A federal judge has denied Donald Trump’s request for a new trial in the E. Jean Carroll case – finding the jury who found that the former president sexually abused and defamed Carroll did not reach a “seriously erroneous result.”

“The jury in this case did not reach ‘a seriously erroneous result,” Judge Lewis Kaplan said. “Its verdict is not ‘a miscarriage of justice.’”

Trump had asked for the new trial after the jury awarded magazine columnist E. Jean Carroll $5 million in damages.

“Now that the court has denied Trump’s motion for a new trial or to decrease the amount of the verdict, E Jean Carroll looks forward to receiving the $5 million in damages that the jury awarded her in Carroll II. She also looks forward to continuing to hold Trump accountable for what he did to her at the trial in Carrol I, which is scheduled to begin on January 15, 2024,” said Roberta Kaplan, attorney for Carroll.

IANAL, but has always been my understanding that, at least in a criminal trial, the defendant can't appeal on the grounds that "the jury got it wrong". I realize that this is a civil case, not a criminal one, so maybe the rules are different.

I thought that, in general, a defendant can appeal if there is new evidence, not available at trial (and not simply not entered by defense counsel), or that the judge made an error in law. Perhaps the judge allowed evidence or testimony that shouldn't have been allowed, or disallowed evidence that should have been shown to the jury. Or the judge incorrectly denied or sustained an objection. Perhaps improper jury instructions were given. That sort of thing.

But you can't simply say that the jury came to the wrong conclusion, unless you can show juror bias. You can't say "let me argue my case one more time". There are no second bites from the apple.

A losing appellant can always claim there was insufficient evidence to support the factfinder's verdict.

But the standard on appeal is rather high; it is a difficult (but not impossible) claim to make.

Dismissing the counterclaim, a judge in New York, Lewis A Kaplan, said that when Carroll repeated her allegation that Trump raped her, her words were “substantially true”. Kaplan also set out in detail why it may be said that Trump raped Carroll.

Isn't it Finland where fines (such as for speeding) are linked to income? I want to say I saw a $100k+ speeding ticket there once. Perhaps punitive damages should be linked to a percentage of income, as opposed to just a number. $100k would hurt me very badly, but tfg would sneeze at it. Probably.

Germany, Austria, France and the Nordic countries all have income or wealth based traffic fines.

I think one of the IKEA heirs got a speeding ticket that cost about what I make in a year in Norway (strange because IKEA is Dutch but here you are...) and I know a case in Sweden where a traffic ticket cost a guy more than he paid for the Shelby GT 500 he got it in.
There was also a fine over a quarter million dollars for speeding in Switzerland (thank you Enzo Ferrari).

Germany is the one that gets me, because Autobahn and all. How ironic would it be to get a six figure speeding ticket in a country where a lot of the highways don't even have speed limits.
