Yes, he could claim.

Proving with competent, credible evidence is altogether different.
That's our bob!

I guess any such claim carries more weight if both alleged client and alleged attorney make the same claim. Without paper or payments, I can't imagine a court accepting the claim if one party says "no, that's not what happened". But surely Trump has never thrown anybody under the bus, has he? Except everybody.

Yeah, FAFO has a specific instantiation in WFTAFO (work for Trump…).

Poor darlings, if only my sympathy tank wasn't completely empty, I'd … who am I kidding? … I'd never care!
Lawyers are so precise in their language! You would think some of that would have rubbed off on me...

Georgia state Sen. Colton Moore, who demanded a special session of the Legislature for an investigation of Fulton County District Attorney Fani Willis (D), was indefinitely suspended from the chamber’s GOP caucus Thursday.

“Despite the fact 32 of 33 Republican State Senators, the Governor, Lt. Governor, Speaker of the House, and the Chairman of the Georgia Republican Party agree that a Special Session to take action against the Fulton County District Attorney is impossible, Senator Moore has a right to his opinion,” according to a statement posted to X, the platform formerly known as Twitter, by the Georgia Senate Republicans.

“However, during his advocacy for his ill-conceived proposal, Senator Moore has knowingly misled people across Georgia and our nation, causing unnecessary tension and hostility, while putting his Caucus colleagues and their families at risk of personal harm,” the statement continued.

Also from above:

The people of Georgia are 100% with me,” he continued. “This is the fight of our lifetime, and I will continue to double down to defend the rule of law and do what is right. I will continue to EXPOSE Fani Willis and the RINOs covering for her.”
I guess that explains why Georgia now has two GOP senators and the sitting R governor lost his primary to a trumper.

Oh wait.

https://www.cnn.com/2023/09/29/politics ... index.html

Fulton County prosecutors on Friday signaled they may soon extend a plea deal to one or both defendants headed to trial next month in the 2020 election subversion case in Georgia.

The revelation came during a procedural hearing for former Trump campaign lawyer Sidney Powell and Kenneth Chesebro, the alleged architect of the fake elector scheme. They are the first defendants in the case set to go on trial on October 23 on charges related to alleged plots to overturn the 2020 presidential election results in the state.

Trial dates for former President Donald Trump and the other 16 co-defendants have not been set.

Prosecutor Nathan Wade said during the hearing that while the district attorney’s office has not yet offered a plea deal to Powell or Chesebro, it may soon.

“We have not, at this point, made an offer,” Wade said during the hearing.

“Is the state in a position to make one in the near future?” Judge Scott McAfee, who is presiding over the case, asked.

“Judge, I believe that we can,” Wade said. “We’ll sit down and kind of put some things together, and we’ll reach out to defense counsel individually to extend an offer.”

Defense attorneys didn’t address the potential for a plea deal during the hearing, and if offers are extended, they could still opt to go to trial.

Does this mean that Powell is going to flip in some way? Her reputation has suffered mightily in the integrity and sanity departments, that’s for sure. Could GA actually have any use for whatever she might reveal to them, given her highly-questionable reliability :?:

So I listened to today's weekly zoom status meeting with McaFee (in chambers), the State lawyers, and two (possibly 3) defense lawyers. Thoughts:

McAfee is a cool cucumber--amiable, smart, not overly in love with the sound of his voice, and even-handed. Like if Stephen Richer had decided to be a judge. The meeting was therefore business-like, and productive, and courteous. Mostly.

So who the heck is Scott Grubman, Chesebro's hotshot lawyer? The guy all the pundits have been saying is a super-duper brainiac lawyer who would be the Cheese's savior? He stood out at the initial meeting/hearing as "the obnoxious one," who reacted to the state's attorney bringing up some bad behavior on the part of one of the defense lawyers with shouting and condemnation and aggression. Going 0 to 100 in an instant. I'll give him the benefit of the doubt and conclude that what the state's attorney said was rude, but I also note that he had many other choices for how to respond other than lashing back with even greater offensiveness.y,

So today, Grubman was late to the meeting by a couple of minutes, but his sort of distant humbleness about it sent up a flag for me. It's all about Grubman, who artificially softens his voice and is the textbook definition of "serious." Then, near the close of the meeting, which (see above) had been congenial and productive and wholly without friction, he brought up an issue which involved working out potential conflicts. Apparently the State had filed something and he had filed a reply, but...

"In my not that many years of experience, usually a prosecutor will give the very basic professional courtesy of reaching out to ask. Mr. Wade decided that that was not something the state wanted to do in this case and that is his prerogative. ... I ask Mr. Wade and his team to please pick up the phone next time and call, because I don't think we need to take the Court's time on every little thing, and we certainly will try to return that basic professional courtesy that usually lawyers in the State of Georgia usually give to each other

Yes I know it's a laughably small bit of friction, but the attempt to needle was clear and, IMO, dumb. MaAfee was grinning when he responded by promising to do a short order, and grinning even more when he addressed the State's Attorneys, who were grinning even more widely.

Why do that? I guess it's his schtick.

The Hill: First defendant in Trump Georgia case pleads guilty:
A co-defendant in the sweeping Georgia election interference case involving former President Trump has become the first to plead guilty to his charges in the case.

Scott Hall, a bail bond business owner, pleaded guilty before Judge Scott McAfee Friday afternoon after reaching a plea agreement with prosecutors.

* * *

He was reportedly among a group of individuals who breached a Coffee County election office on Jan. 7.

He faces seven charges linked to that effort, including state Racketeer Influenced and Corrupt Organizations (RICO) Act charges. He pleaded guilty to five charges.
The maxim is the first to plea gets the sweetest deal.

5 years probation and has agreed to testify truthfully. Woot woot. He was also the first one to turn himself in. Interesting.

Sure is! This will lead to a crumbling of a unified front from the defendants and a rush for some of them to the exit to see if they can also get a sweet deal for turning. In my opinion...

In our annual antitrust training sessions they always made a big point that if we ever found ourselves in a questionable situation it was vitally important to report it to the company legal department immediately. The company wanted to be the first to report such things to the proper authorities.

“First co-defendant in Trump Georgia election case pleads guilty”:
https://www.cnbc.com/2023/09/29/first-c ... uilty.html

Hall will avoid spending time behind bars as part of the deal negotiated with prosecutors.
He guilty to five misdemeanor counts of conspiracy to commit intentional interference with performance of an election, Judge Scott McAfee said during a hearing in Fulton County Superior Court on Friday afternoon.
“Hall will serve five years of probation as part of the sentencing agreement. He will also have to pay a total of $5,000 and serve 200 hours of community service, the judge said in that hearing.
Hall was originally charged with seven counts in the case, which alleges an illegal conspiracy by Trump and the other defendants to overturn President Joe Biden’s electoral victory in Georgia’s 2020 election.
Hall was accused of willfully tampering with electronic voting machines in Coffee County, Georgia, and of working with multiple other co-defendants, including the pro-Trump lawyer Sidney Powell, as part of that effort.”

This is the class mafia RICO strategy: The solider knows little about the organization's workings. So you flip the soldier to get to the lieutenant (who gave the orders to the soldier), who knows more. Then you flip the lieutenant, and continue up the food chain.

Hall got five years probation. My bet is Sidney Powell’s doing at least some jail time, even if she pleads guilty.

I do. Clients would often get cold feet about the plea agreement and I’d have to remind them that without it, they could be doing a lot more time.

In those days the defense and the government would enter an agreement, but the judge wouldn’t know the terms. Both sides would put on a sentencing case, and the judge would adjudge a sentence, then unseal the agreement. The accused got the lesser of the adjudged and agreed-upon sentence, so as defense counsel I was always trying to beat the deal. That only happened a handful of times.
