A report published by the Washington Post claims that money from Donald Trump’s political action committee paid the legal bills of some witnesses involved in the US justice department’s criminal inquiry into the former president’s improper handling of classified documents.

They include the former Trump adviser Kash Patel, who was granted immunity last month for his grand jury testimony, the newspaper says, citing anonymous sources said to be familiar with the matter.

Another is the valet Walt Nauda, who told FBI agents that he had moved boxes at Trump’s direction around his Mar-a-Lago resort in Florida while the government was trying to retrieve documents and records that should have been preserved in Washington DC, according to the Post.

The payment of witnesses’ legal fees by a political group whose purse strings Trump controls, while not illegal, raises ethical concerns and poses a conflict, the Post says.

It quotes former federal prosecutor Jim Walden, who questioned if the payments to witnesses’ lawyers by the Trump fund influenced their testimony or level of cooperation.

“It looks like the Trump political action committee is either paying for the silence of these witnesses, for them to take the fifth [amendment] or for favorable testimony,” he said, referring to the constitutional protection against self-incrimination.

“These circumstances should look very suspicious to the justice department, and there’s a judicial mechanism for them to get court oversight if there’s a conflict.”

Lawyers for former president Donald Trump conducted a search of at least two of his properties for classified materials in recent weeks, after they were instructed by a federal judge to attest they had fully complied with a May grand jury subpoena to turn over all materials bearing classified markings, according to people familiar with the matter.

Trump’s legal team hired an outside firm to carry out the search of his golf club in Bedminster, N.J., and, more recently, Trump Tower in New York, according to the people, who spoke on the condition of anonymity to discuss sensitive information.

The team also offered the FBI the opportunity to observe the search, but the offer was declined, the people said. It would be unusual for federal agents to monitor a search of someone’s property conducted by anyone other than another law enforcement agency. Federal authorities have already searched Mar-a-Lago, Trump’s primary residence, and he spends almost all of his time at those three properties, advisers say.

Oh, I agree. Which is why I think it'll be just a stay-pending-briefing stay, i.e., you get a stay for a week to file something; if you file something before then, then the stay is extended until we rule on what you filed.

Even if the thing filed is just an application for a stay pending the filing of a cert. petition.

Taking away the publicity and noxious litigant, it is a common-enough move for appellate courts, especially federal ones.
And maybe that's why Trump's lawyers are waiting until late in the day, as opposed to filing several days ago, which would have given the 11th Circuit adequate time to evaluate his motion for a stay, as well as given him time to appeal denial of the stay to the Supreme Court. I dunno, I would have filed sooner. They should have started working on the stay motion immediately after oral argument.

Why be competent when your goal is just to create chaos, and to get a delay from the chaos you caused (instead of, ya know, actually earning one)?

The discovery of the documents came as series of searches were conducted by a team hired by the former president, after a federal judge directed his lawyers to look for any materials still in his possession.

Former President Donald J. Trump hired people to search four properties after being directed by a federal judge to look harder for any classified material still in his possession, and they found at least two documents with classified markings inside a sealed box in one of the locations, according to a person familiar with the matter.

Mr. Trump’s search team discovered the documents at a federally run storage site in West Palm Beach, Fla., the person said, prompting his lawyers to notify the Justice Department about them.

I was surprised to read they found anything, not that trump wasn't still hiding papers, just that anyone he hired would actually look.

Were they looking only for documents labelled "Classified" or were they looking for any Government-owned documents?

Most of the documents seized at Mar-a-Lago were not classified; they were simply government documents that TFG had no right to take when he left the WH.

They also should be looking for expensive gifts from foreign dignitaries and governments. There have been reports that he believed that such gifts were his personal property and were his to keep. Aides reportedly had to explain to him, on multiple occasions, that federal law prohibited him from keeping such gifts.

Emails released by the General Services Administration, which assists former presidents during their transition to private life, show that the government agency helped rent the storage unit at a private facility in West Palm Beach on July 21, 2021. The unit was needed to store items that had been held at an office in Northern Virginia used by Trump staffers in the months just after he left office.

The thing to remember about this rapidly shifting more-classified-documents story is that the information seems to be coming entirely from Team Trump.

Something is going on . . . but we don't know what.
People close to Mr. jTrump had said earlier on Wednesday that no classified material had been found during the searches, a claim that was later proved incorrect. The Washington Post first reported on the locating of the two additional documents, as well as the searches of the properties.

I just reread the order from the 11th Circuit issued on the the 1st:
Absent a stay or withholding of the mandate in the appeal to
which this order is appended, the clerk is directed to issue the man-
date after seven (7) days of the date of this opinion. Consistent with
Eleventh Circuit Rule 41-2, the clerk is directed to provide the ac-
tive members of this Court with notice of the issuance of this opin-
ion and our direction to expedite issuance of the mandate.
I assume that means it will be issued today? He's cutting it close.

This could be Trump’s lawyers not understanding how a stay might work, to them deciding not to tell Trump they could ask for a stay, or maybe something else entirely.
