He's arguing that the 72 percent of exit polls completed (the respondents were contacted beforehand), when the average completion percentage of over 90 percent, shows that some 20 to 30,000 voters intended to vote, but where discouraged from voting by long lines in the early morning (and maybe other issues, but I didn't hear that. He (the witness) claims that "Lake would have won if not for election day chaos" that prevented voters from carrying out their intention to vote.

Yesterday, an Arizona judge oversaw 7 hours of arguments in day 1 of Kari Lake's trial contesting her loss in the Arizona governor's race.

Here is our detailed summary of what happened, including testimony from 6 of Lake's witnesses.

Plaintiff has presented pretty much the same lack of evidence (certainly any credible evidence) of anything she had to prove on the 2 remaining counts. Her so-called experts have been a complete joke. There is no way an honest judge finds in her favor. This one has bent over backwards for them, so we'll see. Perhaps just trying to plug any appeal holes.
I read this to get the writer's take on Heather Honey, the "Elections Investigator" (Because that's a thing, now). She was the best of Lake's witnesses; she told the truth as far as it went and didn't stretch. Most of what she said was hearsay, so I expected the State's cross to point that out. He did bring out that she did not know much about election law, but other than that, it was an utter bust of a cross.

It seems that the State established its position that Heather Honey's testimony was all hearsay with its repeated objections during her direct.

There was no 19" ballot. This is an invention by Team Lake. The general election ballot image files were all designed to print on 20 in paper. The defense offered two reasonable explanations for what happened. One or both could have happened. First after the local scanners began to reject some ballots as unreadable some of the election officials may have tried changing the ballot printer settings to "print to fit" (and not "fit to print" as the Lake attorney kept stupidly saying ad nauseum). Second the last expert said a 19" ballot image file was used in the August primary and the laptops at some of the vote centers may have retained these settings.

Both are benign and reasonable explanations for what happened. And as the defense pointed out there were procedures in place to make sure that ballots that are rejected either by local vote center scanners or scanners at the central counting facility are duplicated by a bipartisan panel and counted. The Lake idiots failed to provide evidence that a single vote was rejected due to printer issues.

Did they take some 19" ballots and try to run them through the machine? Because if they want to show they don't work, that seems like a really good way to make their case.

Actually there was testimony that in one of the previous but not long ago elections that the ballots were 19", and one of the possibilities was that those printers were not changed back to print on 20" paper.

Watched day 2 including closings in Lake v Hobbs, which I now think of as "Kari Lake does her bit to chip away at the US election system."

For the two remaining courts, Lake's crew was out to show that either election machine providers or MC election officials/workers had intentionally tried to cheat.

Their entire case was to intentionally mischaracterize the process in support of the idea that MC election officials/workers might have thus had an opportunity to add ballots to the pile. Not exactly evidence of specific workers doing specific acts. Also absurd, doubly so, since they made no attempt to explain why, therefore, in the end, the number of people who voted matched up with the number of votes.

Tom LIddy, son of notorious G Gordon LIddy, went fire and brimstone in his brief closing; he is spot on; this was nothing more than an attempt to undermine the system. He went to the brink of saying, but did not say, that the calls by Lake and the Republicans in AZ to not vote until the very last second, and never use a drop box, was in itself the first step in the plan to eventually claim fraud. He's right.

ETA: Another of the plaintiff's arguments in favor of illegality having occurred was the large numbers of AZ voters who doubt the system. Figure that out.

I watched today's hearing. As everyone commented, what a waste of time and money. Even the plaintiff's attorney said there were not enough votes that might be changed to make a difference. Because they found only four votes that might or might not be switched from one candidate to the other--three of which would have been switches to Mayes, the Dem. Plaintiff att.'s position was, "Well, true, we're going to lose, but wasn't this a great exercise to prove to the voters that we're making sure the system is honest?" Def. Att. gave a resounding NO to that; what if every damned election ended up in court? What about the presumption that duly elected/appointed/trained/evaluated election officers/workers would carry out their jobs without criming?

The judge closed by saying he was dismissing the case, though he was kinder to Hamedah than the defense attorneys were. He said, "The system worked as it is designed to work." Hence the ruling.

Once again, defense attorneys from the county and state were pushing "This has to stop! You're undermining our election system! We will ask for sanctions!" Though the Plaintiff att. was not at all the lying SOBs grifting off of the Kari Lake case. Doubt he'll be sanctioned. Hamadah never claimed criminal intent, just wanted to recount various types of ballots to find mistakes.

ETA: One curiosity to me. Turns out the county (?) only hires registered independents or libertarians as poll workers/other workers, to avoid possible partisanship. That was a new one to me; I assumed (bad me) that all counties had teams of equal number of Dems and Reps to do everything.

What I understood is that the ballot adjudication boards consisted of one member of each major party and an independent or libertarian hired and trained by the County. I am not sure that applied to all poll workers.
