As has been mentioned upthread, being in the house is not a requirement for Speaker -- Liz Cheney is actually someone for whom a few Republicans might be willing to vote. Certainly she should be a slam-dunk choice over Kevin McCarthy to any Democrat.

Even though the Constitution does not explicitly require the Speaker to be chosen from among the members of the House, I think it was assumed that the Speaker would be a member. The Articles of Confederation were explicit about this.

I have questions.

Would there be a salary paid to a Speaker who was not a member of the House? How would that be done? What rights would a non-member Speaker have? Does the House have any rules that exclude non-members from some activities that would be required of a Speaker? Does the Speaker have no duties of any kind whatever that require them to be a member of the House?

The House sets its own rules for such matters. They are not bound (except by the inertia of tradition) to rules of prior Congresses.

I think it is unlikely that they will reach outside their own body for Speaker. Not impossible, but unlikely.

EDIT to add: It’s not yet a foregone conclusion that they will have the choice. They have the edge right now, but that’s not the same as having a majority. As of this edit, they need 7 more called seats.
