I think Heath had filed for a writ of mandamus in the AZ Supreme Court to have them force Judge Thompson to vacate his order in the election contest. It was therefore filed as Heath v Judge Thompson. Of course they dismissed that and said that he could seek leave to file an amicus brief in the Court of Appeals. This ruling was issued on the 27th. The deadline for amicus briefs in the Court of Appeals was the 26th.

Heath refiled his writ in the Court of Appeals on the 31st. The Court of Appeals filed it as an amicus brief and denied it because it was after the deadline. So Heath has now gone whining back to the Supreme Court because they put him in a Catch 22 and wants them to force the Court of Appeals to accept his important pile of dog poop.

No, you could not make this up.
