Remember in light of these comments that Reffitt's wife, Nicole, was joined by Ashli Babbitt's mother in court today and after Reffitt was convicted at trial she told other Jan. 6 defendants not to take plea deals.

Reffitt initially was denied bail pending trial in 2021.

Reffitt could ask for bail pending appeal, but that's unlikely to be granted, so I wouldn't be surprised if he doesn't even ask.

To qualify for the terrorism enhancement under the federal sentencing guidelines, there has to be a “federal crime of terrorism.” As I understand it, those crimes are specifically identified in the guidelines, and it doesn’t appear that the judge believed Reffitt committed any of them. I don’t have an opinion one way or the other on the judge’s ruling, but I don’t believe he was charged with any of those crimes.

That’s not to say that others who, unlike Reffitt, entered the capital and damaged government property, might not earn the enhancement. Time will tell.

The federal crimes of terrorism are defined in the link under section (g)(5).

Guy Reffitt, the Texas man who was first to stand trial in a Capitol riot case and was convicted by jury of bringing gun on to Capitol grounds, is now serving his prison sentence at the La Tuna federal correctional facility in Texas.
