Okay, so it's a pure politics/optics thing, then. Since I would think congressfolk have been prosecuted before directly by DoJ. It's a sensibility issue.
Yeah, and as you note, it cuts the other way as well: The FBI/DOJ directly have gone after members of Congress before, such as ABSCAM. But the FBI's conduct in ABSCAM led to criticisms, which led to crimefighting reforms.
So, regardless of who are the targets here, this appointment ultimately is politics/optics/sensibilities.

Emptywheel has reason to not always believe people are who they say they are or are saying what they mean. She’s been seriously burned by Greenwald, among others, though I don’t know exactly what happened, and she’s among the most careful when it comes to researching before speaking.
My impression after reading her stuff for awhile is… different than that.

Newly-appointed special counsel Jack Smith is moving fast on a pair of criminal probes around Donald Trump that in recent months have focused on the former president’s state of mind after the 2020 election, including what he knew about plans to impede the transfer of power, people familiar with the matter tell CNN.
Though he remains in Europe recovering from a biking accident, Smith has made a series of high-profile moves since he was put in charge last month, including asking a federal judge to hold Trump in contempt for failing to comply with a subpoena ordering him to turn over records marked classified.
Since Thanksgiving, Smith has brought a number of close Trump associates before a grand jury in Washington, including two former White House lawyers, three of Trump’s closest aides, and his former speechwriter Stephen Miller. He has also issued a flurry of subpoenas, including to election officials in battleground states where Trump tried to overturn his loss in 2020.
Smith takes over a staff that’s already nearly twice the size of Robert Mueller’s team of lawyers who worked on the Russia probe. A team of 20 prosecutors investigating January 6 and the effort to overturn the 2020 election are in the process of moving to work under Smith, according to multiple people familiar with the team.

The requested communications include those with Trump’s campaign manager, Bill Stepien, and other advisers, such as Boris Epshteyn. Attorneys identified include Trump campaign lawyers Justin Clark and Matthew Morgan, as well as those serving in other capacities, such as John Eastman, Rudolph Giuliani, Sidney Powell and Cleta Mitchell.
The subpoenas, while sent out by Smith, were also signed by Assistant U.S. Attorney Matt Burke.
NBC News confirms: Officials in Clark County, Nevada have been subpoenaed by Special Counsel Jack Smith — called to testify before a grand jury or provide documents and records to the FBI.

BREAKING: Remember how the DoJ gets a warrant to seize the phone, then gets a second warrant to get the contents? That's this. For a republican member of congress who participated in the fraudulent elector scheme and DoJ scheme to overthrow the government.

I just found out about a new podcast called Jack. Allison Gill, creator of Mueller She Wrote, has teamed up with Andrew McCabe on this new podcast that will go through all of the Special Counsel filings, typical process and anything related to this investigation. I am just now starting to listen to the first episode, there are only two so far. I did a search for "Jack" on my Apple podcast app and found it with no problem.
There's a lot of things that need to change. One specifically? Police brutality.

Please tell me they have Sean Hayes do his "Just Jack" bit as the intro. Please.

OLSON: called Donald on Christmas Day 2020 and suggested martial law, firing acting AG Rosen, tampering with the DoJ, AND he’s so smart he wrote all the crime ideas down in a memo and sent it to trump.
