men and women could not have reached a verdict in [plaintiffs'] favor,'" U.S. District Judge Beryl A. Howell said in her ruling Monday.
