I don’t know why anyone would be shocked at the notion that Giuliani would be talking openly about claiming the election was stolen or voter fraud before it had even taken place. New York state has a screwy procedure for starting a lawsuit without serving a complaint, just a "summons and notice." See NY CPLR § 305(b) ("If the complaint is not served with the summons, the summons shall contain or have attached thereto a notice stating the nature of the action and the relief sought, and, except in an action for medical malpractice, the sum of money for which judgment may be taken in case of default.").
The "notice" is a very short description of the type of case and the relief sought. E.g., "Beach of contract for sale of a tractor-trailer, License number XXXX, seeking damages of $50,000." Or "Negligence resulting in automobile collision at Maple and Elm streets on February 14, 2022."
Once the defendant has been served and makes an appearance, she can make a demand for service of a full complaint.
It's a sloppy and risky way to start a lawsuit, usually used only by personal injury firms with a big portfolio of sketchy, low-value claims. In theory, though, it could be used in a dire emergency, when a client comes in days (or hours) before expiration of the statute of limitations, and the lawyer doesn't have time to do anything else.
The plaintiff, Noelle Dunphy, appearing pro se, commenced the action against Giuliani on January 3 with an eight-page summons and notice, which I've only glanced at.

I would guess that it was actually drafted for Dunphy by a lawyer who wasn't willing to take the case but was willing to help her get it started while she looked for counsel.
Giuliani appeared pro se on February 4 and demanded service of a complaint. On February 24 the plaintiff wrote to the judge requesting an extension:
