A judge has now clarified that this is basically a legal distinction without a real-world difference. He says that what the jury found Trump did was in fact rape, as commonly understood.

The filing from Judge Lewis A. Kaplan came as Trump’s attorneys have sought a new trial and have argued that the jury’s $5 million verdict against Trump in the civil suit was excessive. The reason, they argue, is that sexual abuse could be as limited as the “groping” of a victim’s breasts.

Kaplan roundly rejected Trump’s motion Tuesday, calling that argument “entirely unpersuasive.”

“The finding that Ms. Carroll failed to prove that she was ‘raped’ within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump ‘raped’ her as many people commonly understand the word ‘rape,’ ” Kaplan wrote.

He added: “Indeed, as the evidence at trial recounted below makes clear, the jury found that Mr. Trump in fact did exactly that.”

Kaplan said New York’s legal definition of “rape” is “far narrower” than the word is understood in “common modern parlance.”

Two years after Eliyahu Weinstein’s release, prosecutors say he hasn’t changed.

A New Jersey man who had his prison sentence commuted by then-President Donald Trump was charged on Wednesday in a new, sophisticated fraud scheme that included falsely promising deals to send supplies to Ukraine.

The U.S. Attorney’s Office in New Jersey charged Eliyahu Weinstein and four others in a plan that allegedly cost investors millions of dollars. In addition to Weinstein, 48, of Lakewood, the office charged Aryeh “Ari” Bromberg, 49, and Joel Wittels, 57, also of Lakewood; Shlomo Erez, 55, a citizen and resident of Israel; and Alaa Hattab, 34, of Ottowa, Canada. They were each charged with one count of wire fraud conspiracy and one count of conspiracy to obstruct justice.

Weinstein had been serving a lengthy prison sentence for being convicted in two cases — a Ponzi scheme and real estate fraud — that led to more than $230 million in investor losses when Trump commuted his sentence in January 2021. His release was part of a wave of clemency actions by Trump that included commuting the sentence of Salomon Melgen, a Florida eye doctor and major donor to U.S. Sen. Bob Menendez, and pardoning George Gilmore, New Jersey’s powerful Ocean County Republican chair.

Weinstein’s shortened sentence also had the support of U.S. Rep. Jeff Van Drew (R-N.J.), who did not immediately return a call seeking comment.

But two years after Weinstein’s release, prosecutors say Weinstein hasn’t changed.

Federal prosecutors investigating Donald Trump’s efforts to overturn the 2020 election results have evidence to charge the former president with three crimes, including section 241 of the US legal code that makes it unlawful to conspire to violate civil rights, two people familiar with the matter said.

The potential charges detailed in a target letter sent to Trump by prosecutors from the office of special counsel Jack Smith, who also charged Trump with retaining classified documents last month, was the clearest signal of an imminent indictment.

Prosecutors appear to have evidence to charge Trump with obstruction of an official proceeding and conspiracy to defraud the United States based on the target letter, two statutes that the House select committee examining the January 6 Capitol attack issued criminal referrals for last year.

The target letter to Trump identified a previously unconsidered third charge, the sources said. That is section 241 of title 18 of the US code, which makes it unlawful to conspire to threaten or intimidate a person in the “free exercise” of any right or privilege under the “Constitution or laws of the United States”.

The statute, enacted to protect the civil rights of Black voters targeted by white supremacy groups after the US civil war, is unusual because it is typically used by prosecutors in law enforcement misconduct and hate crime prosecutions, though its use has expanded in recent years.

What the potential charges means for Trump is unclear.

Prosecutors have been examining various instances of Trump pressuring officials like his former vice-president Mike Pence, but Trump’s efforts to obstruct the transfer of power could also be construed as conspiring to defraud voters more generally.

A magistrate judge on Thursday placed a protective order over a forthcoming deposition by former President Donald Trump in his $500 million lawsuit against his former lawyer and fixer Michael Cohen in a dispute with implications for the former president’s criminal case in New York.

The judge, Edwin Torres, ordered both the transcript and video from the deposition be kept confidential — at a minimum until he finishes setting the parameters for what evidence in the case will be made public or kept from the public. The civil lawsuit in question, which Trump filed in April, alleges that Cohen violated attorney-client confidentiality.

Trump is seeking $500 million in damages, alleging Cohen violated their agreements through his book, media appearances and podcast discussions. Thursday’s court proceedings centered on what evidence should be made public in the lawsuit, which has garnered much less publicity than Trump’s two high profile criminal cases or the sexual abuse and defamation civil suit he lost in May.


While the case against Cohen has gone under the radar, the hearing at the courthouse showed how evidence presented in the dispute could affect Trump’s other legal entanglements. It also demonstrated that Trump’s penchant for filing lawsuits against people he regards as enemies opens Trump to the possibility of his nemeses essentially rummaging through many of his highly personal records.

Michael Cohen reached a settlement with the Trump Organization in a dispute over nearly $1 million in unpaid legal bills, averting a civil trial set for Monday.

During a court hearing Friday, lawyers for Cohen and the Trump Organization announced they reached the settlement and said the terms were “confidential.”

Cohen sued the Trump Organization in 2019 alleging that he had agreements – both written and oral – that his legal bills would be paid in connection to numerous investigations, but the real estate business stopped funding those bills when he split from Trump and began cooperating against them.

The Trump Organization said it covered Cohen’s legitimate bills but says he is not indemnified for voluntary cooperation he gave following his guilty plea for lying to Congress, campaign finance violations and other crimes.

“Here, Plaintiff’s involvement arose and occurred because of his own initiative, and his own predicament, resulting from his own misconduct, and was undertaken for his own purposes,” the Trump lawyers wrote in court filings.

“These actions – the crimes, and the cooperation – defeated the purpose of, and thus effectively terminated, any oral agreement that might have existed for indemnification,” Trump attorneys wrote.

Jurors were selected and sworn in this week. Opening statements were set for Monday and the trial, which was expected to include testimony from Cohen and Donald Trump Jr. – but not the former president – was expected to last about a week.
